4444 The purposes of this Act are— 2
4545 (1) to achieve a fair, equitable, and final settle-3
4646 ment of claims to water rights in the State of Cali-4
4747 fornia for— 5
4848 (A) the Tule River Tribe; and 6
4949 (B) the United States, acting as trustee 7
5050 for the Tribe; 8
5151 (2) to authorize, ratify, and confirm the 2007 9
5252 Agreement entered by the Tribe, the South Tule 10
5353 Independent Ditch Company, and the Tule River As-11
5454 sociation, to the extent that the 2007 Agreement is 12
5555 consistent with this Act; 13
5656 (3) to authorize and direct the Secretary— 14
5757 (A) to execute the 2007 Agreement, with 15
5858 amendments to facilitate implementation and 16
5959 approval of the 2007 Agreement; and 17
6060 (B) to take any other actions necessary to 18

7272 NGENERAL.—In this Act: 6

7474 AGREEMENT.—The term ‘‘2007 7
7575 Agreement’’ means— 8
7676 (A) the agreement dated November 21, 9
7777 2007, as amended on April 22, 2009, between 10
7878 the Tribe, the South Tule Independent Ditch 11
7979 Company, and the Tule River Association, and 12
8080 exhibits attached thereto; and 13
8181 (B) any amendment to the Agreement re-14
8282 ferred to in subparagraph (A) (including an 15
8383 amendment to any exhibit) that is executed in 16
8484 accordance with section 4(a)(2). 17

8686 OURT.—The term ‘‘Court’’ means the 18
8787 United States District Court for the Eastern Dis-19
8888 trict of California, unless otherwise specified herein. 20

9090 IVERT; DIVERSION.—The terms ‘‘divert’’ 21
9191 and ‘‘diversion’’ mean to remove water from its nat-22
9292 ural course or location by means of a ditch, canal, 23
9393 flume, bypass, pipeline, conduit, well, pump, or other 24
9494 structure or device, or act of a person. 25

104104 (C) any and all other holders of water 7

147147 1873, October 3, 1873, and August 3, 1878, includ-16
148148 ing lands added to the Reservation pursuant to sec-17

168168 firmed, and declared to be valid for the benefit of 6
169169 the Tribe as set forth and described in the 2007 7
170170 Agreement and this Act. 8

172172 RIBE.—The term ‘‘Tribe’’ means the 9
173173 Tule River Indian Tribe of the Tule River Reserva-10
174174 tion, California, a federally recognized Indian Tribe. 11

176176 RUST FUND.—The term ‘‘Trust Fund’’ 12
177177 means the Tule River Indian Tribe Settlement Trust 13
178178 Fund established under section 6(a). 14

183183 Association’’ means the association formed by 17

202202 water supply, including but not limited to water 6
203203 treatment, storage, and distribution infrastructure, 7
204204 to be constructed, in whole or in part, using monies 8
205205 from the Trust Fund. 9

207207 EFINITIONS OFOTHERTERMS.—Any other 10
208208 term used in this Act but not defined in subsection (a)— 11
209209 (1) has the meaning given the term in the 2007 12
210210 Agreement; or 13
211211 (2) if no definition for the term is provided in 14
212212 the 2007 Agreement, shall be used in a manner con-15
213213 sistent with its use in the 2007 Agreement. 16
214214 SEC. 4. RATIFICATION OF 2007 AGREEMENT. 17

219219 Act and to the extent that the 2007 Agreement does 20
220220 not conflict with this Act, the 2007 Agreement is au-21

238238 UBSTITUTE SITES.—If a sub-7
239239 stitute site for the Phase I Reservoir is 8
240240 identified by the Tribe pursuant to section 9
241241 3.4.B.(2)(a) of the 2007 Agreement, then 10
242242 amendments related to the Operation 11
243243 Rules are authorized, ratified, and con-12
244244 firmed, to the extent that such Amend-13
245245 ments are consistent with the 2007 Agree-14
246246 ment and this Act. 15

248248 RIORITY DATE.—Amendments 16
249249 agreed to by the Parties to establish that 17
250250 the priority date for the Tribal Water 18
251251 Right is no later than January 9, 1873, is 19
252252 authorized, ratified, and confirmed. 20

254254 ENIOR WATER RIGHTS .— 21
255255 Amendments agreed to by the Parties to 22
256256 accommodate senior water rights of those 23
257257 Downstream Water Users described in sec-24

