14	14	To amend the Immigration and Nationality Act to deny
15	15	immigration benefits to aliens who carried out, partici-
16	16	pated in, planned, financed, supported, or otherwise fa-
17	17	cilitated the October 2023 attacks against Israel.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘No Immigration Bene-4
22	22	fits for Hamas Terrorists Act’’. 5

28	28	ERWISE FACILITATED ATTACKS AGAINST 3

33	33	SRAEL.—Section 212(a)(3) of the Immigration and Na-6
34	34	tionality Act (8 U.S.C. 1182(a)(3)) is amended— 7
35	35	(1) in subparagraph (B)(i), in the undesignated 8
36	36	matter following subclause (IX)— 9
37	37	(A) by inserting ‘‘senior member,’’ after 10
38	38	‘‘representative,’’; and 11
39	39	(B) by inserting ‘‘or an officer, official rep-12
40	40	resentative, member, or spokesman of Pales-13
41	41	tinian Islamic Jihad or Hamas’’ after ‘‘Pal-14
42	42	estine Liberation Organization’’; and 15
43	43	(2) by adding at the end the following: 16
44	44	‘‘(H) P
45	45	ARTICIPANTS IN HAMAS TERRORISM 17
46	46	AGAINST ISRAEL.—Any alien who carried out, 18
47	47	participated in, planned, financed, afforded ma-19
48	48	terial support to, or otherwise facilitated any of 20
49	49	the attacks against Israel initiated by Hamas 21
50	50	beginning on October 7, 2023, is inadmissible.’’. 22

52	52	NELIGIBILITY FORRELIEF.—Section 241(b)(3) 23
53	53	of the Immigration and Nationality Act (8 U.S.C. 24
54	54	1231(b)(3)) is amended by adding at the end the fol-25
55	55	lowing: 26

59	59	‘‘(D) INELIGIBILITY FOR RELIEF .—Any 1
60	60	alien who carried out, participated in, planned, 2
61	61	financed, afforded material support to, or other-3
62	62	wise facilitated any of the attacks against Israel 4
63	63	initiated by Hamas beginning on October 7, 5
64	64	2023, shall be ineligible for any relief under the 6
65	65	immigration laws, including relief under this 7
66	66	section, section 208 of this Act, section 2242 of 8
67	67	the Foreign Relations Authorization Act, Fiscal 9
68	68	Years 1998 and 1999 (subdivision B of division 10
69	69	G of Public Law 105–277; 8 U.S.C. 1231 11
70	70	note), and any regulations issued pursuant to 12
71	71	such section 2242.’’. 13

73	73	ONFORMING AMENDMENT.—Section 14
74	74	237(a)(4)(B) of the Immigration and Nationality Act (8 15
75	75	U.S.C. 1227(a)(4)(B)) is amended by striking ‘‘subpara-16
76	76	graph (B) or (F)’’ and inserting ‘‘subparagraph (B), (F), 17
77	77	or (H)’’. 18

82	82	THEUNITEDSTATES.—Not later than one year after the 21
83	83	date of the enactment of this Act, and annually thereafter, 22
84	84	the Secretary of Homeland Security shall submit a report 23
85	85	to Congress that identifies the number of aliens who— 24

90	90	section 212(a)(3)(H) of the Immigration and Na-2
91	91	tionality Act, as added by subsection (a)(2); and 3
92	92	(2) are described in such section 212(a)(3)(H) 4
93	93	and have been found to be removable pursuant to 5
94	94	section 237(a)(4)(B) of the Immigration and Na-6
95	95	tionality Act, as amended by subsection (c). 7
