45	45	(1) to achieve a fair, equitable, and final settle-3
46	46	ment of claims to water rights in the State of Cali-4
47	47	fornia for— 5
48	48	(A) the Tule River Tribe; and 6
49	49	(B) the United States, acting as trustee 7
50	50	for the Tribe; 8
51	51	(2) to authorize, ratify, and confirm the 2007 9
52	52	Agreement entered by the Tribe, the South Tule 10
53	53	Independent Ditch Company, and the Tule River As-11
54	54	sociation, to the extent that the 2007 Agreement is 12
55	55	consistent with this Act; 13
56	56	(3) to authorize and direct the Secretary— 14
57	57	(A) to execute the 2007 Agreement, with 15
58	58	amendments to facilitate implementation and 16
59	59	approval of the 2007 Agreement; and 17
60	60	(B) to take any other actions necessary to 18
61	61	carry out the 2007 Agreement in accordance 19
62	62	with this Act; 20

70	70	SEC. 3. DEFINITIONS. 5

72	72	NGENERAL.—In this Act: 6
73	73	(1) 2007
74	74	AGREEMENT.—The term ‘‘2007 7
75	75	Agreement’’ means— 8
76	76	(A) the agreement dated November 21, 9
77	77	2007, as amended on April 22, 2009, between 10
78	78	the Tribe, the South Tule Independent Ditch 11
79	79	Company, and the Tule River Association, and 12
80	80	exhibits attached thereto; and 13
81	81	(B) any amendment to the Agreement re-14
82	82	ferred to in subparagraph (A) (including an 15
83	83	amendment to any exhibit) that is executed in 16
84	84	accordance with section 4(a)(2). 17
85	85	(2) C
86	86	OURT.—The term ‘‘Court’’ means the 18
87	87	United States District Court for the Eastern Dis-19
88	88	trict of California, unless otherwise specified herein. 20

90	90	IVERT; DIVERSION.—The terms ‘‘divert’’ 21
91	91	and ‘‘diversion’’ mean to remove water from its nat-22
92	92	ural course or location by means of a ditch, canal, 23
93	93	flume, bypass, pipeline, conduit, well, pump, or other 24
94	94	structure or device, or act of a person. 25

103	103	Company and its successors and assigns; and 6
104	104	(C) any and all other holders of water 7
105	105	rights in the South Fork Tule River Basin. 8

168	168	firmed, and declared to be valid for the benefit of 6
169	169	the Tribe as set forth and described in the 2007 7
170	170	Agreement and this Act. 8

172	172	RIBE.—The term ‘‘Tribe’’ means the 9
173	173	Tule River Indian Tribe of the Tule River Reserva-10
174	174	tion, California, a federally recognized Indian Tribe. 11

176	176	RUST FUND.—The term ‘‘Trust Fund’’ 12
177	177	means the Tule River Indian Tribe Settlement Trust 13
178	178	Fund established under section 6(a). 14

203	203	treatment, storage, and distribution infrastructure, 7
204	204	to be constructed, in whole or in part, using monies 8
205	205	from the Trust Fund. 9

208	208	term used in this Act but not defined in subsection (a)— 11
209	209	(1) has the meaning given the term in the 2007 12

213	213	sistent with its use in the 2007 Agreement. 16
214	214	SEC. 4. RATIFICATION OF 2007 AGREEMENT. 17

219	219	Act and to the extent that the 2007 Agreement does 20
220	220	not conflict with this Act, the 2007 Agreement is au-21

239	239	stitute site for the Phase I Reservoir is 8
240	240	identified by the Tribe pursuant to section 9
241	241	3.4.B.(2)(a) of the 2007 Agreement, then 10
242	242	amendments related to the Operation 11
243	243	Rules are authorized, ratified, and con-12
244	244	firmed, to the extent that such Amend-13
245	245	ments are consistent with the 2007 Agree-14
246	246	ment and this Act. 15

248	248	RIORITY DATE.—Amendments 16
249	249	agreed to by the Parties to establish that 17
250	250	the priority date for the Tribal Water 18
251	251	Right is no later than January 9, 1873, is 19
252	252	authorized, ratified, and confirmed. 20

254	254	ENIOR WATER RIGHTS .— 21
255	255	Amendments agreed to by the Parties to 22

269	269	amendments agreed to by the Parties to 7
270	270	facilitate implementation and approval of 8
271	271	the 2007 Agreement are authorized, rati-9
272	272	fied, and confirmed, to the extent that 10
273	273	such amendments are otherwise consistent 11
274	274	with this Act and with other applicable 12
275	275	law. 13