269269 amendments agreed to by the Parties to 7
270270 facilitate implementation and approval of 8
271271 the 2007 Agreement are authorized, rati-9
272272 fied, and confirmed, to the extent that 10
273273 such amendments are otherwise consistent 11
274274 with this Act and with other applicable 12
275275 law. 13

277277 XECUTION.— 14
278278 (1) I
279279 N GENERAL.—To the extent the 2007 15
280280 Agreement does not conflict with this Act, the Sec-16
281281 retary shall execute the 2007 Agreement, in accord-17
282282 ance with paragraph (2), including all exhibits to, or 18
283283 parts of, the 2007 Agreement requiring the signa-19
284284 ture of the Secretary. 20
285285 (2) T
286286 IMING.—The Secretary shall not execute 21
287287 the 2007 Agreement until— 22
288288 (A) the Parties agree on amendments re-23
289289 lated to the priority date for the Tribal Water 24
290290 Right; and 25

295295 (i) the Tribe moves forward with the 2
296296 Phase I Reservoir described in section 3
297297 3.4.B.(1) of the 2007 Agreement; or 4
298298 (ii) if the Tribe selects a substitute 5
299299 site pursuant to section 3.4.B.(2) of the 6
300300 2007 Agreement, either— 7
301301 (I) the Parties agree on Oper-8
302302 ation Rules; or 9
303303 (II) the Secretary determines, in 10
304304 the discretion of the Secretary, that 11
305305 the Parties have reached an impasse 12
306306 in attempting to negotiate the Oper-13
307307 ation Rules. 14

309309 ODIFICATIONS.—Nothing in this Act pro-15
310310 hibits the Secretary, after execution of the 2007 16
311311 Agreement, from approving any modification to the 17
312312 2007 Agreement, including any exhibit to the 2007 18
313313 Agreement, that is consistent with this Act, to the 19
314314 extent that the modification does not otherwise re-20
315315 quire congressional approval under section 2116 of 21
316316 the Revised Statutes (25 U.S.C. 177) or any other 22
317317 applicable provision of Federal law. 23

319319 NVIRONMENTAL COMPLIANCE.— 24

324324 Agreement and this Act, the Secretary shall comply 2
325325 with all applicable provisions of— 3
326326 (A) the Endangered Species Act of 1973 4
327327 (16 U.S.C. 1531 et seq.); 5
328328 (B) the National Environmental Policy Act 6
329329 of 1969 (42 U.S.C. 4321 et seq.), including the 7
330330 implementing regulations of that Act; and 8
331331 (C) other applicable Federal environmental 9
332332 laws and regulations. 10

334334 OMPLIANCE.— 11
335335 (A) I
336336 N GENERAL.—In implementing the 12
337337 2007 Agreement and this Act, the Tribe shall 13
338338 prepare any necessary environmental docu-14
339339 ments, consistent with all applicable provisions 15
340340 of— 16
341341 (i) the Endangered Species Act of 17
342342 1973 (16 U.S.C. 1531 et seq.); 18
343343 (ii) the National Environmental Policy 19
344344 Act of 1969 (42 U.S.C. 4321 et seq.), in-20
345345 cluding the implementing regulations of 21
346346 that Act; and 22
347347 (iii) all other applicable Federal envi-23
348348 ronmental laws and regulations. 24

352352 (B) AUTHORIZATIONS.—The Secretary 1
353353 shall— 2
354354 (i) independently evaluate the docu-3
355355 mentation submitted under subparagraph 4
356356 (A); and 5
357357 (ii) be responsible for the accuracy, 6
358358 scope, and contents of that documentation. 7
359359 (3) E
360360 FFECT OF EXECUTION .—The execution of 8
361361 the 2007 Agreement by the Secretary under this sec-9
362362 tion shall not constitute a major Federal action for 10
363363 purposes of the National Environmental Policy Act 11
364364 of 1969 (42 U.S.C. 4321 et seq.). 12
365365 (4) C
366366 OSTS.—Any costs associated with the per-13
367367 formance of the compliance activities under this sub-14
368368 section shall be paid from funds deposited in the 15
369369 Trust Fund, subject to the condition that any costs 16
370370 associated with the performance of Federal approval 17
371371 or other review of such compliance work or costs as-18
372372 sociated with inherently Federal functions shall re-19
373373 main the responsibility of the Secretary. 20
374374 SEC. 5. TRIBAL WATER RIGHT. 21

