1717 SECTION 1. SHORT TITLE. 3
1818 This Act may be cited as the ‘‘Fighting Foreign Ille-4
1919 gal Seafood Harvests Act of 2025’’ or the ‘‘FISH Act of 5
2020 2025’’. 6
2121 SEC. 2. DEFINITIONS. 7

3232 ENEFICIAL OWNER.—The term ‘‘beneficial 3
3333 owner’’ means, with respect to a vessel, a person 4
3434 that, directly or indirectly, through any contract, ar-5
3535 rangement, understanding, relationship, or other-6
3636 wise— 7
3737 (A) exercises substantial control over the 8
3838 vessel; or 9
3939 (B) owns not less than 50 percent of the 10
4040 ownership interests in the vessel. 11

4242 ISH.—The term ‘‘fish’’ means finfish, 12
4343 crustaceans, and mollusks. 13

4545 ORCED LABOR.—The term ‘‘forced labor’’ 14
4646 has the meaning given that term in section 307 of 15
4747 the Tariff Act of 1930 (19 U.S.C. 1307). 16

4949 FISHING.—The term ‘‘IUU fishing’’ 17
5050 means activities described as illegal fishing, unre-18
5151 ported fishing, or unregulated fishing in paragraph 19
5252 3 of the International Plan of Action to Prevent, 20
5353 Deter and Eliminate Illegal, Unreported and Un-21
5454 regulated Fishing, adopted at the 24th Session of 22
5555 the Committee on Fisheries in Rome on March 2, 23
5656 2001. 24

6161 NIZATION.—The terms ‘‘regional fisheries manage-2
6262 ment organization’’ and ‘‘RFMO’’ have the meaning 3
6363 given the terms in section 303 of the Port State 4
6464 Measures Agreement Act of 2015 (16 U.S.C. 7402). 5

6666 EAFOOD.—The term ‘‘seafood’’ means 6
6767 fish, shellfish, processed fish, fish meal, shellfish 7
6868 products, and all other forms of marine animal and 8
6969 plant life other than marine mammals and birds. 9

7171 ECRETARY.—Unless otherwise provided, 10
7272 the term ‘‘Secretary’’ means the Secretary of Com-11
7373 merce acting through the Administrator of the Na-12
7474 tional Oceanic and Atmospheric Administration or 13
7575 the designee of the Administrator. 14
7676 SEC. 3. STATEMENT OF POLICY. 15
7777 It is the policy of the United States to partner, con-16
7878 sult, and coordinate with foreign governments (at the na-17
7979 tional and subnational levels), civil society, international 18
8080 organizations, international financial institutions, sub-19
8181 national coastal communities, commercial and recreational 20
8282 fishing industry leaders, communities that engage in 21
8383 artisanal or subsistence fishing, fishers, and the private 22
8484 sector, in a concerted effort— 23
8585 (1) to continue the broad effort across the Fed-24
8686 eral Government to counter IUU fishing, including 25

9191 ficking, and other threats to maritime security, as 2
9292 outlined in sections 3533 and 3534 of the Maritime 3
9393 SAFE Act (16 U.S.C. 8002 and 8003); and 4
9494 (2) to, additionally— 5
9595 (A) prioritize efforts to prevent IUU fish-6
9696 ing at its sources; and 7
9797 (B) support continued implementation of 8
9898 the Central Arctic Ocean Fisheries agreement, 9
9999 as well as joint research and follow-on actions 10
100100 that ensure sustainability of fish stocks in Arc-11
101101 tic international waters. 12
102102 SEC. 4. ESTABLISHMENT OF A BLACK LIST (IUU VESSEL 13
103103 LIST). 14
104104 Section 608 of the High Seas Driftnet Fishing Mora-15
105105 torium Protection Act (16 U.S.C. 1826i) is amended by 16
106106 striking subsections (c) and (d) and inserting the fol-17
107107 lowing: 18
108108 ‘‘(c) B
109109 LACKLIST(IUU VESSELLIST).— 19
110110 ‘‘(1) I
111111 N GENERAL.—The Secretary, in coordina-20
112112 tion with the Secretary of State, the Commissioner 21
113113 of U.S. Customs and Border Protection, and the 22
114114 Secretary of Labor, shall develop, maintain, and 23
115115 make public a list of foreign vessels, foreign fleets, 24
116116 and beneficial owners of foreign vessels or foreign 25

