117117 (1) to achieve a fair, equitable, and final settle-13
118118 ment of all claims to water rights in the Zuni River 14
119119 Stream System in the State for— 15
120120 (A) the Tribe; and 16
121121 (B) the United States, acting as trustee 17
122122 for the Tribe; 18
123123 (2) to authorize, ratify, and confirm the Agree-19
124124 ment entered into by the Tribe, the State, and var-20
125125 ious other parties to the extent that the Agreement 21
126126 is consistent with this title; 22
127127 (3) to authorize and direct the Secretary— 23

142142 tled ‘‘United States v. A&R Production, et al.’’, Civil 10
143143 No. 01–CV–00072, including the subproceeding Civil 11
144144 No. 07–CV–00681, pending as of the date of enact-12
145145 ment of this Act in the United States District Court 13
146146 for the District of New Mexico. 14

148148 GREEMENT.—The term ‘‘Agreement’’ 15

150150 (A) the document entitled ‘‘Settlement 17
151151 Agreement to Quantify and Protect the Water 18

239239 SEC. 103. RATIFICATION OF AGREEMENT. 17

244244 title, and to the extent that the Agreement does not 20
245245 conflict with this title, the Agreement is authorized, 21
246246 ratified, and confirmed. 22

249249 Agreement, or to any attachment to the Agreement 24
250250 requiring the signature of the Secretary, is executed 25

260260 N GENERAL.—To the extent the Agreement 5
261261 does not conflict with this title, the Secretary shall 6
262262 execute the Agreement, including all attachments to 7
263263 or parts of the Agreement, requiring the signature 8
264264 of the Secretary. 9

266266 ODIFICATIONS.—Nothing in this title pro-10
267267 hibits the Secretary, after execution of the Agree-11
268268 ment, from approving any modification to the Agree-12
269269 ment, including an attachment to the Agreement, 13
270270 that is consistent with this title, to the extent that 14
271271 the modification does not otherwise require congres-15
272272 sional approval under section 2116 of the Revised 16
273273 Statutes (25 U.S.C. 177) or any other applicable 17
274274 Federal law. 18
275275 (c) E
276276 NVIRONMENTAL COMPLIANCE.— 19

278278 N GENERAL.—In implementing the Agree-20
279279 ment and this title, the Secretary shall comply 21
280280 with— 22
281281 (A) the Endangered Species Act of 1973 23
282282 (16 U.S.C. 1531 et seq.); 24

292292 OMPLIANCE.— 6

294294 N GENERAL.—In implementing the 7
295295 Agreement and this title, the Tribe shall pre-8
296296 pare any necessary environmental documents, 9
297297 consistent with— 10
298298 (i) the Endangered Species Act of 11
299299 1973 (16 U.S.C. 1531 et seq.); 12
300300 (ii) the National Environmental Policy 13
301301 Act of 1969 (42 U.S.C. 4321 et seq.), in-14
302302 cluding the implementing regulations of 15
303303 that Act; and 16
304304 (iii) all other applicable Federal envi-17
305305 ronmental laws and regulations. 18
306306 (B) A
307307 UTHORIZATIONS.—The Secretary 19
308308 shall— 20
309309 (i) independently evaluate the docu-21
310310 mentation required under subparagraph 22
311311 (A); and 23
312312 (ii) be responsible for the accuracy, 24
313313 scope, and contents of that documentation. 25

318318 the Agreement by the Secretary under this section 2
319319 shall not constitute a major Federal action under 3
320320 the National Environmental Policy Act of 1969 (42 4
321321 U.S.C. 4321 et seq.). 5

323323 OSTS.—Any costs associated with the per-6
324324 formance of the compliance activities under this sub-7
325325 section shall be paid from funds deposited in the 8
326326 Trust Fund, subject to the condition that any costs 9
327327 associated with the performance of Federal approval 10
328328 or other review of such compliance work or costs as-11
329329 sociated with inherently Federal functions shall re-12
330330 main the responsibility of the Secretary. 13
331331 SEC. 104. TRIBAL WATER RIGHTS. 14

333333 RUSTSTATUS OF THE TRIBALWATER 15

335335 IGHTS.—The Tribal Water Rights shall be held in trust 16
336336 by the United States on behalf of the Tribe, in accordance 17
337337 with the Agreement and this title. 18

339339 ORFEITURE ANDABANDONMENT.— 19

341341 N GENERAL.—The Tribal Water Rights 20
342342 shall not be subject to loss through non-use, for-21
343343 feiture, abandonment, or other operation of law. 22

345345 TATE-LAW BASED WATER RIGHTS .—State- 23
346346 law based water rights acquired by the Tribe, or by 24
347347 the United States on behalf of the Tribe, after the 25

356356 SE.—Any use of the Tribal Water Rights shall 5
357357 be subject to the terms and conditions of the Agreement 6
358358 and this title. 7