376376 ONFIRMATION OFTRIBALWATERRIGHT.— 22

378378 N GENERAL.—The Tribal Water Right is 23
379379 ratified, confirmed, and declared valid. 24

383383 (2) QUANTIFICATION.—The Tribal Water Right 1
384384 includes the right to divert and use or permit the di-2
385385 version and use of up to 5,828 acre-feet per year of 3
386386 surface water from the South Fork Tule River, as 4
387387 described in the 2007 Agreement and as confirmed 5
388388 in the decree entered by the Court pursuant to sub-6
389389 sections (b) and (c) of section 12. 7
390390 (3) U
391391 SE.—Any diversion, use, and place of use 8
392392 of the Tribal Water Right shall be subject to the 9
393393 terms and conditions of the 2007 Agreement and 10
394394 this Act. 11
395395 (b) T
396396 RUSTSTATUS OFTRIBALWATERRIGHT.—The 12
397397 Tribal Water Right— 13
398398 (1) shall be held in trust by the United States 14
399399 for the use and benefit of the Tribe in accordance 15
400400 with this Act; and 16
401401 (2) shall not be subject to loss through non-use, 17
402402 forfeiture, abandonment, or other operation of law. 18

404404 UTHORITY OF THETULERIVERTRIBE.— 19
405405 (1) I
406406 N GENERAL.—The Tule River Tribe shall 20
407407 have the authority to allocate and distribute the 21
408408 Tribal Water Right for use on the Reservation in ac-22
409409 cordance with the 2007 Agreement, this Act, and 23
410410 applicable Federal law. 24

412412 DMINISTRATION.— 25

416416 (1) NO ALIENATION.—The Tribe shall not per-1
417417 manently alienate any portion of the Tribal Water 2
418418 Right. 3

420420 URCHASES OR GRANTS OF LAND FROM IN -4
421421 DIANS.—An authorization provided by this Act for 5
422422 the allocation, distribution, leasing, or other ar-6
423423 rangement entered into pursuant to this Act shall be 7
424424 considered to satisfy any requirement for authoriza-8
425425 tion of the action by treaty or convention imposed by 9
426426 section 2116 of the Revised Statutes (25 U.S.C. 10
427427 177). 11

429429 ROHIBITION ON FORFEITURE .—The non- 12
430430 use of all or any portion of the Tribal Water Right 13
431431 by any water user shall not result in the forfeiture, 14
432432 abandonment, relinquishment, or other loss of all or 15
433433 any portion of the Tribal Water Right. 16
434434 SEC. 6. TULE RIVER TRIBE TRUST ACCOUNTS. 17
435435 (a) E
436436 STABLISHMENT.—The Secretary shall establish 18
437437 a trust fund, to be known as the ‘‘Tule River Indian Tribe 19
438438 Settlement Trust Fund’’, to be managed, invested, and 20
439439 distributed by the Secretary and to remain available until 21
440440 expended, withdrawn, or reverted to the general fund of 22
441441 the Treasury, consisting of the amounts deposited in the 23
442442 Trust Fund under subsection (c), together with any inter-24

449449 CCOUNTS.—The Secretary shall establish in the 3
450450 Trust Fund the following Accounts: 4
451451 (1) The Tule River Tribe Water Development 5
452452 Projects Account. 6
453453 (2) The Tule River Tribe OM&R Account. 7
454454 (c) D
455455 EPOSITS.—The Secretary shall deposit— 8
456456 (1) in the Tule River Tribe Water Development 9
457457 Projects Account established under subsection 10
458458 (b)(1), the amounts made available pursuant to sec-11
459459 tion 7(a)(1); and 12
460460 (2) in the Tule River Tribe OM&R Account es-13
461461 tablished under subsection (b)(2), the amounts made 14
462462 available pursuant to section 7(a)(2). 15

464464 ANAGEMENT AND INTEREST.— 16
465465 (1) M
466466 ANAGEMENT.—On receipt and deposit of 17
467467 funds into the accounts in the Trust Fund pursuant 18
468468 to subsection (c), the Secretary shall manage, invest, 19
469469 and distribute all amounts in the Trust Fund in ac-20
470470 cordance with the investment authority of the Sec-21
471471 retary under— 22
472472 (A) the first section of the Act of June 24, 23
473473 1938 (52 Stat. 1037, chapter 648; 25 U.S.C. 24
474474 162a); 25

593593 chapter II of chapter 5, and chapter 7, of title 5, United 19

12781278 and shall be removed not later than 90 days after 19
