1515 Be it enacted by the Senate and House of Representa-1
1616 tives of the United States of America in Congress assembled, 2
1717 SECTION 1. SHORT TITLE. 3
1818 This Act may be cited as the ‘‘Border Airport Fair-4
1919 ness Act of 2025’’. 5
2020 SEC. 2. DESIGNATION OF CERTAIN AIRPORTS AS PORTS OF 6
2121 ENTRY. 7
2222 (a) I
2323 NGENERAL.—The President shall— 8
2424 (1) pursuant to the Act of August 1, 1914 (38 9
2525 Stat. 623, chapter 223; 19 U.S.C. 2), designate each 10

2929 airport described in subsection (b) as a port of 1
3030 entry; and 2
3131 (2) terminate the application of the user fee re-3
3232 quirement under section 236 of the Trade and Tar-4
3333 iff Act of 1984 (19 U.S.C. 58b) with respect to the 5
3434 airport. 6
3535 (b) A
3636 IRPORTSDESCRIBED.—An airport described in 7
3737 this subsection is an airport that— 8
3838 (1) is a primary airport (as defined in section 9
3939 47102 of title 49, United States Code); 10
4040 (2) is located not more than 30 miles from the 11
4141 northern or southern international land border of 12
4242 the United States; 13
4343 (3) is associated, through a formal, legal instru-14
4444 ment, including a valid contract or governmental or-15
4545 dinance, with a land border crossing or a seaport not 16
4646 more than 30 miles from the airport; and 17
4747 (4) through such association, meets the numer-18
4848 ical criteria considered by U.S. Customs and Border 19
4949 Protection for establishing a port of entry, as set 20
5050 forth in— 21
5151 (A) Treasury Decision 82–37 (47 Fed. 22
5252 Reg. 10137; relating to revision of customs cri-23
5353 teria for establishing ports of entry and sta-24
5454 tions), as revised by Treasury Decisions 86–14 25
