21	21	To regulate large capacity ammunition feeding devices.
22	22	Be it enacted by the Senate and House of Representa-1
23	23	tives of the United States of America in Congress assembled, 2
24	24	SECTION 1. SHORT TITLE. 3
25	25	This Act may be cited as the ‘‘Keep Americans Safe 4
26	26	Act’’. 5
27	27	SEC. 2. DEFINITIONS. 6
28	28	Section 921(a) of title 18, United States Code, is 7
29	29	amended by adding at the end the following: 8

33	33	‘‘(38) The term ‘large capacity ammunition feeding 1
34	34	device’— 2
35	35	‘‘(A) means a magazine, belt, drum, feed strip, 3
36	36	helical feeding device, or similar device, including 4
37	37	any such device joined or coupled with another in 5
38	38	any manner, that has an overall capacity of, or that 6
39	39	can be readily restored, changed, or converted to ac-7
40	40	cept, more than 10 rounds of ammunition; and 8
41	41	‘‘(B) does not include an attached tubular de-9
42	42	vice designed to accept, and capable of operating 10
43	43	only with, .22 caliber rimfire ammunition. 11
44	44	‘‘(39) The term ‘qualified law enforcement officer’ 12
45	45	has the meaning given the term in section 926B.’’. 13
46	46	SEC. 3. RESTRICTIONS ON LARGE CAPACITY AMMUNITION 14
47	47	FEEDING DEVICES. 15
48	48	(a) I
49	49	NGENERAL.—Section 922 of title 18, United 16
50	50	States Code, is amended by inserting after subsection (u) 17
51	51	the following: 18
52	52	‘‘(v)(1) It shall be unlawful for a person to import, 19
53	53	sell, manufacture, transfer, or possess, in or affecting 20
54	54	interstate or foreign commerce, a large capacity ammuni-21
55	55	tion feeding device. 22
56	56	‘‘(2) Paragraph (1) shall not apply to the possession 23
57	57	of any large capacity ammunition feeding device otherwise 24

61	61	lawfully possessed on or before the date of enactment of 1
62	62	the Keep Americans Safe Act. 2
63	63	‘‘(3) Paragraph (1) shall not apply to— 3
64	64	‘‘(A) the importation for, manufacture for, sale 4
65	65	to, transfer to, or possession by the United States 5
66	66	or a department or agency of the United States or 6
67	67	a State or a department, agency, or political subdivi-7
68	68	sion of a State, or a sale or transfer to or possession 8
69	69	by a qualified law enforcement officer employed by 9
70	70	the United States or a department or agency of the 10
71	71	United States or a State or a department, agency, 11
72	72	or political subdivision of a State for purposes of law 12
73	73	enforcement (whether on or off-duty), or a sale or 13
74	74	transfer to or possession by a campus law enforce-14
75	75	ment officer for purposes of law enforcement (wheth-15
76	76	er on or off-duty); 16
77	77	‘‘(B) the importation for, or sale or transfer to 17
78	78	a licensee under title I of the Atomic Energy Act of 18
79	79	1954 (42 U.S.C. 2011 et seq.) for purposes of estab-19
80	80	lishing and maintaining an on-site physical protec-20
81	81	tion system and security organization required by 21
82	82	Federal law, or possession by an employee or con-22
83	83	tractor of such licensee on-site for such purposes or 23
84	84	off-site for purposes of licensee-authorized training 24
85	85	or transportation of nuclear materials; 25

89	89	‘‘(C) the possession, by an individual who is re-1
90	90	tired in good standing from service with a law en-2
91	91	forcement agency and is not otherwise prohibited 3
92	92	from receiving ammunition, of a large capacity am-4
93	93	munition feeding device— 5
94	94	‘‘(i) sold or transferred to the individual by 6
95	95	the agency upon such retirement; or 7
96	96	‘‘(ii) that the individual purchased, or oth-8
97	97	erwise obtained, for official use before such re-9
98	98	tirement; or 10
99	99	‘‘(D) the importation, sale, manufacture, trans-11
100	100	fer, or possession of any large capacity ammunition 12
101	101	feeding device by a licensed manufacturer or licensed 13
102	102	importer for the purposes of testing or experimen-14
103	103	tation authorized by the Attorney General. 15
104	104	‘‘(4) For purposes of paragraph (3)(A), the term 16
105	105	‘campus law enforcement officer’ means an individual who 17
106	106	is— 18
107	107	‘‘(A) employed by a private institution of higher 19
108	108	education that is eligible for funding under title IV 20
109	109	of the Higher Education Act of 1965 (20 U.S.C. 21
110	110	1070 et seq.); 22
111	111	‘‘(B) responsible for the prevention or investiga-23
112	112	tion of crime involving injury to persons or property, 24

117	117	such crimes; 2
118	118	‘‘(C) authorized by Federal, State, or local law 3
119	119	to carry a firearm, execute search warrants, and 4
120	120	make arrests; and 5
121	121	‘‘(D) recognized, commissioned, or certified by 6
122	122	a government entity as a law enforcement officer.’’. 7

126	126	title 18, United States Code, is amended by adding at the 10
127	127	end the following: ‘‘A large capacity ammunition feeding 11
128	128	device manufactured after the date of enactment of the 12
129	129	Keep Americans Safe Act shall be identified by a serial 13
130	130	number and the date on which the device was manufac-14
131	131	tured or made, legibly and conspicuously engraved or cast 15
132	132	on the device, and such other identification as the Attor-16
133	133	ney General shall by regulations prescribe.’’. 17

177	177	Section 501(a)(1) of title I of the Omnibus Crime 4
178	178	Control and Safe Streets Act of 1968 (34 U.S.C. 5
179	179	10152(a)(1)) is amended by adding at the end the fol-6
180	180	lowing: 7
181	181	‘‘(J) Compensation for surrendered large 8
182	182	capacity ammunition feeding devices, as that 9
183	183	term is defined in section 921 of title 18, 10
184	184	United States Code, under buy-back programs 11
185	185	for large capacity ammunition feeding devices.’’. 12
186	186	SEC. 6. SEVERABILITY. 13
187	187	If any provision of this Act, an amendment made by 14
188	188	this Act, or the application of such provision or amend-15
189	189	ment to any person or circumstance is held to be unconsti-16
190	190	tutional, the remainder of this Act, the amendments made 17
191	191	by this Act, and the application of such provision or 18
192	192	amendment to any person or circumstance shall not be af-19
193	193	fected thereby. 20
