35 | 35 | | This Act may be cited as the ‘‘Constitutional Con-4 |

43 | 43 | | NGENERAL.—Chapter 44 of title 18, United 3 |

44 | 44 | | States Code, is amended by inserting after section 926C 4 |

46 | 46 | | ‘‘§ 926D. Reciprocity for the carrying of certain con-6 |
---|
47 | 47 | | cealed firearms 7 |
---|
48 | 48 | | ‘‘(a) I |
---|
49 | 49 | | NGENERAL.—Notwithstanding any provision 8 |
---|
50 | 50 | | of the law of any State or political subdivision thereof to 9 |
---|
51 | 51 | | the contrary— 10 |
---|
52 | 52 | | ‘‘(1) an individual who is not prohibited by 11 |
---|
53 | 53 | | Federal law from possessing, transporting, shipping, 12 |
---|
54 | 54 | | or receiving a firearm, and who is carrying a govern-13 |
---|
55 | 55 | | ment-issued photographic identification document 14 |
---|
56 | 56 | | and a valid license or permit which is issued pursu-15 |
---|
57 | 57 | | ant to the law of a State and which permits the indi-16 |
---|
58 | 58 | | vidual to carry a concealed firearm, may possess or 17 |
---|
59 | 59 | | carry a concealed handgun (other than a machine-18 |
---|
60 | 60 | | gun or destructive device) that has been shipped or 19 |
---|
61 | 61 | | transported in interstate or foreign commerce in any 20 |
---|
62 | 62 | | State other than the State of residence of the indi-21 |
---|
63 | 63 | | vidual that— 22 |
---|
64 | 64 | | ‘‘(A) has a statute that allows residents of 23 |
---|
65 | 65 | | the State to obtain licenses or permits to carry 24 |
---|
66 | 66 | | concealed firearms; or 25 |
---|

77 | 77 | | and is entitled and not prohibited from carrying a 8 |
---|
78 | 78 | | concealed firearm in the State in which the indi-9 |
---|
79 | 79 | | vidual resides otherwise than as described in para-10 |
---|
80 | 80 | | graph (1), may possess or carry a concealed hand-11 |
---|
81 | 81 | | gun (other than a machinegun or destructive device) 12 |
---|
82 | 82 | | that has been shipped or transported in interstate or 13 |
---|
83 | 83 | | foreign commerce in any State other than the State 14 |
---|
84 | 84 | | of residence of the individual that— 15 |
---|
85 | 85 | | ‘‘(A) has a statute that allows residents of 16 |
---|
86 | 86 | | the State to obtain licenses or permits to carry 17 |
---|
87 | 87 | | concealed firearms; or 18 |
---|
88 | 88 | | ‘‘(B) does not prohibit the carrying of con-19 |
---|
89 | 89 | | cealed firearms by residents of the State for 20 |
---|

92 | 92 | | ONDITIONS AND LIMITATIONS.—The posses-22 |
---|
93 | 93 | | sion or carrying of a concealed handgun in a State under 23 |
---|
94 | 94 | | this section shall be subject to the same conditions and 24 |
---|
95 | 95 | | limitations, except as to eligibility to possess or carry, im-25 |
---|

106 | 106 | | NRESTRICTEDLICENSE ORPERMIT.—In a 7 |
---|
107 | 107 | | State that allows the issuing authority for licenses or per-8 |
---|
108 | 108 | | mits to carry concealed firearms to impose restrictions on 9 |
---|
109 | 109 | | the carrying of firearms by individual holders of such li-10 |
---|
110 | 110 | | censes or permits, an individual carrying a concealed 11 |
---|
111 | 111 | | handgun under this section shall be permitted to carry a 12 |
---|
112 | 112 | | concealed handgun according to the same terms author-13 |
---|
113 | 113 | | ized by an unrestricted license of or permit issued to a 14 |
---|
114 | 114 | | resident of the State. 15 |
---|
115 | 115 | | ‘‘(d) R |
---|
116 | 116 | | ULE OFCONSTRUCTION.—Nothing in this sec-16 |
---|
117 | 117 | | tion shall be construed to preempt any provision of State 17 |
---|
118 | 118 | | law with respect to the issuance of licenses or permits to 18 |
---|
119 | 119 | | carry concealed firearms.’’. 19 |

121 | 121 | | LERICALAMENDMENT.—The table of sections 20 |

122 | 122 | | for chapter 44 of title 18, United States Code, is amended 21 |

123 | 123 | | by inserting after the item relating to section 926C the 22 |
