3838 NGENERAL.—Section 1902(kk) of the Social Se-4
3939 curity Act (42 U.S.C. 1396a(kk)) is amended by adding 5
4040 at the end the following new paragraph: 6
4141 ‘‘(10) S
4242 TREAMLINED ENROLLMENT PROCESS 7
4343 FOR ELIGIBLE OUT-OF-STATE PROVIDERS.— 8
4444 ‘‘(A) I
4545 N GENERAL.—The State— 9
4646 ‘‘(i) adopts and implements a process 10
4747 to allow an eligible out-of-State provider to 11
4848 enroll under the State plan (or a waiver of 12
4949 such plan) to furnish items and services to, 13
5050 or order, prescribe, refer, or certify eligi-14
5151 bility for items and services for, qualifying 15
5252 individuals without the imposition of 16
5353 screening or enrollment requirements by 17
5454 such State that exceed the minimum nec-18
5555 essary for such State to provide payment 19
5656 to the eligible out-of-State provider under 20
5757 the State plan (or a waiver of such plan), 21
5858 such as the provider’s name and National 22
5959 Provider Identifier (and such other infor-23
6060 mation specified by the Secretary); and 24
6161 ‘‘(ii) provides that an eligible out-of- 25
6262 State provider that enrolls as a partici-26

7272 EFINITIONS.—In this paragraph: 6

7474 LIGIBLE OUT-OF-STATE PRO-7
7575 VIDER.—The term ‘eligible out-of-State 8
7676 provider’ means, with respect to a State, a 9
7777 provider— 10
7878 ‘‘(I) that is located in any other 11
7979 State; 12
8080 ‘‘(II) that— 13
8181 ‘‘(aa) was determined by the 14
8282 Secretary to have a limited risk 15
8383 of fraud, waste, and abuse for 16
8484 purposes of determining the level 17
8585 of screening to be conducted 18
8686 under section 1866(j)(2), has 19
8787 been so screened under such sec-20
8888 tion 1866(j)(2), and is enrolled in 21
8989 the Medicare program under title 22
9090 XVIII; or 23
9191 ‘‘(bb) was determined by the 24
9292 State agency administering or su-25

109109 ‘‘(aa) excluded from partici-14
110110 pation in any Federal health care 15
111111 program pursuant to section 16
112112 1128 or 1128A; 17
113113 ‘‘(bb) excluded from partici-18
114114 pation in the State plan (or a 19
115115 waiver of such plan) pursuant to 20
116116 part 1002 of title 42, Code of 21
117117 Federal Regulations (or any suc-22
118118 cessor regulation), or State law; 23
