15	15	and for other purposes.
16	16	Be it enacted by the Senate and House of Representa-1
17	17	tives of the United States of America in Congress assembled, 2
18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Shadow Wolves Im-4
20	20	provement Act’’. 5
21	21	SEC. 2. ENHANCING THE EFFECTIVENESS OF THE SHADOW 6
22	22	WOLVES PROGRAM. 7
23	23	(a) I
24	24	NGENERAL.—Subtitle D of title IV of the 8
25	25	Homeland Security Act of 2002 (6 U.S.C. 251 et seq.) 9
26	26	is amended by adding at the end the following: 10

30	30	‘‘SEC. 448. SHADOW WOLVES PROGRAM. 1
31	31	‘‘(a) M
32	32	ISSION ANDGOALS.—The Director of U.S. 2
33	33	Immigration and Customs Enforcement (referred to in 3
34	34	this section as the ‘Director’), in coordination with appro-4
35	35	priate representatives of partnering Tribal governments, 5
36	36	including the Tohono O’odham Nation, shall specify the 6
37	37	mission and goals of the Shadow Wolves Program. 7
38	38	‘‘(b) S
39	39	TAFFING.—The Director shall determine— 8
40	40	‘‘(1) the number of special agents needed to 9
41	41	staff the Shadow Wolves Program nationally; and 10
42	42	‘‘(2) the knowledge, skills, and abilities that 11
43	43	such special agents shall be required to possess. 12
44	44	‘‘(c) S
45	45	TRATEGY.—Not later than 180 days after the 13
46	46	date of the enactment of the Shadow Wolves Improvement 14
47	47	Act, the Director, in consultation with appropriate rep-15
48	48	resentatives of partnering Tribal governments, including 16
49	49	the Tohono O’odham Nation, shall update the strategy re-17
50	50	quired under section 3 of the Shadow Wolves Enhance-18
51	51	ment Act (Public Law 117–113) by adding— 19
52	52	‘‘(1) measurable objectives to achieve the reten-20
53	53	tion and recruitment of law enforcement officers, 21
54	54	and the expansion goals set forth in the strategy; 22
55	55	‘‘(2) a timeline for achieving such goals; and 23
56	56	‘‘(3) milestones for recruiting qualified special 24
57	57	agents for the Shadow Wolves Program to meet the 25

61	61	target identified in the staffing needs assessment re-1
62	62	quired under subsection (b)(1). 2
63	63	‘‘(d) P
64	64	ROVISION OFINFORMATION.—The Director 3
65	65	shall provide, to all GS–1801 Tactical Officers who are 4
66	66	employed as Shadow Wolves by Homeland Security Inves-5
67	67	tigations as of the date of the enactment of the Shadow 6
68	68	Wolves Improvement Act, written information that will 7
69	69	help them make an informed decision about reclassifying 8
70	70	as special agents, including— 9
71	71	‘‘(1) individualized information regarding how 10
72	72	reclassification would affect pay, including changes 11
73	73	to overtime pay, and retirement compensation; 12
74	74	‘‘(2) steps such officers are required to com-13
75	75	plete to be reclassified as special agents, including— 14
76	76	‘‘(A) whether they must meet training re-15
77	77	quirements; 16
78	78	‘‘(B) a description of those requirements; 17
79	79	‘‘(C) whether they are exempt from phys-18
80	80	ical fitness, medical, or polygraph examinations; 19
81	81	and 20
82	82	‘‘(D) whether they are eligible for overtime 21
83	83	pay during such training; and 22
84	84	‘‘(3) any other relevant information that the 23
85	85	Director believes would help such officers make an 24
86	86	informed decision regarding such reclassification. 25

90	90	‘‘(e) SUCCESSIONPLAN.—The Director shall develop 1
91	91	a plan for the timely recruitment of qualified individuals 2
92	92	to fill vacant special agent positions in the Shadow Wolves 3
93	93	Program that will result from anticipated retirements. 4
94	94	‘‘(f) P
95	95	ROGRAMEXPANSION.—The Director shall— 5
96	96	‘‘(1) develop criteria for evaluating and select-6
97	97	ing additional tribal lands on which additional Shad-7
98	98	ow Wolves units may be located, including the 8
99	99	amount of additional funding necessary and poten-9
100	100	tial sources for such funding; and 10
101	101	‘‘(2) in developing such criteria, give consider-11
102	102	ation to tribal lands located in proximity to existing 12
103	103	facilities that provide Federal law enforcement train-13
104	104	ing.’’. 14

106	106	LERICALAMENDMENT.—The table of contents 15
107	107	for the Homeland Security Act of 2002 (6 U.S.C. 101 et 16
108	108	seq.) is amended by inserting after the item relating to 17
109	109	section 447 the following: 18

136	136	EPORT.—Not later than 1 year after the date 12
137	137	of the enactment of this Act, the Director shall submit 13
138	138	a report to the relevant congressional committees that de-14
139	139	scribes the progress that has been made towards the full 15
140	140	implementation of— 16
141	141	(1) section 448 of the Homeland Security Act 17
142	142	of 2002, as added by section 2(a), including the re-18
143	143	quired coordination with appropriate representatives 19
144	144	of the Tohono O’odham Nation and other partnering 20
145	145	Tribal governments, to specify the mission and goals 21
146	146	of the Shadow Wolves Program, which shall include 22
147	147	tracking, interdiction, and investigation; and 23
148	148	(2) section 2(4) of the Shadow Wolves En-24
149	149	hancement Act, as added by section 4. 25

156	156	Section 2 of the Shadow Wolves Enhancement Act 4
157	157	(Public Law 117–113) is amended— 5
158	158	(1) in paragraph (2), by striking ‘‘and’’ at the 6

160	160	(2) in paragraph (3), by striking the period at 8
161	161	the end and inserting ‘‘; and’’; and 9
162	162	(3) by adding at the end the following: 10
163	163	‘‘(4) to noncompetitively convert Shadow 11
164	164	Wolves, after their successful completion of three 12
165	165	years as Shadow Wolves, regardless of location as-13
166	166	signed, from the excepted service to career or career 14
167	167	conditional appointments in the competitive serv-15
168	168	ice.’’. 16
