16	16	Be it enacted by the Senate and House of Representa-1
17	17	tives of the United States of America in Congress assembled, 2
18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Modernizing Retro-4
20	20	spective Regulatory Review Act’’. 5
21	21	SEC. 2. IMPROVING RETROSPECTIVE REVIEWS OF FED-6
22	22	ERAL REGULATIONS. 7
23	23	(a) D
24	24	EFINITIONS.—In this section: 8
25	25	(1) A
26	26	DMINISTRATIVE COMMITTEE OF THE FED -9
27	27	ERAL REGISTER.—The term ‘‘Administrative Com-10

32	32	mittee established under section 1506 of title 44, 2
33	33	United States Code. 3

35	35	DMINISTRATOR.—The term ‘‘Adminis-4
36	36	trator’’ means the Administrator of the Office of In-5
37	37	formation and Regulatory Affairs. 6

39	39	GENCY.—The term ‘‘agency’’ has the 7
40	40	meaning given the term in section 3502 of title 44, 8
41	41	United States Code. 9

43	43	PPROPRIATE CONGRESSIONAL COMMIT -10
44	44	TEES.—The term ‘‘appropriate congressional com-11
45	45	mittees’’ means— 12
46	46	(A) the Committee on Oversight and Gov-13
47	47	ernment Reform of the House of Representa-14
48	48	tives; and 15
49	49	(B) the Committee on Homeland Security 16
50	50	and Governmental Affairs of the Senate. 17

52	52	IRECTOR OF GPO.—The term ‘‘Director of 18
53	53	GPO’’ means the Director of the Government Pub-19
54	54	lishing Office. 20

56	56	ACHINE-READABLE.—The term ‘‘machine- 21
57	57	readable’’ has the meaning given the term in section 22
58	58	3502 of title 44, United States Code. 23

60	60	ETROSPECTIVE REVIEW OF A REGULATION 24
61	61	OF THE AGENCY.—The term ‘‘retrospective review of 25

65	65	a regulation of the agency’’ means a review of regu-1
66	66	lations of the agency conducted after the regulation 2
67	67	has been issued that is required by law or deter-3
68	68	mined appropriate by the head of the agency. 4

70	70	EPORT ONAVAILABILITY OFEXISTINGREGU-5
71	71	LATIONS INMACHINE-READABLEFORMAT.— 6
72	72	(1) I
73	73	N GENERAL.—Not later than 180 days 7
74	74	after the date of enactment of this Act, the Director 8
75	75	of the Office of Management and Budget, acting 9
76	76	through the Administrator and in consultation with 10
77	77	the Director of GPO, the Archivist of the United 11
78	78	States, and the Director of the Federal Register, 12
79	79	shall submit to the appropriate congressional com-13
80	80	mittees, a report on the progress of the Federal Gov-14
81	81	ernment in making regulations of agencies available 15
82	82	in machine-readable format. 16
83	83	(2) C
84	84	ONTENTS OF REPORT .—The report re-17
85	85	quired by paragraph (1) shall include— 18
86	86	(A) an assessment of whether agency regu-19
87	87	lations have been made available in a machine- 20
88	88	readable format to the public; and 21
89	89	(B) information regarding the recognition 22
90	90	by the Administrative Committee of the Federal 23
91	91	Register of the eCFR maintained by the Direc-24
92	92	tor of the Federal Register and the Director of 25

99	99	UIDANCE ONUSINGTECHNOLOGY TOCONDUCT 3

101	101	ETROSPECTIVEREVIEWS.— 4
102	102	(1) I
103	103	N GENERAL.—Not later than 18 months 5
104	104	after the date of enactment of this Act, the Director 6
105	105	of the Office of Management and Budget, acting 7
106	106	through the Administrator, shall issue guidance on 8
107	107	how the head of an agency can— 9
108	108	(A) use technology (including algorithmic 10
109	109	tools and artificial intelligence) to more effi-11
110	110	ciently, cost-effectively, and accurately conduct 12
111	111	any retrospective review of the existing regula-13
112	112	tions of the agency, including how to identify, 14
113	113	procure, and use such technology to identify 15
114	114	through any such review regulations of the 16
115	115	agency that— 17
116	116	(i) are obsolete, ineffective, or insuffi-18
117	117	cient; 19
118	118	(ii) are excessively burdensome or 20
119	119	should be improved; 21
120	120	(iii) contain typographical errors; 22
121	121	(iv) contain inaccurate cross ref-23
122	122	erences; or 24

126	126	(v) are redundant, contradict, or over-1
127	127	lap with any regulations or standards of 2
128	128	the agency; and 3
129	129	(B) adequately train personnel of the agen-4
130	130	cy on how to use such technology. 5

132	132	EVELOPMENT OF GUIDANCE .—In devel-6
133	133	oping the guidance required pursuant to paragraph 7
134	134	(1), the Administrator shall take into account any 8
135	135	assessment or information included in the report re-9
136	136	quired by subsection (b). 10
137	137	(d) A
138	138	GENCYRETROSPECTIVEREVIEWPLAN.—Not 11
139	139	later than 2 years after the date of enactment of this Act, 12
140	140	the head of each agency shall submit to the Administrator 13
141	141	and the appropriate congressional committees a plan 14
142	142	that— 15
143	143	(1) includes a detailed strategy for imple-16
144	144	menting the guidance issued pursuant to subsection 17
145	145	(c) with respect to the regulations of the agency; 18
146	146	(2) identifies any regulation of the agency, or 19
147	147	categories of regulations of the agency, that the 20
148	148	head of the agency— 21
149	149	(A) is required by law to review after the 22
150	150	applicable regulation is issued; or 23
151	151	(B) determines would benefit from being 24
152	152	reviewed after the regulation is issued; and 25

157	157	or ex-post analysis determined necessary or useful 2
158	158	by the head of the agency. 3
159	159	(e) A
160	160	GENCYIMPLEMENTATION.—Not later than 180 4
161	161	days after the date on which the head of an agency sub-5
162	162	mits the plan required by subsection (d), the head of the 6
163	163	agency shall implement the strategy included in such plan 7
164	164	with respect to any retrospective review of a regulation 8
165	165	of the agency. 9
