16	16	To amend section 324 of the Robert T. Stafford Disaster
17	17	Relief and Emergency Assistance Act to incentivize
18	18	States, Indian Tribes, and Territories to close disaster
19	19	recovery projects by authorizing the use of excess funds
20	20	for management costs for other disaster recovery
21	21	projects.
22	22	Be it enacted by the Senate and House of Representa-1
23	23	tives of the United States of America in Congress assembled, 2
24	24	SECTION 1. SHORT TITLE. 3
25	25	This Act may be cited as the ‘‘Disaster Management 4
26	26	Costs Modernization Act’’. 5

30	30	SEC. 2. USE OF EXCESS FUNDS FOR MANAGEMENT COSTS. 1
31	31	(a) I
32	32	NGENERAL.—Section 324 of the Robert T. 2
33	33	Stafford Disaster Relief and Emergency Assistance Act 3
34	34	(42 U.S.C. 5165b) is amended— 4
35	35	(1) in subsection (b)(2)— 5
36	36	(A) by redesignating subparagraphs (A) 6
37	37	and (B) as clauses (i) and (ii), respectively, and 7
38	38	adjusting the margins accordingly; and 8
39	39	(B) in the matter preceding clause (i), as 9
40	40	so redesignated, by striking ‘‘provide the fol-10
41	41	lowing percentage rates’’ and inserting ‘‘pro-11
42	42	vide— 12
43	43	‘‘(A) excess funds for management costs as 13
44	44	described in subsection (c); and 14
45	45	‘‘(B) the following percentage rates’’; 15
46	46	(2) by redesignating subsection (c) as sub-16
47	47	section (d); and 17
48	48	(3) by inserting after subsection (b) the fol-18
49	49	lowing: 19

55	55	EFINITION.—In this subsection, the term 22
56	56	‘excess funds for management costs’ means the dif-23
57	57	ference between— 24

61	61	‘‘(A) the amount of the applicable specific 1
62	62	management costs authorized under subsection 2
63	63	(b)(1) and subsection (b)(2)(B); and 3
64	64	‘‘(B) as of the date on which the grant 4
65	65	award is closed, the amount of funding for 5
66	66	management costs activities expended by the 6
67	67	grantee or subgrantee receiving the financial as-7
68	68	sistance for costs described in subparagraph 8
69	69	(A). 9
70	70	‘‘(2) A
71	71	VAILABILITY OF EXCESS FUNDS FOR 10
72	72	MANAGEMENT COSTS .—The President may make 11
73	73	available to a grantee or subgrantee receiving finan-12
74	74	cial assistance under section 403, 404, 406, 407, or 13
75	75	502 any excess funds for management costs. 14
76	76	‘‘(3) U
77	77	SE OF FUNDS.—Excess funds for man-15
78	78	agement costs made available to a grantee or sub-16
79	79	grantee under paragraph (2) may be used for— 17
80	80	‘‘(A) activities associated with building ca-18
81	81	pacity to prepare for, recover from, or mitigate 19
82	82	the impacts of a major disaster or emergency 20
83	83	declared under section 401 or 501, respectively; 21
84	84	and 22
85	85	‘‘(B) management costs associated with 23
86	86	any— 24
87	87	‘‘(i) major disaster; 25

92	92	‘‘(iii) disaster preparedness measure; 2

94	94	‘‘(iv) mitigation activity or measure 4
95	95	authorized under section 203, 204, 205, or 5
96	96	404. 6
97	97	‘‘(4) A
98	98	VAILABILITY.—Excess funds for manage-7
99	99	ment costs made available to a grantee or sub-8
100	100	grantee under paragraph (2) shall remain available 9
101	101	to the grantee or subgrantee until the date that is 10
102	102	5 years after the date on which the excess funds for 11
103	103	management costs are made available under para-12
104	104	graph (2).’’. 13
105	105	(b) A
106	106	PPLICABILITY.—The amendments made by sub-14
107	107	section (a) shall apply with respect to any grant award 15
108	108	in relation to a major disaster or emergency declared 16
109	109	under section 401 or 501, respectively, of the Robert T. 17
110	110	Stafford Disaster Relief and Emergency Assistance Act 18
111	111	(42 U.S.C. 5170, 5191)— 19
112	112	(1) the declaration of which is made on or after 20
113	113	the date of enactment of this Act; and 21
114	114	(2) that is funded with amounts appropriated 22
115	115	on or after the date of enactment of this Act. 23

117	117	TUDY.—Not later than 180 days after the 24
118	118	date of enactment of this Act, the Comptroller General 25

123	123	Homeland Security and Governmental Affairs of the Sen-2
124	124	ate and the Committee on Transportation and Infrastruc-3
125	125	ture of the House of Representatives a report— 4
126	126	(1) on the actual management costs described 5
127	127	in section 324 of the Robert T. Stafford Disaster 6
128	128	Relief and Emergency Assistance Act (42 U.S.C. 7
129	129	5165b) during the period of a major disaster dec-8
130	130	laration under section 401 of such Act (42 U.S.C. 9
131	131	5170) to determine whether the amount set aside for 10
132	132	those management costs after the date of enactment 11
133	133	of this Act is appropriate; and 12
134	134	(2) that includes— 13
135	135	(A) the management costs described in sec-14
136	136	tion 324 of the Robert T. Stafford Disaster Re-15
137	137	lief and Emergency Assistance Act (42 U.S.C. 16
138	138	5165b) for each major disaster declared under 17
139	139	section 401 of such Act (42 U.S.C. 5170) dur-18
140	140	ing the 5-year period preceding the date of the 19
141	141	report; 20
142	142	(B) the amount set aside for those man-21
143	143	agement costs; 22
144	144	(C) the use of those management costs; 23
145	145	(D) the length of each such major disaster; 24
146	146	and 25
