1515 tives of the United States of America in Congress assembled, 2
1616 SECTION 1. SHORT TITLE. 3
1717 This Act may be cited as the ‘‘Protect America’s In-4
1818 novation and Economic Security from CCP Act of 2025’’. 5
1919 SEC. 2. CCP INITIATIVE. 6
2020 (a) E
2121 STABLISHMENT.—There is established in the 7
2222 National Security Division of the Department of Justice 8
2323 the CCP Initiative to— 9
2424 (1) counter nation-state threats to the United 10
2525 States; 11

3030 Party on United States intellectual property and 2
3131 academic institutions in the United States; 3
3232 (3) develop an enforcement strategy concerning 4
3333 nontraditional collectors, including researchers in 5
3434 labs, universities, and the defense industrial base, 6
3535 that are being used to transfer technology contrary 7
3636 to United States interests; 8
3737 (4) implement the amendments to the authori-9
3838 ties of the Committee on Foreign Investment in the 10
3939 United States under section 721 of the Defense Pro-11
4040 duction Act of 1950 (50 U.S.C. 4565) made by the 12
4141 Foreign Investment Risk Review Modernization Act 13
4242 of 2018 (subtitle A of title XVII of Public Law 115– 14
4343 232; 50 U.S.C. 4565 note) for the Department of 15
4444 Justice, including by working with the Department 16
4545 of the Treasury to develop regulations to implement 17
4646 those amendments; 18
4747 (5) identify cases under the Foreign Corrupt 19
4848 Practices Act of 1977 (Public Law 95–213; 91 Stat. 20
4949 1494) involving Chinese companies that compete 21
5050 with United States businesses; 22
5151 (6) prioritize— 23

5656 gaged in trade secret theft, hacking, and eco-2
5757 nomic espionage; 3
5858 (B) protecting the critical infrastructure in 4
5959 the United States against external threats 5
6060 through foreign direct investment and supply 6
6161 chain compromises; and 7
6262 (C) identifying Chinese Communist Party 8
6363 theft of intellectual property from small busi-9
6464 nesses; and 10
6565 (7) investigate investments made by Chinese 11
6666 companies included on the Entity List maintained 12
6767 by the Bureau of Industry and Security of the De-13
6868 partment of Commerce and set forth in Supplement 14
6969 No. 4 to part 744 of title 15, Code of Federal Regu-15
7070 lations, or identified by the Secretary of Defense 16
7171 under section 1260H(a) of the William M. (Mac) 17
7272 Thornberry National Defense Authorization Act for 18
7373 Fiscal Year 2021 (Public Law 116–283; 10 U.S.C. 19
7474 113 note) as a Chinese military company operating 20
7575 directly or indirectly in the United States and report 21
7676 to the Secretary of Commerce or the Secretary of 22
7777 Defense, as appropriate, on any findings of such in-23
7878 vestigations, including findings related to subsidi-24
7979 aries or other entities controlled by such companies, 25

8484 registered in or operate in the People’s Republic of 2
8585 China. 3
8686 (b) C
8787 ONSULTATION.—In executing the CCP Initia-4
8888 tive’s objectives as set forth in subsection (a), the Attorney 5
8989 General, acting through the Assistant Attorney General 6
9090 for National Security, shall consult with relevant compo-7
9191 nents of the Department of Justice as necessary, and co-8
9292 ordinate activities with the Federal Bureau of Investiga-9
9393 tion and any other Federal agency as necessary. 10
9494 (c) R
9595 EQUIREMENT.—Under the CCP Initiative— 11
9696 (1) the Initiative shall be separate from and not 12
9797 under the authority or discretion of any other De-13
9898 partment of Justice initiative dedicated to coun-14
9999 tering nation-state threats; and 15
100100 (2) all resources used for the CCP Initiative 16
101101 shall solely be set aside for the CCP Initiative and 17
102102 shall not be combined to support any other Depart-18
103103 ment of Justice program, including other programs 19
104104 and initiatives dedicated to countering nation-state 20
105105 threats. 21

107107 NNUALREPORT.—The Attorney General shall 22
108108 submit to the Committee on Homeland Security and Gov-23
109109 ernmental Affairs and the Committee on the Judiciary of 24
110110 the Senate and the Committee on Homeland Security and 25

115115 resentatives on the progress and challenges of the CCP 2
116116 Initiative over the preceding year, including— 3
117117 (1) its progress in accomplishing the objectives 4
118118 set forth in subsection (a); 5
119119 (2) the amount and sufficiency of resources 6
120120 provided to, and expended by, the CCP Initiative; 7
121121 (3) the level and effectiveness of coordination 8
122122 with the Federal Bureau of Investigation and other 9
123123 Federal agencies; 10
124124 (4) the status of efforts by and the financial in-11
125125 telligence capabilities of the Chinese Communist 12
126126 Party to engage in trade secret theft, hacking, and 13
127127 economic espionage; 14
128128 (5) an analysis of the use of unmanned aircraft 15
129129 and associated elements (including communication 16
130130 links and the components that control the unmanned 17
131131 aircraft required for the operator to operate safely 18
132132 and efficiently in the national airspace system) by 19
133133 the Chinese Communist Party; 20
134134 (6) the impact of the CCP Initiative on those 21
135135 efforts of the Chinese Communist Party; 22
136136 (7) the level and effectiveness of coordination 23
137137 and information sharing between Federal agencies 24

144144 United States as a result of hacking and trade se-4
145145 cret theft by the Chinese Communist Party. 5

147147 UNSET.—This Act shall cease to be in effect on 6
148148 the date that is 6 years after the date of enactment of 7
149149 this Act. 8

151151 EVERABILITY.—If any provision of this Act, or 9
152152 the application of such provision to any person or cir-10
153153 cumstance, is held to be unconstitutional, the remainder 11
154154 of this Act, and the application of the provisions of such 12
155155 to any person or circumstance, shall not be affected there-13
156156 by. 14