122122 section as the ‘IUU vessel list’). 3

124124 NCLUSION ON LIST.—The IUU vessel list 4
125125 shall include any foreign vessel, foreign fleet, or ben-5
126126 eficial owner of a foreign vessel or foreign fleet for 6
127127 which the Secretary determines there is clear and 7
128128 convincing evidence to believe that a foreign vessel 8
129129 is any of the following (even if the Secretary has 9
130130 only partial information regarding the foreign ves-10
131131 sel): 11
132132 ‘‘(A) A foreign vessel listed on an IUU ves-12
133133 sel list of an international fishery management 13
134134 organization. 14
135135 ‘‘(B) A foreign vessel taking part in fishing 15
136136 that undermines the effectiveness of an inter-16
137137 national fishery management organization’s 17
138138 conservation and management measures, in-18
139139 cluding a foreign vessel— 19
140140 ‘‘(i) exceeding applicable international 20
141141 fishery management organization catch 21
142142 limits; or 22
143143 ‘‘(ii) that is operating inconsistent 23
144144 with relevant catch allocation arrange-24
145145 ments of the international fishery manage-25

150150 the authority of a foreign country that is 2
151151 not a member of the international fishery 3
152152 management organization. 4
153153 ‘‘(C) A foreign vessel, either on the high 5
154154 seas or in the exclusive economic zone of an-6
155155 other country, identified and reported by 7
156156 United States authorities to an international 8
157157 fishery management organization to be con-9
158158 ducting IUU fishing when the United States 10
159159 has reason to believe the foreign country to 11
160160 which the foreign vessel is registered or docu-12
161161 mented is not addressing the allegation. 13
162162 ‘‘(D) A foreign vessel, foreign fleet, or ben-14
163163 eficial owner of a foreign vessel or foreign fleet 15
164164 on the high seas identified by United States au-16
165165 thorities to be conducting IUU fishing or fish-17
166166 ing that involves the use of forced labor, includ-18
167167 ing individuals and entities subject to a with-19
168168 hold release order or a finding issued by U.S. 20
169169 Customs and Border Protection pursuant to 21
170170 section 307 of the Tariff Act of 1930 (19 22
171171 U.S.C. 1307) or any other U.S. Customs and 23
172172 Border Protection enforcement action, sanctions 24
173173 imposed by the Department of the Treasury 25

178178 countability Act (22 U.S.C. 10101 et seq.), or 2
179179 any other United States Government forced 3
180180 labor prevention or enforcement action that has 4
181181 not been subsequently revoked. 5
182182 ‘‘(E) A foreign vessel that provides services 6
183183 (excluding emergency or enforcement services) 7
184184 to a foreign vessel that is on the IUU vessel 8
185185 list, including transshipment, resupply, refuel-9
186186 ing, or pilotage. 10
187187 ‘‘(F) A foreign vessel that is a fishing ves-11
188188 sel engaged in commercial fishing within the ex-12
189189 clusive economic zone of the United States 13
190190 without a permit issued under title II of the 14
191191 Magnuson-Stevens Fishery Conservation and 15
192192 Management Act (16 U.S.C. 1821 et seq.). 16
193193 ‘‘(G) A foreign vessel that has the same 17
194194 beneficial owner as a foreign vessel on the IUU 18
195195 vessel list at the time of the infraction. 19
196196 ‘‘(H) A foreign vessel or beneficial owner 20
197197 of a foreign vessel subject to economic sanctions 21
198198 administered by the Department of the Treas-22
199199 ury Office of Foreign Assets Control for 23
200200 transnational criminal activity associated with 24
201201 IUU fishing under Executive Order 13581 (76 25

209209 by the Department of the Treasury under the 5
210210 Global Magnitsky Human Rights Accountability 6
211211 Act (22 U.S.C. 10101 et seq.). 7
212212 ‘‘(3) N
213213 OMINATIONS TO BE PUT ON THE BLACK 8
214214 (IUU VESSEL) LIST.—The Secretary may receive 9
215215 nominations for putting a foreign vessel on the IUU 10
216216 vessel list from— 11
217217 ‘‘(A) the head of an executive branch agen-12
218218 cy that is a member of the Interagency Work-13
219219 ing Group on IUU Fishing established under 14
220220 section 3551 of the Maritime SAFE Act (16 15
221221 U.S.C. 8031); 16
222222 ‘‘(B) a country that is a member of the 17
223223 Combined Maritime Forces; or 18
224224 ‘‘(C) civil organizations that have data- 19
225225 sharing agreements with a member of the Inter-20
226226 agency Working Group on IUU Fishing. 21
227227 ‘‘(4) P
228228 ROCEDURES FOR ADDITION .—The Sec-22
229229 retary may put a foreign vessel on the IUU vessel 23
230230 list only after notification to the foreign vessel’s ben-24
231231 eficial owner and a review of any information that 25