360360 LLOTMENT RIGHTSNOTINCLUDED.—The 8
361361 Tribal Water Rights do not include any water rights for 9
362362 an Allotment. 10
363363 (e) A
364364 LLOTTEESNOTADVERSELYAFFECTED.— 11
365365 Nothing in this title quantifies or diminishes any water 12
366366 right, or any claim or entitlement to water, of an Allottee. 13
367367 (f) A
368368 CCOUNTING FOR ALLOTMENTUSES.—Any use 14
369369 of water on an Allotment shall be accounted for out of 15
370370 the Tribal Water Rights recognized in the Agreement, in-16
371371 cluding recognition of— 17
372372 (1) any water use existing on an Allotment as 18
373373 of the date of enactment of this Act; 19
374374 (2) reasonable domestic, stock, and irrigation 20
375375 water uses put into use on an Allotment; and 21
376376 (3) any water right decreed to the United 22
377377 States in trust for an Allottee in the Adjudication 23
378378 for use on an Allotment. 24

383383 object in the Adjudication to the quantification of reason-2
384384 able domestic, stock, and irrigation water uses on an Allot-3
385385 ment, and shall administer any water use on Zuni Lands 4
386386 in accordance with applicable Federal law, including rec-5
387387 ognition of— 6
388388 (1) any water use existing on an Allotment as 7
389389 of the date of enactment of this Act; 8
390390 (2) reasonable domestic, stock, and irrigation 9
391391 water uses on an Allotment; and 10
392392 (3) any water right decreed to the United 11
393393 States in trust for an Allottee in the Adjudication. 12
394394 (h) A
395395 UTHORITY OF THETRIBE.— 13
396396 (1) I
397397 N GENERAL.—The Tribe shall have the au-14
398398 thority to allocate, distribute, and lease the Tribal 15
399399 Water Rights for use on Zuni Lands in accordance 16
400400 with the Agreement, this title, and applicable Fed-17
401401 eral law, including the first section of the Act of Au-18
402402 gust 9, 1955 (69 Stat. 539, chapter 615; 25 U.S.C. 19
403403 415) (commonly known as the ‘‘Long-Term Leasing 20
404404 Act’’). 21

406406 SE OFF ZUNI LANDS.— 22
407407 (A) I
408408 N GENERAL.—The Tribe may allo-23
409409 cate, distribute, and lease the Tribal Water 24
410410 Rights for use off Zuni Lands in accordance 25

418418 AXIMUM TERM .—The maximum 4
419419 term of any lease, including all renewals, under 5
420420 this paragraph shall not exceed 99 years. 6

422422 DMINISTRATION.— 7
423423 (1) N
424424 O ALIENATION.—The Tribe shall not per-8
425425 manently alienate any portion of the Tribal Water 9
426426 Rights. 10

428428 URCHASES OR GRANTS OF LAND FROM IN -11
429429 DIANS.—An authorization provided by this title for 12
430430 the allocation, distribution, leasing, or other ar-13
431431 rangement entered into pursuant to this title shall 14
432432 be considered to satisfy any requirement for author-15
433433 ization of the action required by Federal law. 16

435435 ROHIBITION ON FORFEITURE .—The non- 17
436436 use of all or any portion of the Tribal Water Rights 18
437437 by any water user shall not result in the forfeiture, 19
438438 abandonment, relinquishment, or other loss of all or 20
439439 any portion of the Tribal Water Rights. 21
440440 SEC. 105. SETTLEMENT TRUST FUND. 22

442442 STABLISHMENT.—The Secretary shall establish 23
443443 a trust fund, to be known as the ‘‘Zuni Tribe Settlement 24
444444 Trust Fund’’, to be managed, invested, and distributed by 25

449449 withdrawn, or reverted to the general fund of the Treas-2
450450 ury, consisting of amounts deposited in the Trust Fund 3
451451 under subsection (c), together with any investment earn-4
452452 ings, including interest, earned on those amounts, for the 5
453453 purpose of carrying out this title. 6

455455 RUSTFUNDACCOUNTS.—The Secretary shall 7
456456 establish in the Trust Fund the following accounts: 8
457457 (1) The Zuni Tribe Water Rights Settlement 9
458458 Trust Account. 10
459459 (2) The Zuni Tribe Operation, Maintenance, & 11
460460 Replacement Trust Account. 12
461461 (c) D
462462 EPOSITS.—The Secretary shall deposit in the 13
463463 Trust Fund the amounts made available under section 14
464464 106(a). 15

466466 ANAGEMENT AND INTEREST.— 16

468468 ANAGEMENT.—On receipt and deposit of 17
469469 funds into the Trust Fund under subsection (c), the 18
470470 Secretary shall manage, invest, and distribute all 19
471471 amounts in the Trust Fund in a manner that is con-20
472472 sistent with the investment authority of the Sec-21
473473 retary under— 22

853853 FFECTIVEDATE.—The waivers and releases de-13
854854 scribed in subsections (a) and (b) shall take effect on the 14
