16	16	To prohibit the flying, draping, or other display of any flag
17	17	other than the flag of the United States at covered
18	18	public buildings, and for other purposes.
19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. SHORT TITLE. 3
22	22	This Act may be cited as the ‘‘One Flag for All Act’’. 4
23	23	SEC. 2. PROHIBITION ON FLAGS OTHER THAN THE FLAG OF 5
24	24	THE UNITED STATES. 6

26	26	EFINITIONS.—In this section: 7
27	27	(1) C
28	28	OVERED PUBLIC BUILDING .— 8

32	32	(A) IN GENERAL.—Except as provided in 1
33	33	subparagraph (B), the term ‘‘covered public 2
34	34	building’’ has the meaning given the term ‘‘pub-3
35	35	lic building’’ in section 3301(a) of title 40, 4
36	36	United States Code. 5
37	37	(B) I
38	38	NCLUSIONS.—The term ‘‘covered pub-6
39	39	lic building’’ includes— 7
40	40	(i) a building in use by the Senate or 8
41	41	House of Representatives or otherwise 9
42	42	under the jurisdiction of the Architect of 10
43	43	the Capitol; 11
44	44	(ii) a military installation; and 12
45	45	(iii) any embassy or consulate of the 13
46	46	United States. 14

48	48	LAG OF THE UNITED STATES .—The term 15
49	49	‘‘flag of the United States’’ has the meaning given 16
50	50	the term in section 700(b) of title 18, United States 17
51	51	Code. 18

53	53	ILITARY INSTALLATION.—The term ‘‘mili-19
54	54	tary installation’’ has the meaning given the term in 20
55	55	section 2801(c) of title 10, United States Code. 21

57	57	ROHIBITIONS.—Notwithstanding any other pro-22
58	58	vision of law, and except as provided in subsection (c), 23
59	59	no flag that is not the flag of the United States may be 24
60	60	flown, draped, or otherwise displayed— 25

64	64	(1) on the exterior of a covered public building; 1
65	65	or 2
66	66	(2) in an area of a covered public building that 3
67	67	is fully accessible to the public, including an 4
68	68	entryway or hallway. 5
69	69	(c) E
70	70	XCEPTIONS.—The prohibitions under subsection 6
71	71	(b) shall not apply to— 7
72	72	(1) a National League of Families POW/MIA 8
73	73	flag (as designated by section 902(a) of title 36, 9
74	74	United States Code); 10
75	75	(2) a Hostage and Wrongful Detainee flag (as 11
76	76	designated by section 904(a) of title 36, United 12
77	77	States Code); 13
78	78	(3) any flag that represents the nation of a vis-14
79	79	iting diplomat or a representative of the government 15
80	80	of that nation visiting the covered public building at 16
81	81	which the flag is displayed; 17
82	82	(4) in the case of a Member of Congress, the 18
83	83	State flag of the State represented by the Member 19
84	84	that is located outside or within the office of the 20
85	85	Member; 21
86	86	(5) any flag that represents a unit or branch of 22
87	87	the Armed Forces or any flag that supports the 23
88	88	Armed Forces; 24

92	92	(6) any flag of historical significance to the 1
93	93	United States, including the Betsy Ross flag, the 2
94	94	Gadsden flag, and the Bennington flag; 3
95	95	(7) any flag that represents public safety; 4
96	96	(8) any flag commemorating a special national 5
97	97	observance, including any 9/11 memorial, Remem-6
98	98	brance Day, Veterans Day, or Memorial Day flag; 7
99	99	(9) in the case of a religious liturgy or cere-8
100	100	mony at a military installation or facility, any flag 9
101	101	that represents a religious organization or church 10
102	102	that is described in section 501(c)(3) of the Internal 11
103	103	Revenue Code of 1986 and exempt from taxation 12
104	104	under section 501(a) of that Code; 13
105	105	(10) in the case of a Federal agency, any flag 14
106	106	that represents the Federal agency; 15
107	107	(11) any flag that represents an Indian Tribe 16
108	108	(as defined in section 4 of the Indian Self-Deter-17
109	109	mination and Education Assistance Act (25 U.S.C. 18
110	110	5304)); or 19
111	111	(12) any flag that represents the State, terri-20
112	112	tory, county, city, or local jurisdiction in which the 21
113	113	covered public building is located. 22