235235 the owner provides within 90 days of the notifica-1
236236 tion. 2
237237 ‘‘(5) P
238238 UBLIC INFORMATION .—The Secretary 3
239239 shall publish its procedures for adding foreign ves-4
240240 sels on, and removing foreign vessels from, the IUU 5
241241 vessel list. The Secretary shall publish the IUU ves-6
242242 sel list itself in the Federal Register annually and on 7
243243 a website, which shall be updated any time a foreign 8
244244 vessel is added to the IUU vessel list, and include 9
245245 the following information (as much as is available 10
246246 and confirmed) for each foreign vessel on the IUU 11
247247 vessel list: 12
248248 ‘‘(A) The name of the foreign vessel and 13
249249 previous names of the foreign vessel. 14
250250 ‘‘(B) The International Maritime Organi-15
251251 zation (IMO) number of the foreign vessel, or 16
252252 other Unique Vessel Identifier (such as the flag 17
253253 state permit number or authorized vessel num-18
254254 ber issued by an international fishery manage-19
255255 ment organization). 20
256256 ‘‘(C) The maritime mobile service identity 21
257257 number and call sign of the foreign vessel. 22
258258 ‘‘(D) The business or corporate address of 23
259259 each beneficial owner of the foreign vessel. 24

264264 is registered or documented, and where it was 2
265265 previously registered if known. 3
266266 ‘‘(F) The date of inclusion on the IUU ves-4
267267 sel list of the foreign vessel. 5
268268 ‘‘(G) Any other Unique Vessel Identifier 6
269269 (UVI), if applicable. 7
270270 ‘‘(H) Any other identifying information on 8
271271 the foreign vessel, as determined appropriate by 9
272272 the Secretary. 10
273273 ‘‘(I) The basis for the Secretary’s inclusion 11
274274 of the foreign vessel on the IUU vessel list 12
275275 under paragraph (2). 13

277277 ONSEQUENCES OF BEING ONBLACKLIST 14

279279 ESSELLIST).— 15
280280 ‘‘(1) I
281281 N GENERAL.—Except for the purposes of 16
282282 inspection and enforcement or in case of force 17
283283 majeure, a foreign vessel on the IUU vessel list is 18
284284 prohibited from— 19
285285 ‘‘(A) accessing United States ports and 20
286286 using port services; 21
287287 ‘‘(B) traveling through the United States 22
288288 territorial sea unless it is conducting innocent 23
289289 passage; and 24

294294 services, or transshipment, within waters sub-2
295295 ject to the jurisdiction of the United States, un-3
296296 less such prohibition would be inconsistent with 4
297297 customary international law. 5
298298 ‘‘(2) S
299299 ERVICING PROHIBITED.—No vessel of the 6
300300 United States may service a foreign vessel that is on 7
301301 the IUU vessel list, except in an emergency involving 8
302302 life and safety or to facilitate enforcement. 9
303303 ‘‘(3) I
304304 MPORTS PROHIBITED .—The import of 10
305305 seafood or seafood products caught, processed, or 11
306306 transported by foreign vessels on the IUU vessel list 12
307307 is prohibited and shall be subject to the enforcement 13
308308 provisions of section 606. 14
309309 ‘‘(4) F
310310 ISHING TREATIES AND AGREEMENTS .—It 15
311311 should be a priority for United States delegations 16
312312 to— 17
313313 ‘‘(A) advocate for the incorporation of arti-18
314314 cles in international fishery management orga-19
315315 nizations providing identical or similar safe-20
316316 guards described in this section in new and up-21
317317 dated bilateral or multilateral fishing treaties; 22
318318 and 23
319319 ‘‘(B) encourage parties to international 24
320320 and regional fisheries organizations that the 25

326326 section. 3

328328 NFORCEMENT OF BLACKLIST(IUU VESSEL 4
329329 L
330330 IST).— 5
331331 ‘‘(1) I
332332 N GENERAL.—Except as provided in para-6
333333 graph (2), a foreign vessel on the IUU vessel list 7
334334 and the cargo of such vessel shall be subject to sei-8
335335 zure and forfeiture to the United States in the same 9
336336 manner as merchandise is forfeited for violation of 10
337337 the customs revenue laws. 11
338338 ‘‘(2) E
339339 XCEPTION.—The cargo of seafood of a 12
340340 foreign vessel on the IUU vessel list shall not be 13
341341 subject to seizure and forfeiture to the United States 14
342342 if the cargo of seafood is in the possession of an im-15
343343 porter who has paid for the cargo of seafood and did 16
344344 not know, or did not have any reason to know, that 17
345345 the seafood was the product of IUU fishing. 18
346346 ‘‘(f) P
347347 ERMANENCY OF BLACKLIST(IUU VESSEL 19
348348 L
349349 IST).— 20
350350 ‘‘(1) I
351351 N GENERAL.—Except as provided in para-21
352352 graphs (2) through (4), a foreign vessel, foreign 22
353353 fleet, or beneficial owner of a foreign vessel or for-23
354354 eign fleet that is put on the IUU vessel list shall re-24
355355 main on the IUU vessel list. 25

