15	15	the hunting, fishing, trapping, and animal gathering
16	16	rights of the Confederated Tribes of the Grand Ronde
17	17	Community, and for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. GRAND RONDE RESERVATION ACT AMEND-3
21	21	MENT. 4
22	22	Section 2 of Public Law 100–425 (commonly known 5
23	23	as the ‘‘Grand Ronde Reservation Act’’) (102 Stat. 1595) 6
24	24	is amended to read as follows: 7

31	31	EFINITIONS.—In this section: 3
32	32	‘‘(1) C
33	33	ONSENT DECREE .—The term ‘Consent 4
34	34	Decree’ means the final judgment and decree of the 5
35	35	United States District Court for the District of Or-6
36	36	egon, in the action entitled ‘Confederated Tribes of 7
37	37	the Grand Ronde Community of Oregon against the 8
38	38	State of Oregon’, entered on January 12, 1987. 9
39	39	‘‘(2) G
40	40	RAND RONDE HUNTING AND FISHING 10
41	41	AGREEMENT.—The term ‘Grand Ronde Hunting and 11
42	42	Fishing Agreement’ means the agreement entitled 12
43	43	‘Agreement Among the State of Oregon, the United 13
44	44	States of America and the Confederated Tribes of 14
45	45	the Grand Ronde Community of Oregon to Perma-15
46	46	nently Define Tribal Hunting, Fishing, Trapping, 16
47	47	and Animal Gathering Rights of the Tribe and its 17
48	48	Members’ and entered into by the United States on 18
49	49	December 2, 1986. 19
50	50	‘‘(3) I
51	51	NDIAN TRIBE.—The term ‘Indian Tribe’ 20
52	52	has the meaning given the term in section 4 of the 21
53	53	Indian Self-Determination and Education Assistance 22
54	54	Act (25 U.S.C. 5304). 23

62	62	‘‘(1) IN GENERAL.—The Grand Ronde Hunting 1
63	63	and Fishing Agreement shall remain in effect until 2
64	64	and unless replaced, amended, or otherwise modified 3
65	65	by 1 or more successor government-to-government 4
66	66	agreements between the Confederated Tribes of the 5
67	67	Grand Ronde Community and the State of Oregon 6
68	68	relating to the hunting, fishing, trapping, and ani-7
69	69	mal gathering rights of the Confederated Tribes of 8
70	70	the Grand Ronde Community. 9
71	71	‘‘(2) A
72	72	MENDMENTS.—The Grand Ronde Hunt-10
73	73	ing and Fishing Agreement or any successor agree-11
74	74	ment entered into under paragraph (1) may be 12
75	75	amended from time to time by mutual consent of the 13
76	76	Confederated Tribes of the Grand Ronde Commu-14
77	77	nity and the State of Oregon. 15
78	78	‘‘(3) C
79	79	ONTENTS OF NEW AGREEMENT OR FU -16
80	80	TURE AMENDMENTS .—No successor agreement or 17
81	81	amended agreement entered into under paragraph 18
82	82	(1) shall— 19
83	83	‘‘(A) purport to affirm, recognize, estab-20
84	84	lish, expand, adjudicate, waive, limit, abrogate 21
85	85	or otherwise affect the ancestral, aboriginal, 22
86	86	treaty, statutory, equitable, or other applicable 23
87	87	rights of the Confederated Tribes of the Grand 24
88	88	Ronde Community or any other Indian Tribe; 25

92	92	‘‘(B) limit the State of Oregon from enter-1
93	93	ing into separate agreements with other Indian 2
94	94	Tribes that address the authority to take spe-3
95	95	cies within the geographic scope of the agree-4
96	96	ment; or 5
97	97	‘‘(C) be used in a civil or criminal action 6
98	98	in a court of competent jurisdiction to enlarge, 7
99	99	confirm, adjudicate, affect, or modify any treaty 8
100	100	or other right of an Indian Tribe. 9
101	101	‘‘(4) S
102	102	OURCE OF AUTHORITY .—All hunting, 10
103	103	fishing, trapping, and animal gathering rights of the 11
104	104	Confederated Tribes of the Grand Ronde Commu-12
105	105	nity in any successor agreement or amended agree-13
106	106	ment entered into under paragraph (1) after the 14
107	107	date of enactment of this paragraph shall derive 15
108	108	solely from the authority of the State of Oregon. 16
109	109	‘‘(c) J
110	110	UDICIALREVIEW.—In any action brought in 17
111	111	the United States District Court for the District of Or-18
112	112	egon to rescind, overturn, modify, or provide relief under 19
113	113	Federal law from the Consent Decree, the United States 20
114	114	District Court for the District of Oregon shall review the 21
115	115	application of the parties on the merits without regard to 22
116	116	the defense of res judicata or collateral estoppel. 23
117	117	‘‘(d) E
118	118	FFECT.—Nothing in this section, or in any 24
119	119	successor agreement or amended agreement entered into 25

124	124	termining, defining, affirming, recognizing, abrogating, 2
125	125	limiting, or affecting the rights or claims of any Indian 3
126	126	Tribe, including any treaty and other sovereign rights.’’. 4
