shrimp for consumption in the United States, and for other purposes.

To amend the Federal Food, Drug, and Cosmetic Act to 
provide for the inspection of foreign facilities that manu-
facture, process, pack, or hold shrimp for consumption 
in the United States, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Safer Shrimp Imports 4
Act’’. 5

SEC. 2. SHRIMP MANUFACTURED, PROCESSED, PACKED, OR 1
HELD AT OVERSEAS FACILITIES. 2
(a) I
NGENERAL.—Section 807 of the Federal Food, 3
Drug, and Cosmetic Act (21 U.S.C. 384c) is amended by 4
adding at the end the following: 5
‘‘(c) R
EQUIREMENTS FOR FOREIGNSHRIMPFACILI-6
TIES.— 7
‘‘(1) I
N GENERAL.—Notwithstanding any other 8
provision of law, not later than 180 days after the 9
date of enactment of this subsection, the Secretary 10
shall seek to enter into arrangements and agree-11
ments under subsection (a)(1) with the foreign gov-12
ernment of each foreign country with 1 or more for-13
eign facilities registered under section 415 that man-14
ufacture, process, pack, or hold shrimp for consump-15
tion in the United States. 16
‘‘(2) R
EQUIREMENTS FOR SHRIMP .—Beginning 17
on the date that is 1 year after the date of enact-18
ment of this subsection, shrimp shall be refused ad-19
mission into the United States if it is manufactured, 20
processed, packed, or held in a foreign country— 21
‘‘(A) the government of which does not 22
enter into an arrangement or agreement with 23
the Secretary under paragraph (1); or 24

‘‘(B) the food inspection system of which 1
does not meet the criteria described in para-2
graph (3). 3
‘‘(3) C
RITERIA.—The criteria described in this 4
paragraph with respect to a food inspection system 5
is that the food inspection system (as demonstrated 6
to the Secretary by the applicable foreign govern-7
ment) is equivalent to the food inspection system of 8
the Food and Drug Administration with respect to 9
shrimp, including by providing— 10
‘‘(A) staffing that ensures uniform enforce-11
ment of applicable laws and regulations; and 12
‘‘(B) enforcement of laws and regulations 13
that address the conditions under which shrimp 14
is raised and transported to processing estab-15
lishments. 16
‘‘(4) D
EMONSTRATION.—A foreign government 17
seeking to demonstrate that its food inspection sys-18
tem meets the criteria described in paragraph (3) 19
shall provide to the Secretary copies of all laws, reg-20
ulations, and other information pertaining to such 21
food inspection system.’’. 22
(b) A
DULTERATION.—Section 402 of the Federal 23
Food, Drug, and Cosmetic Act (21 U.S.C. 342) is amend-24
ed by adding at the end the following: 25

‘‘(j) If it is shrimp imported or offered for import 1
into the United States and the shrimp has been manufac-2
tured, processed, packed, or held in a foreign country the 3
government or food inspection system of which does not 4
comply with the applicable requirements of section 5
807(c).’’. 6
(c) R
EPORT TOCONGRESS.—Not later than 1 year 7
after the date of enactment of this Act, and annually 8
thereafter, the Secretary of Health and Human Services 9
shall submit to the Committee on Health, Education, 10
Labor, and Pensions of the Senate and the Committee on 11
Energy and Commerce of the House of Representatives 12
a report that describes the implementation of the amend-13
ments made by subsections (a) and (b). 14