359359 ‘‘(2) REVOCATION OF WRO .—The Secretary 1
360360 shall remove a foreign vessel or foreign fleet from 2
361361 the IUU vessel list if the foreign vessel was added 3
362362 to the IUU vessel list because it was found by U.S. 4
363363 Customs and Border Protection to have had a with-5
364364 hold release order or a finding issued pursuant to 6
365365 section 307 of the Tariff Act of 1930 (19 U.S.C. 7
366366 1307) and the withhold release order was subse-8
367367 quently revoked. 9
368368 ‘‘(3) A
369369 PPLICATION BY OWNER FOR POTENTIAL 10
370370 REMOVAL.— 11
371371 ‘‘(A) I
372372 N GENERAL.—In consultation with 12
373373 the Secretary of State and the U.S. Customs 13
374374 and Border Protection, the Secretary may re-14
375375 move a foreign vessel, foreign fleet, or beneficial 15
376376 owner of a foreign vessel or foreign fleet from 16
377377 the IUU vessel list if the beneficial owner of the 17
378378 foreign vessel submits an application for re-18
379379 moval to the Secretary that meets the stand-19
380380 ards that the Secretary has set out for removal. 20
381381 ‘‘(B) S
382382 TANDARDS.—The Secretary shall in-21
383383 clude in the standards set out for removal a de-22
384384 termination that the foreign vessel or foreign 23
385385 vessel owner has not engaged in IUU fishing or 24
386386 fishing that involves the use of forced labor dur-25

390390 ing the 5-year period preceding the date of the 1
391391 application for removal. The Secretary, in con-2
392392 sultation with the Secretary of State and the 3
393393 U.S. Customs and Border Protection, shall de-4
394394 termine whether each application for removal 5
395395 demonstrates that sufficient corrective action 6
396396 has been taken to remediate the violations and 7
397397 infractions that led to the inclusion on the IUU 8
398398 vessel list. 9
399399 ‘‘(C) C
400400 ONSIDERATION OF RELEVANT IN -10
401401 FORMATION.—In considering an application for 11
402402 removal, the Secretary shall consider relevant 12
403403 information from all sources. 13
404404 ‘‘(4) R
405405 EMOVAL DUE TO INTERNATIONAL FISH -14
406406 ERY MANAGEMENT ORGANIZATION ACTION .—The 15
407407 Secretary may remove a foreign vessel from the IUU 16
408408 vessel list if the foreign vessel was put on the list be-17
409409 cause it was a foreign vessel listed on an IUU vessel 18
410410 list of an international fishery management organi-19
411411 zation, pursuant to subsection (c)(2)(A), and the 20
412412 international fishery management organization re-21
413413 moved the foreign vessel from its IUU vessel list. 22
414414 ‘‘(g) R
415415 EGULATIONS AND PROCESS.—Not later than 23
416416 12 months after the date of enactment of the Fighting 24
417417 Foreign Illegal Seafood Harvests Act of 2025, the Sec-25

422422 lishing, maintaining, implementing, and publishing the 2
423423 IUU vessel list. The Administrator may add or remove a 3
424424 foreign vessel, foreign fleet, or beneficial owner of a for-4
425425 eign vessel or foreign fleet from the IUU vessel list on 5
426426 the date the foreign vessel becomes eligible for such addi-6
427427 tion or removal. 7

711711 lateral and multilateral initiatives should address under-10
712712 lying drivers of IUU fishing and fishing that involves the 11
713713 use of forced labor, such as the practice of transshipment, 12
714714 flags of convenience vessels, and government subsidies of 13
715715 the distant water fishing industry. 14

752752 patrols and future patrol plans for operations with 19
753753 partner nations where bilateral agreements are re-20
754754 quired to effectively execute the counter-IUU mis-21
755755 sion and any changes to IUU provisions in bilateral 22

757757 (2) incidents of IUU fishing observed while con-24
758758 ducting High Seas Boarding and Inspections 25