277	277	XECUTION.— 14
278	278	(1) I
279	279	N GENERAL.—To the extent the 2007 15
280	280	Agreement does not conflict with this Act, the Sec-16
281	281	retary shall execute the 2007 Agreement, in accord-17
282	282	ance with paragraph (2), including all exhibits to, or 18
283	283	parts of, the 2007 Agreement requiring the signa-19
284	284	ture of the Secretary. 20
285	285	(2) T
286	286	IMING.—The Secretary shall not execute 21
287	287	the 2007 Agreement until— 22
288	288	(A) the Parties agree on amendments re-23
289	289	lated to the priority date for the Tribal Water 24
290	290	Right; and 25

299	299	site pursuant to section 3.4.B.(2) of the 6
300	300	2007 Agreement, either— 7
301	301	(I) the Parties agree on Oper-8
302	302	ation Rules; or 9
303	303	(II) the Secretary determines, in 10
304	304	the discretion of the Secretary, that 11
305	305	the Parties have reached an impasse 12
306	306	in attempting to negotiate the Oper-13
307	307	ation Rules. 14

309	309	ODIFICATIONS.—Nothing in this Act pro-15
310	310	hibits the Secretary, after execution of the 2007 16
311	311	Agreement, from approving any modification to the 17
312	312	2007 Agreement, including any exhibit to the 2007 18
313	313	Agreement, that is consistent with this Act, to the 19
314	314	extent that the modification does not otherwise re-20
315	315	quire congressional approval under section 2116 of 21
316	316	the Revised Statutes (25 U.S.C. 177) or any other 22
317	317	applicable provision of Federal law. 23

319	319	NVIRONMENTAL COMPLIANCE.— 24

324	324	Agreement and this Act, the Secretary shall comply 2
325	325	with all applicable provisions of— 3
326	326	(A) the Endangered Species Act of 1973 4
327	327	(16 U.S.C. 1531 et seq.); 5
328	328	(B) the National Environmental Policy Act 6
329	329	of 1969 (42 U.S.C. 4321 et seq.), including the 7
330	330	implementing regulations of that Act; and 8
331	331	(C) other applicable Federal environmental 9
332	332	laws and regulations. 10
333	333	(2) C
334	334	OMPLIANCE.— 11
335	335	(A) I
336	336	N GENERAL.—In implementing the 12
337	337	2007 Agreement and this Act, the Tribe shall 13
338	338	prepare any necessary environmental docu-14
339	339	ments, consistent with all applicable provisions 15
340	340	of— 16
341	341	(i) the Endangered Species Act of 17
342	342	1973 (16 U.S.C. 1531 et seq.); 18
343	343	(ii) the National Environmental Policy 19
344	344	Act of 1969 (42 U.S.C. 4321 et seq.), in-20
345	345	cluding the implementing regulations of 21
346	346	that Act; and 22
347	347	(iii) all other applicable Federal envi-23
348	348	ronmental laws and regulations. 24

352	352	(B) AUTHORIZATIONS.—The Secretary 1
353	353	shall— 2
354	354	(i) independently evaluate the docu-3
355	355	mentation submitted under subparagraph 4
356	356	(A); and 5
357	357	(ii) be responsible for the accuracy, 6
358	358	scope, and contents of that documentation. 7
359	359	(3) E
360	360	FFECT OF EXECUTION .—The execution of 8
361	361	the 2007 Agreement by the Secretary under this sec-9
362	362	tion shall not constitute a major Federal action for 10
363	363	purposes of the National Environmental Policy Act 11
364	364	of 1969 (42 U.S.C. 4321 et seq.). 12
365	365	(4) C
366	366	OSTS.—Any costs associated with the per-13
367	367	formance of the compliance activities under this sub-14
368	368	section shall be paid from funds deposited in the 15
369	369	Trust Fund, subject to the condition that any costs 16
370	370	associated with the performance of Federal approval 17
371	371	or other review of such compliance work or costs as-18
372	372	sociated with inherently Federal functions shall re-19
373	373	main the responsibility of the Secretary. 20
374	374	SEC. 5. TRIBAL WATER RIGHT. 21
375	375	(a) C
376	376	ONFIRMATION OFTRIBALWATERRIGHT.— 22
377	377	(1) I
378	378	N GENERAL.—The Tribal Water Right is 23
379	379	ratified, confirmed, and declared valid. 24

