2222 This Act may be cited as the ‘‘One Flag for All Act’’. 4
2323 SEC. 2. PROHIBITION ON FLAGS OTHER THAN THE FLAG OF 5

3232 (A) IN GENERAL.—Except as provided in 1
3333 subparagraph (B), the term ‘‘covered public 2
3434 building’’ has the meaning given the term ‘‘pub-3
3535 lic building’’ in section 3301(a) of title 40, 4
3636 United States Code. 5
3737 (B) I
3838 NCLUSIONS.—The term ‘‘covered pub-6
3939 lic building’’ includes— 7
4040 (i) a building in use by the Senate or 8
4141 House of Representatives or otherwise 9
4242 under the jurisdiction of the Architect of 10
4343 the Capitol; 11
4444 (ii) a military installation; and 12
4545 (iii) any embassy or consulate of the 13
4646 United States. 14

4848 LAG OF THE UNITED STATES .—The term 15
4949 ‘‘flag of the United States’’ has the meaning given 16
5050 the term in section 700(b) of title 18, United States 17
5151 Code. 18

5353 ILITARY INSTALLATION.—The term ‘‘mili-19
5454 tary installation’’ has the meaning given the term in 20
5555 section 2801(c) of title 10, United States Code. 21

5757 ROHIBITIONS.—Notwithstanding any other pro-22
5858 vision of law, and except as provided in subsection (c), 23
5959 no flag that is not the flag of the United States may be 24
6060 flown, draped, or otherwise displayed— 25

6464 (1) on the exterior of a covered public building; 1
6565 or 2
6666 (2) in an area of a covered public building that 3
6767 is fully accessible to the public, including an 4
6868 entryway or hallway. 5

7070 XCEPTIONS.—The prohibitions under subsection 6
7171 (b) shall not apply to— 7
7272 (1) a National League of Families POW/MIA 8
7373 flag (as designated by section 902(a) of title 36, 9
7474 United States Code); 10
7575 (2) a Hostage and Wrongful Detainee flag (as 11
7676 designated by section 904(a) of title 36, United 12
7777 States Code); 13
7878 (3) any flag that represents the nation of a vis-14
7979 iting diplomat or a representative of the government 15
8080 of that nation visiting the covered public building at 16
8181 which the flag is displayed; 17
8282 (4) in the case of a Member of Congress, the 18
8383 State flag of the State represented by the Member 19
8484 that is located outside or within the office of the 20
8585 Member; 21
8686 (5) any flag that represents a unit or branch of 22
8787 the Armed Forces or any flag that supports the 23
8888 Armed Forces; 24

9292 (6) any flag of historical significance to the 1
9393 United States, including the Betsy Ross flag, the 2
9494 Gadsden flag, and the Bennington flag; 3
9595 (7) any flag that represents public safety; 4
9696 (8) any flag commemorating a special national 5
9797 observance, including any 9/11 memorial, Remem-6
9898 brance Day, Veterans Day, or Memorial Day flag; 7
9999 (9) in the case of a religious liturgy or cere-8
100100 mony at a military installation or facility, any flag 9
101101 that represents a religious organization or church 10
102102 that is described in section 501(c)(3) of the Internal 11
103103 Revenue Code of 1986 and exempt from taxation 12
104104 under section 501(a) of that Code; 13
105105 (10) in the case of a Federal agency, any flag 14
106106 that represents the Federal agency; 15
107107 (11) any flag that represents an Indian Tribe 16
108108 (as defined in section 4 of the Indian Self-Deter-17
109109 mination and Education Assistance Act (25 U.S.C. 18
110110 5304)); or 19
111111 (12) any flag that represents the State, terri-20
112112 tory, county, city, or local jurisdiction in which the 21
113113 covered public building is located. 22
