2929 NGENERAL.—Section 807 of the Federal Food, 3
3030 Drug, and Cosmetic Act (21 U.S.C. 384c) is amended by 4
3131 adding at the end the following: 5
3232 ‘‘(c) R
3333 EQUIREMENTS FOR FOREIGNSHRIMPFACILI-6
3434 TIES.— 7
3535 ‘‘(1) I
3636 N GENERAL.—Notwithstanding any other 8
3737 provision of law, not later than 180 days after the 9
3838 date of enactment of this subsection, the Secretary 10
3939 shall seek to enter into arrangements and agree-11
4040 ments under subsection (a)(1) with the foreign gov-12
4141 ernment of each foreign country with 1 or more for-13
4242 eign facilities registered under section 415 that man-14
4343 ufacture, process, pack, or hold shrimp for consump-15
4444 tion in the United States. 16
4545 ‘‘(2) R
4646 EQUIREMENTS FOR SHRIMP .—Beginning 17
4747 on the date that is 1 year after the date of enact-18
4848 ment of this subsection, shrimp shall be refused ad-19
4949 mission into the United States if it is manufactured, 20
5050 processed, packed, or held in a foreign country— 21
5151 ‘‘(A) the government of which does not 22
5252 enter into an arrangement or agreement with 23
5353 the Secretary under paragraph (1); or 24

5757 ‘‘(B) the food inspection system of which 1
5858 does not meet the criteria described in para-2
5959 graph (3). 3

6161 RITERIA.—The criteria described in this 4
6262 paragraph with respect to a food inspection system 5
6363 is that the food inspection system (as demonstrated 6
6464 to the Secretary by the applicable foreign govern-7
6565 ment) is equivalent to the food inspection system of 8
6666 the Food and Drug Administration with respect to 9
6767 shrimp, including by providing— 10
6868 ‘‘(A) staffing that ensures uniform enforce-11
6969 ment of applicable laws and regulations; and 12
7070 ‘‘(B) enforcement of laws and regulations 13
7171 that address the conditions under which shrimp 14
7272 is raised and transported to processing estab-15
7373 lishments. 16
7474 ‘‘(4) D
7575 EMONSTRATION.—A foreign government 17
7676 seeking to demonstrate that its food inspection sys-18
7777 tem meets the criteria described in paragraph (3) 19
7878 shall provide to the Secretary copies of all laws, reg-20
7979 ulations, and other information pertaining to such 21
8080 food inspection system.’’. 22

8282 DULTERATION.—Section 402 of the Federal 23
8383 Food, Drug, and Cosmetic Act (21 U.S.C. 342) is amend-24
8484 ed by adding at the end the following: 25

8888 ‘‘(j) If it is shrimp imported or offered for import 1
8989 into the United States and the shrimp has been manufac-2
9090 tured, processed, packed, or held in a foreign country the 3
9191 government or food inspection system of which does not 4
9292 comply with the applicable requirements of section 5
9393 807(c).’’. 6

9595 EPORT TOCONGRESS.—Not later than 1 year 7
9696 after the date of enactment of this Act, and annually 8
9797 thereafter, the Secretary of Health and Human Services 9
9898 shall submit to the Committee on Health, Education, 10
9999 Labor, and Pensions of the Senate and the Committee on 11
100100 Energy and Commerce of the House of Representatives 12
101101 a report that describes the implementation of the amend-13
102102 ments made by subsections (a) and (b). 14