383	383	(2) QUANTIFICATION.—The Tribal Water Right 1
384	384	includes the right to divert and use or permit the di-2
385	385	version and use of up to 5,828 acre-feet per year of 3
386	386	surface water from the South Fork Tule River, as 4
387	387	described in the 2007 Agreement and as confirmed 5
388	388	in the decree entered by the Court pursuant to sub-6
389	389	sections (b) and (c) of section 12. 7
390	390	(3) U
391	391	SE.—Any diversion, use, and place of use 8
392	392	of the Tribal Water Right shall be subject to the 9
393	393	terms and conditions of the 2007 Agreement and 10
394	394	this Act. 11
395	395	(b) T
396	396	RUSTSTATUS OFTRIBALWATERRIGHT.—The 12
397	397	Tribal Water Right— 13
398	398	(1) shall be held in trust by the United States 14
399	399	for the use and benefit of the Tribe in accordance 15
400	400	with this Act; and 16
401	401	(2) shall not be subject to loss through non-use, 17
402	402	forfeiture, abandonment, or other operation of law. 18
403	403	(c) A
404	404	UTHORITY OF THETULERIVERTRIBE.— 19
405	405	(1) I
406	406	N GENERAL.—The Tule River Tribe shall 20
407	407	have the authority to allocate and distribute the 21
408	408	Tribal Water Right for use on the Reservation in ac-22
409	409	cordance with the 2007 Agreement, this Act, and 23
410	410	applicable Federal law. 24

412	412	DMINISTRATION.— 25

416	416	(1) NO ALIENATION.—The Tribe shall not per-1
417	417	manently alienate any portion of the Tribal Water 2
418	418	Right. 3

420	420	URCHASES OR GRANTS OF LAND FROM IN -4
421	421	DIANS.—An authorization provided by this Act for 5
422	422	the allocation, distribution, leasing, or other ar-6
423	423	rangement entered into pursuant to this Act shall be 7
424	424	considered to satisfy any requirement for authoriza-8
425	425	tion of the action by treaty or convention imposed by 9
426	426	section 2116 of the Revised Statutes (25 U.S.C. 10
427	427	177). 11

429	429	ROHIBITION ON FORFEITURE .—The non- 12
430	430	use of all or any portion of the Tribal Water Right 13
431	431	by any water user shall not result in the forfeiture, 14
432	432	abandonment, relinquishment, or other loss of all or 15
433	433	any portion of the Tribal Water Right. 16
434	434	SEC. 6. TULE RIVER TRIBE TRUST ACCOUNTS. 17
435	435	(a) E
436	436	STABLISHMENT.—The Secretary shall establish 18
437	437	a trust fund, to be known as the ‘‘Tule River Indian Tribe 19
438	438	Settlement Trust Fund’’, to be managed, invested, and 20
439	439	distributed by the Secretary and to remain available until 21
440	440	expended, withdrawn, or reverted to the general fund of 22
441	441	the Treasury, consisting of the amounts deposited in the 23
442	442	Trust Fund under subsection (c), together with any inter-24

449	449	CCOUNTS.—The Secretary shall establish in the 3
450	450	Trust Fund the following Accounts: 4
451	451	(1) The Tule River Tribe Water Development 5
452	452	Projects Account. 6
453	453	(2) The Tule River Tribe OM&R Account. 7

1277	1277	this section shall remain the property of the holder 18
1278	1278	and shall be removed not later than 90 days after 19
1279	1279	the date on which the right, contract, lease, permit, 20
1280	1280	or right-of-way expires, unless the Tribe and the 21
1281	1281	holder agree otherwise. Any such property remaining 22
1282	1282	beyond the 90-day period shall become the property 23

1299	1299	(B) location, entry, and patent under the 10
1300	1300	mining laws; and 11
1301	1301	(C) disposition under all laws pertaining to 12
1302	1302	mineral and geothermal leasing or mineral ma-13
1303	1303	terials. 14

1305	1305	XPIRATION.—The withdrawals pursuant to 15
1306	1306	paragraph (1) shall terminate on the date that the 16
1307	1307	Secretary takes the lands into trust for the benefit 17
1308	1308	of the Tribe pursuant to subsection (a)(1). 18

1312	1312	the United States may, with the consent of the Tribe, 21

1314	1314	to more specifically identify the parcels to be exchanged. 23

1332	1332	retary of Agriculture shall provide such assistance as 11
1333	1333	may be appropriate— 12
1334	1334	(A) to conduct additional surveys of the 13
1335	1335	transferred land; and 14
1336	1336	(B) to satisfy administrative requirements 15
1337	1337	necessary to accomplish the land transfers 16
1338	1338	under this section. 17

1340	1340	ATE OFTRANSFER.—The Secretary shall issue 18
1341	1341	trust deeds for all land transfers under this section by not 19

1606	1606	(C) any action carried out by the Sec-20
1607	1607	retary, and any contract or agreement entered 21
1608	1608	into pursuant to this Act, shall be void; 22
1609	1609	(D) any unexpended Federal funds appro-23
1610	1610	priated or made available to carry out the ac-24
1611	1611	tivities authorized by this Act, together with 25

1631	1631	with any interest accrued on those funds, 17
