6868 owed by the lessee to a lender or other mortgagee. 6

7171 gage package’’ means a proposed residential lease-8
7272 hold mortgage, business leasehold mortgage, land 9
7373 mortgage, or right-of-way document submitted to an 10
7474 applicable Bureau office under section 3(a)(1). 11

102102 N GENERAL.—As soon as practicable after 8
103103 receiving a proposed residential leasehold mortgage, 9
104104 business leasehold mortgage, land mortgage, or 10
105105 right-of-way document, the applicable Bureau office 11
106106 shall notify the lender that the proposed residential 12
107107 leasehold mortgage, business leasehold mortgage, or 13
108108 right-of-way document has been received. 14

110110 RELIMINARY REVIEW.— 15

112112 N GENERAL.—Not later than 10 cal-16
113113 endar days after receipt of a proposed residen-17
114114 tial leasehold mortgage, business leasehold 18
115115 mortgage, land mortgage, or right-of-way docu-19
116116 ment, the applicable Bureau office shall conduct 20
117117 and complete a preliminary review of the resi-21
118118 dential leasehold mortgage, business leasehold 22
119119 mortgage, land mortgage, or right-of-way docu-23
120120 ment to verify that all required documents are 24
121121 included. 25

167167 (i) shall be in writing; and 10
168168 (ii) in the case of a determination to 11
169169 disapprove a residential leasehold mort-12
170170 gage, business leasehold mortgage, right- 13
171171 of-way document, or land mortgage shall, 14
172172 state the basis for the determination. 15

174174 PPLICATION.—This paragraph shall 16
175175 not apply to a residential leasehold mortgage or 17
176176 business leasehold mortgage with respect to In-18
177177 dian land in cases in which the applicant for 19
178178 the residential leasehold mortgage or business 20
179179 leasehold mortgage is an Indian tribe (as de-21
180180 fined in subsection (d) of the first section of the 22
181181 Act of 1955 (69 Stat. 539, chapter 615; 126 23
182182 Stat. 1150; 25 U.S.C. 415(d))) that has been 24

261261 paragraph (4) of that subsection) by the applicable 10
262262 deadline described in that subsection, immediately 11
263263 after missing the deadline, the applicable Bureau of-12
264264 fice shall provide notice of the delay in review and 13
265265 processing to— 14
266266 (A) the party that submitted the mortgage 15
267267 package or requested the first certified title sta-16
268268 tus report; and 17
269269 (B) the lender for which the mortgage 18
270270 package (including any corresponding first cer-19
271271 tified title status report or subsequent certified 20
272272 title status report) is being requested. 21

274274 EQUESTS FOR UPDATES .—In addition to 22
275275 providing the notices required under paragraph (1), 23
276276 not later than 2 calendar days after receiving a rel-24
277277 evant inquiry with respect to a submitted mortgage 25

288288 tus report, the applicable Bureau office shall re-8
289289 spond to the inquiry. 9

293293 other provision of law, any first certified title status report 12
294294 and any subsequent certified title status report, as appli-13
295295 cable, shall be delivered directly to— 14
296296 (1) the lender; 15
297297 (2) any local or regional agency office of the 16
298298 Bureau that requests the first certified title status 17
299299 report or subsequent certified title status report; 18
300300 (3) in the case of a proposed residential lease-19
301301 hold mortgage or land mortgage, the relevant Fed-20
302302 eral agency that insures or guarantees the loan; and 21
303303 (4) if requested, any individual or entity de-22
304304 scribed in section 150.303 of title 25, Code of Fed-23
305305 eral Regulations (as in effect on the date of enact-24
306306 ment of this Act). 25

314314 cies and Indian Tribes shall have read-only access to por-4
315315 tals containing the relevant land documents from the 5
316316 Trust Asset and Accounting Management System (com-6
317317 monly known as ‘‘TAAMS’’) maintained by the Bureau. 7

321321 N GENERAL.—Not later than March 1 of 9
322322 each calendar year, the Director shall submit to the 10
323323 Committee on Indian Affairs of the Senate and the 11
324324 Committee on Natural Resources of the House of 12
325325 Representatives a report describing— 13
326326 (A) for the most recent calendar year, the 14
327327 number of requests received to complete resi-15
328328 dential leasehold mortgage packages, business 16
329329 leasehold mortgage packages, land mortgage 17
330330 packages, and right-of-way document packages 18
331331 (including any requests for corresponding first 19
332332 certified title status reports and subsequent cer-20
333333 tified title status reports), including a detailed 21
334334 description of— 22
335335 (i) requests that were and were not 23
336336 successfully completed by the applicable 24

352352 maintain the confidentiality of personally identifiable 12
353353 information of the parties involved in requesting the 13
354354 completion of residential leasehold mortgage pack-14
355355 ages, business leasehold mortgage packages, land 15
356356 mortgage packages, and right-of-way document 16
357357 packages (including any corresponding first certified 17
358358 title status reports and subsequent certified title sta-18
359359 tus reports). 19

361361 TUDY.—Not later than 1 year after the 20
362362 date of enactment of this Act, the Comptroller General 21
363363 of the United States shall submit to the Committee on 22
364364 Indian Affairs of the Senate and the Committee on Nat-23
365365 ural Resources of the House of Representatives a report 24
366366 that includes— 25

374374 Tribe to be digitized for the purpose of streamlining 5
375375 and expediting the completion of mortgage packages 6
376376 for residential mortgages on Indian land (including 7
377377 the corresponding first certified title status reports 8
378378 and subsequent certified title status reports); and 9
379379 (2) an estimate of the time and total cost nec-10
380380 essary for Indian Tribes to digitize the records de-11
381381 scribed in paragraph (1), in conjunction with assist-12
382382 ance in that digitization from the Bureau. 13
383383 SEC. 4. ESTABLISHMENT OF REALTY OMBUDSMAN POSI-14
384384 TION. 15
385385 (a) I
386386 NGENERAL.—The Director shall establish with-16
387387 in the Division of Real Estate Services of the Bureau the 17
388388 position of Realty Ombudsman, who shall report directly 18
389389 to the Secretary of the Interior. 19
390390 (b) F
391391 UNCTIONS.—The Realty Ombudsman shall— 20
392392 (1) ensure that the applicable Bureau offices 21
393393 are meeting the mortgage review and processing 22
394394 deadlines established by section 3(a); 23

401401 (3) serve as a liaison to other Federal agencies, 4
402402 including by— 5
403403 (A) ensuring the Bureau is responsive to 6
404404 all of the inquiries from the relevant Federal 7
405405 agencies; and 8
406406 (B) helping to facilitate communications 9
407407 between the relevant Federal agencies and the 10
408408 Bureau on matters relating to mortgages on In-11
409409 dian land; 12
410410 (4) receive inquiries, questions, and complaints 13
411411 directly from Indian Tribes, members of Indian 14
412412 Tribes, and lenders in regard to executed residential 15
413413 leasehold mortgages, business leasehold mortgages, 16
414414 land mortgages, or right-of-way documents; and 17
415415 (5) serve as the intermediary between the In-18
416416 dian Tribes, members of Indian Tribes, and lenders 19
417417 and the Bureau in responding to inquiries and ques-20
418418 tions and resolving complaints. 21
