26	26	Be it enacted by the Senate and House of Representa-1
27	27	tives of the United States of America in Congress assembled, 2
28	28	SECTION 1. SHORT TITLE. 3
29	29	This Act may be cited as the ‘‘Accelerating Kids’ Ac-4
30	30	cess to Care Act’’. 5

34	34	SEC. 2. STREAMLINED ENROLLMENT PROCESS FOR ELIGI-1
35	35	BLE OUT-OF-STATE PROVIDERS UNDER MED-2
36	36	ICAID AND CHIP. 3
37	37	(a) I
38	38	NGENERAL.—Section 1902(kk) of the Social Se-4
39	39	curity Act (42 U.S.C. 1396a(kk)) is amended by adding 5
40	40	at the end the following new paragraph: 6
41	41	‘‘(10) S
42	42	TREAMLINED ENROLLMENT PROCESS 7
43	43	FOR ELIGIBLE OUT-OF-STATE PROVIDERS.— 8
44	44	‘‘(A) I
45	45	N GENERAL.—The State— 9
46	46	‘‘(i) adopts and implements a process 10
47	47	to allow an eligible out-of-State provider to 11
48	48	enroll under the State plan (or a waiver of 12
49	49	such plan) to furnish items and services to, 13
50	50	or order, prescribe, refer, or certify eligi-14
51	51	bility for items and services for, qualifying 15
52	52	individuals without the imposition of 16
53	53	screening or enrollment requirements by 17
54	54	such State that exceed the minimum nec-18
55	55	essary for such State to provide payment 19
56	56	to the eligible out-of-State provider under 20
57	57	the State plan (or a waiver of such plan), 21
58	58	such as the provider’s name and National 22
59	59	Provider Identifier (and such other infor-23
60	60	mation specified by the Secretary); and 24
61	61	‘‘(ii) provides that an eligible out-of- 25
62	62	State provider that enrolls as a partici-26

67	67	waiver of such plan) through such process 2
68	68	shall be so enrolled for a 5-year period, un-3
69	69	less the provider is terminated or excluded 4
70	70	from participation during such period. 5
71	71	‘‘(B) D
72	72	EFINITIONS.—In this paragraph: 6
73	73	‘‘(i) E
74	74	LIGIBLE OUT-OF-STATE PRO-7
75	75	VIDER.—The term ‘eligible out-of-State 8
76	76	provider’ means, with respect to a State, a 9
77	77	provider— 10
78	78	‘‘(I) that is located in any other 11
79	79	State; 12
80	80	‘‘(II) that— 13
81	81	‘‘(aa) was determined by the 14
82	82	Secretary to have a limited risk 15
83	83	of fraud, waste, and abuse for 16
84	84	purposes of determining the level 17
85	85	of screening to be conducted 18
86	86	under section 1866(j)(2), has 19
87	87	been so screened under such sec-20
88	88	tion 1866(j)(2), and is enrolled in 21
89	89	the Medicare program under title 22
90	90	XVIII; or 23
91	91	‘‘(bb) was determined by the 24
92	92	State agency administering or su-25

97	97	the State plan (or a waiver of 2
98	98	such plan) of such other State to 3
99	99	have a limited risk of fraud, 4
100	100	waste, and abuse for purposes of 5
101	101	determining the level of screening 6
102	102	to be conducted under paragraph 7
103	103	(1) of this subsection, has been 8
104	104	so screened under such para-9
105	105	graph (1), and is enrolled under 10
106	106	such State plan (or a waiver of 11
107	107	such plan); and 12
108	108	‘‘(III) that has not been— 13
109	109	‘‘(aa) excluded from partici-14
110	110	pation in any Federal health care 15
111	111	program pursuant to section 16
112	112	1128 or 1128A; 17
113	113	‘‘(bb) excluded from partici-18
114	114	pation in the State plan (or a 19
115	115	waiver of such plan) pursuant to 20
116	116	part 1002 of title 42, Code of 21
117	117	Federal Regulations (or any suc-22
118	118	cessor regulation), or State law; 23
119	119	or 24

130	130	UALIFYING INDIVIDUAL .—The 7
131	131	term ‘qualifying individual’ means an indi-8
132	132	vidual under 21 years of age who is en-9
133	133	rolled under the State plan (or waiver of 10
134	134	such plan). 11
135	135	‘‘(iii) S
136	136	TATE.—The term ‘State’ 12
137	137	means 1 of the 50 States or the District 13
138	138	of Columbia.’’. 14

140	140	ONFORMINGAMENDMENTS.— 15
141	141	(1) Section 1902(a)(77) of the Social Security 16
142	142	Act (42 U.S.C. 1396a(a)(77)) is amended by insert-17
143	143	ing ‘‘enrollment,’’ after ‘‘screening,’’. 18
144	144	(2) The subsection heading for section 19
145	145	1902(kk) of such Act (42 U.S.C. 1396a(kk)) is 20
146	146	amended by inserting ‘‘E
