32 | 32 | | NGENERAL.—Except as provided in subsection 2 |
---|
33 | 33 | | (b), in this Act, the term ‘‘sanctuary jurisdiction’’ means 3 |
---|
34 | 34 | | any State or political subdivision of a State that has in 4 |
---|
35 | 35 | | effect a statute, ordinance, policy, or practice that pro-5 |
---|
36 | 36 | | hibits or restricts any government entity or official from— 6 |
---|
37 | 37 | | (1) sending, receiving, maintaining, or exchang-7 |
---|
38 | 38 | | ing with any Federal, State, or local government en-8 |
---|
39 | 39 | | tity information regarding the citizenship or immi-9 |
---|
40 | 40 | | gration status (lawful or unlawful) of any individual; 10 |
---|
41 | 41 | | or 11 |
---|
42 | 42 | | (2) complying with a request lawfully made by 12 |
---|
43 | 43 | | the Secretary of Homeland Security under section 13 |
---|
44 | 44 | | 236 or 287 of the Immigration and Nationality Act 14 |
---|
45 | 45 | | (8 U.S.C. 1226, 1357) to comply with a detainer 15 |
---|
46 | 46 | | for, or notify about the release of, an individual. 16 |

48 | 48 | | XCEPTION.—For purposes of this Act, a State 17 |
---|
49 | 49 | | or political subdivision of a State shall not be considered 18 |
---|
50 | 50 | | a sanctuary jurisdiction based solely on the State or polit-19 |
---|
51 | 51 | | ical subdivision of a State having a policy under which 20 |
---|
52 | 52 | | officials of the State or political subdivision of a State will 21 |
---|
53 | 53 | | not share information with respect to, or comply with a 22 |
---|
54 | 54 | | request made by the Secretary of Homeland Security 23 |
---|
55 | 55 | | under section 236 or 287 of the Immigration and Nation-24 |
---|
56 | 56 | | ality Act (8 U.S.C. 1226, 1357) to comply with a detainer 25 |
---|

64 | 64 | | Beginning on the date that is the earlier of the date 5 |
---|
65 | 65 | | that is 60 days after the date of the enactment of this 6 |
---|
66 | 66 | | Act or the first day of the fiscal year that begins after 7 |
---|
67 | 67 | | the date of the enactment of this Act, a sanctuary jurisdic-8 |
---|
68 | 68 | | tion is ineligible to receive any Federal funds that the 9 |
---|
69 | 69 | | sanctuary jurisdiction intends to use for the benefit (in-10 |
---|
70 | 70 | | cluding the provision of food, shelter, healthcare services, 11 |
---|
71 | 71 | | legal services, and transportation) of aliens who are 12 |
---|
72 | 72 | | present in the United States without lawful status under 13 |
---|
73 | 73 | | the immigration laws (as defined in section 101 of the Im-14 |
---|
74 | 74 | | migration and Nationality Act (8 U.S.C. 1101)). 15 |
---|
75 | 75 | | SEC. 4. REPORT ON NONCOMPLIANCE. 16 |
---|
76 | 76 | | Not later than 1 year after the date of the enactment 17 |
---|
77 | 77 | | of this Act, and annually thereafter, the Secretary of 18 |
---|
78 | 78 | | Homeland Security shall submit to the Committee on the 19 |
---|
79 | 79 | | Judiciary of the Senate and the Committee on the Judici-20 |
---|
80 | 80 | | ary of the House of Representatives a report that identi-21 |
---|
81 | 81 | | fies each State and political subdivision of a State that 22 |
---|
82 | 82 | | has, within the preceding 1-year period, failed to comply 23 |
---|
83 | 83 | | with a request described in section 2(a)(2). 24 |
