3030 SEC. 2. DEFINITION OF SANCTUARY JURISDICTION. 1
3131 (a) I
3232 NGENERAL.—Except as provided in subsection 2
3333 (b), in this Act, the term ‘‘sanctuary jurisdiction’’ means 3
3434 any State or political subdivision of a State that has in 4
3535 effect a statute, ordinance, policy, or practice that pro-5
3636 hibits or restricts any government entity or official from— 6
3737 (1) sending, receiving, maintaining, or exchang-7
3838 ing with any Federal, State, or local government en-8
3939 tity information regarding the citizenship or immi-9
4040 gration status (lawful or unlawful) of any individual; 10
4141 or 11
4242 (2) complying with a request lawfully made by 12
4343 the Secretary of Homeland Security under section 13
4444 236 or 287 of the Immigration and Nationality Act 14
4545 (8 U.S.C. 1226, 1357) to comply with a detainer 15
4646 for, or notify about the release of, an individual. 16

4848 XCEPTION.—For purposes of this Act, a State 17
4949 or political subdivision of a State shall not be considered 18
5050 a sanctuary jurisdiction based solely on the State or polit-19
5151 ical subdivision of a State having a policy under which 20
5252 officials of the State or political subdivision of a State will 21
5353 not share information with respect to, or comply with a 22
5454 request made by the Secretary of Homeland Security 23
5555 under section 236 or 287 of the Immigration and Nation-24
5656 ality Act (8 U.S.C. 1226, 1357) to comply with a detainer 25

6262 SEC. 3. SANCTUARY JURISDICTIONS INELIGIBLE FOR CER-3
6363 TAIN FEDERAL FUNDS. 4
6464 Beginning on the date that is the earlier of the date 5
6565 that is 60 days after the date of the enactment of this 6
6666 Act or the first day of the fiscal year that begins after 7
6767 the date of the enactment of this Act, a sanctuary jurisdic-8
6868 tion is ineligible to receive any Federal funds that the 9
6969 sanctuary jurisdiction intends to use for the benefit (in-10
7070 cluding the provision of food, shelter, healthcare services, 11
7171 legal services, and transportation) of aliens who are 12
7272 present in the United States without lawful status under 13
7373 the immigration laws (as defined in section 101 of the Im-14
7474 migration and Nationality Act (8 U.S.C. 1101)). 15
7575 SEC. 4. REPORT ON NONCOMPLIANCE. 16
7676 Not later than 1 year after the date of the enactment 17
7777 of this Act, and annually thereafter, the Secretary of 18
7878 Homeland Security shall submit to the Committee on the 19
7979 Judiciary of the Senate and the Committee on the Judici-20
8080 ary of the House of Representatives a report that identi-21
8181 fies each State and political subdivision of a State that 22
8282 has, within the preceding 1-year period, failed to comply 23
8383 with a request described in section 2(a)(2). 24
