14	14	To amend the Federal Food, Drug, and Cosmetic Act to
15	15	provide for the inspection of foreign facilities that manu-
16	16	facture, process, pack, or hold shrimp for consumption
17	17	in the United States, and for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Safer Shrimp Imports 4
22	22	Act’’. 5

26	26	SEC. 2. SHRIMP MANUFACTURED, PROCESSED, PACKED, OR 1
27	27	HELD AT OVERSEAS FACILITIES. 2
28	28	(a) I
29	29	NGENERAL.—Section 807 of the Federal Food, 3
30	30	Drug, and Cosmetic Act (21 U.S.C. 384c) is amended by 4
31	31	adding at the end the following: 5
32	32	‘‘(c) R
33	33	EQUIREMENTS FOR FOREIGNSHRIMPFACILI-6
34	34	TIES.— 7
35	35	‘‘(1) I
36	36	N GENERAL.—Notwithstanding any other 8
37	37	provision of law, not later than 180 days after the 9
38	38	date of enactment of this subsection, the Secretary 10
39	39	shall seek to enter into arrangements and agree-11
40	40	ments under subsection (a)(1) with the foreign gov-12
41	41	ernment of each foreign country with 1 or more for-13
42	42	eign facilities registered under section 415 that man-14
43	43	ufacture, process, pack, or hold shrimp for consump-15
44	44	tion in the United States. 16
45	45	‘‘(2) R
46	46	EQUIREMENTS FOR SHRIMP .—Beginning 17
47	47	on the date that is 1 year after the date of enact-18
48	48	ment of this subsection, shrimp shall be refused ad-19
49	49	mission into the United States if it is manufactured, 20
50	50	processed, packed, or held in a foreign country— 21
51	51	‘‘(A) the government of which does not 22
52	52	enter into an arrangement or agreement with 23
53	53	the Secretary under paragraph (1); or 24

57	57	‘‘(B) the food inspection system of which 1
58	58	does not meet the criteria described in para-2
59	59	graph (3). 3
60	60	‘‘(3) C
61	61	RITERIA.—The criteria described in this 4
62	62	paragraph with respect to a food inspection system 5
63	63	is that the food inspection system (as demonstrated 6
64	64	to the Secretary by the applicable foreign govern-7
65	65	ment) is equivalent to the food inspection system of 8
66	66	the Food and Drug Administration with respect to 9
67	67	shrimp, including by providing— 10
68	68	‘‘(A) staffing that ensures uniform enforce-11
69	69	ment of applicable laws and regulations; and 12
70	70	‘‘(B) enforcement of laws and regulations 13
71	71	that address the conditions under which shrimp 14
72	72	is raised and transported to processing estab-15
73	73	lishments. 16
74	74	‘‘(4) D
75	75	EMONSTRATION.—A foreign government 17
76	76	seeking to demonstrate that its food inspection sys-18
77	77	tem meets the criteria described in paragraph (3) 19
78	78	shall provide to the Secretary copies of all laws, reg-20
79	79	ulations, and other information pertaining to such 21
80	80	food inspection system.’’. 22

82	82	DULTERATION.—Section 402 of the Federal 23
83	83	Food, Drug, and Cosmetic Act (21 U.S.C. 342) is amend-24
84	84	ed by adding at the end the following: 25

88	88	‘‘(j) If it is shrimp imported or offered for import 1
89	89	into the United States and the shrimp has been manufac-2
90	90	tured, processed, packed, or held in a foreign country the 3
91	91	government or food inspection system of which does not 4
92	92	comply with the applicable requirements of section 5
93	93	807(c).’’. 6

95	95	EPORT TOCONGRESS.—Not later than 1 year 7
96	96	after the date of enactment of this Act, and annually 8
97	97	thereafter, the Secretary of Health and Human Services 9
98	98	shall submit to the Committee on Health, Education, 10
99	99	Labor, and Pensions of the Senate and the Committee on 11
100	100	Energy and Commerce of the House of Representatives 12
101	101	a report that describes the implementation of the amend-13
102	102	ments made by subsections (a) and (b). 14
