26	26	SECTION 1. SHORT TITLE. 3
27	27	This Act may be cited as the ‘‘American Victims of 4
28	28	Terrorism Compensation Act’’. 5

36	36	NGENERAL.—Section 404 of the Justice for 4
37	37	United States Victims of State Sponsored Terrorism Act 5
38	38	(34 U.S.C. 20144) is amended— 6
39	39	(1) in subsection (d)(4), by adding at the end 7
40	40	the following: 8

42	42	IFTH-ROUND PAYMENTS .—All fifth- 9
43	43	round payments required to be authorized by 10
44	44	the Special Master on or before January 1, 11
45	45	2025, shall be distributed to eligible claimants 12

283	283	which amounts are to be deposited into the Fund pursuant 6
284	284	to the amendments made by subsection (a). 7
285	285	SEC. 3. TIMING OF DEPOSIT OF PENALTIES AND FINES 8

329	329	Fund if the state sponsor of terrorism 20
330	330	was so designated at the time of the 21
331	331	penalty or fine, at any time during the 22
332	332	course of any related legal pro-23
333	333	ceedings, or at the time of any related 24
334	334	conduct. 25

339	339	TION.—Nothing in this clause shall be 2
340	340	construed to limit any rights to court- 3
341	341	ordered restitution of any direct crime 4
342	342	victim of an offense in a matter or 5
343	343	proceeding from which amounts are to 6
344	344	be deposited into the Fund pursuant 7
345	345	to this subparagraph. Nothing in the 8
346	346	American Victims of Terrorism Com-9
347	347	pensation Act or an amendment made 10
348	348	by that Act that clarifies the scope of 11
349	349	forfeiture proceeds to be deposited 12
350	350	into the Fund shall be construed to 13
351	351	impact the scope or interpretation of 14
352	352	criminal or civil penalties or fines that 15
353	353	are required to be deposited into the 16
354	354	Fund under clauses (i) and (ii) of this 17
355	355	subparagraph, which scope is the sub-18
356	356	ject of pending litigation and shall be 19
357	357	addressed in such litigation or by fu-20
358	358	ture legislation as warranted, includ-21
359	359	ing as informed by the report by the 22
360	360	Comptroller General of the United 23
361	361	States regarding proceeds available 24

368	368	IMING.—An agency of the 3
369	369	United States shall deposit or transfer into 4
370	370	the Fund all funds, and the net proceeds 5
371	371	from the sale of property, forfeited or paid 6
372	372	to the United States described in this sub-7
373	373	paragraph not later than the later of— 8
374	374	‘‘(I) 60 days after the receipt of 9
375	375	such amount by the agency; or 10
376	376	‘‘(II) 30 days after the date of 11
377	377	enactment of this clause.’’. 12
378	378	SEC. 4. ANNUAL PAYMENTS. 13
379	379	Section 404(d)(4) of the Justice for United States 14
380	380	Victims of State Sponsored Terrorism Act (34 U.S.C. 15
381	381	20144(d)(4)) is amended by striking subparagraph (A) 16
382	382	and inserting the following: 17
383	383	‘‘(A) I
384	384	N GENERAL.—Except as provided in 18
385	385	subparagraphs (B), (C), and (D), on January 19
386	386	1, 2026, and January 1 of each calendar year 20
387	387	thereafter, the Special Master or the Attorney 21
388	388	General shall authorize additional payments on 22
389	389	a pro rata basis to those claimants with eligible 23
390	390	claims under subsection (c)(2) to include all 24
391	391	amounts received as of that date by any agency 25

400	400	uted pursuant to this subsection and is not re-6
401	401	quired for the payment of administrative costs 7
402	402	or compensation as set forth in subparagraphs 8
403	403	(B) and (C) of subsection (b)(1). All authorized 9
404	404	payments shall be distributed to the eligible 10
405	405	claimants as soon as practicable in the calendar 11
406	406	year of authorization, or, if the Special Master 12
407	407	or Attorney General authorizes payments prior 13
408	408	to January 1, not later than 1 year after the 14
409	409	date of such authorization.’’. 15
410	410	SEC. 5. REPORT OF FUND ACTIVITY. 16
411	411	Section 404(b)(1)(A) of the Justice for United States 17
412	412	Victims of State Sponsored Terrorism Act (34 U.S.C. 18
413	413	20144(b)(1)(A)) is amended by adding at the end the fol-19
