2424 SECTION 1. SHORT TITLE. 3
2525 This Act may be cited as the ‘‘Keep Americans Safe 4
2626 Act’’. 5
2727 SEC. 2. DEFINITIONS. 6
2828 Section 921(a) of title 18, United States Code, is 7
2929 amended by adding at the end the following: 8

3333 ‘‘(38) The term ‘large capacity ammunition feeding 1
3434 device’— 2
3535 ‘‘(A) means a magazine, belt, drum, feed strip, 3
3636 helical feeding device, or similar device, including 4
3737 any such device joined or coupled with another in 5
3838 any manner, that has an overall capacity of, or that 6
3939 can be readily restored, changed, or converted to ac-7
4040 cept, more than 10 rounds of ammunition; and 8
4141 ‘‘(B) does not include an attached tubular de-9
4242 vice designed to accept, and capable of operating 10
4343 only with, .22 caliber rimfire ammunition. 11
4444 ‘‘(39) The term ‘qualified law enforcement officer’ 12
4545 has the meaning given the term in section 926B.’’. 13
4646 SEC. 3. RESTRICTIONS ON LARGE CAPACITY AMMUNITION 14
4747 FEEDING DEVICES. 15
4848 (a) I
4949 NGENERAL.—Section 922 of title 18, United 16
5050 States Code, is amended by inserting after subsection (u) 17
5151 the following: 18
5252 ‘‘(v)(1) It shall be unlawful for a person to import, 19
5353 sell, manufacture, transfer, or possess, in or affecting 20
5454 interstate or foreign commerce, a large capacity ammuni-21
5555 tion feeding device. 22
5656 ‘‘(2) Paragraph (1) shall not apply to the possession 23
5757 of any large capacity ammunition feeding device otherwise 24

6161 lawfully possessed on or before the date of enactment of 1
6262 the Keep Americans Safe Act. 2
6363 ‘‘(3) Paragraph (1) shall not apply to— 3
6464 ‘‘(A) the importation for, manufacture for, sale 4
6565 to, transfer to, or possession by the United States 5
6666 or a department or agency of the United States or 6
6767 a State or a department, agency, or political subdivi-7
6868 sion of a State, or a sale or transfer to or possession 8
6969 by a qualified law enforcement officer employed by 9
7070 the United States or a department or agency of the 10
7171 United States or a State or a department, agency, 11
7272 or political subdivision of a State for purposes of law 12
7373 enforcement (whether on or off-duty), or a sale or 13
7474 transfer to or possession by a campus law enforce-14
7575 ment officer for purposes of law enforcement (wheth-15
7676 er on or off-duty); 16
7777 ‘‘(B) the importation for, or sale or transfer to 17
7878 a licensee under title I of the Atomic Energy Act of 18
7979 1954 (42 U.S.C. 2011 et seq.) for purposes of estab-19
8080 lishing and maintaining an on-site physical protec-20
8181 tion system and security organization required by 21
8282 Federal law, or possession by an employee or con-22
8383 tractor of such licensee on-site for such purposes or 23
8484 off-site for purposes of licensee-authorized training 24
8585 or transportation of nuclear materials; 25

8989 ‘‘(C) the possession, by an individual who is re-1
9090 tired in good standing from service with a law en-2
9191 forcement agency and is not otherwise prohibited 3
9292 from receiving ammunition, of a large capacity am-4
9393 munition feeding device— 5
9494 ‘‘(i) sold or transferred to the individual by 6
9595 the agency upon such retirement; or 7
9696 ‘‘(ii) that the individual purchased, or oth-8
9797 erwise obtained, for official use before such re-9
9898 tirement; or 10
9999 ‘‘(D) the importation, sale, manufacture, trans-11
100100 fer, or possession of any large capacity ammunition 12
101101 feeding device by a licensed manufacturer or licensed 13
102102 importer for the purposes of testing or experimen-14
103103 tation authorized by the Attorney General. 15
104104 ‘‘(4) For purposes of paragraph (3)(A), the term 16
105105 ‘campus law enforcement officer’ means an individual who 17
106106 is— 18
107107 ‘‘(A) employed by a private institution of higher 19
108108 education that is eligible for funding under title IV 20
109109 of the Higher Education Act of 1965 (20 U.S.C. 21
110110 1070 et seq.); 22
111111 ‘‘(B) responsible for the prevention or investiga-23
112112 tion of crime involving injury to persons or property, 24

118118 ‘‘(C) authorized by Federal, State, or local law 3
119119 to carry a firearm, execute search warrants, and 4
120120 make arrests; and 5
121121 ‘‘(D) recognized, commissioned, or certified by 6
122122 a government entity as a law enforcement officer.’’. 7

126126 title 18, United States Code, is amended by adding at the 10
127127 end the following: ‘‘A large capacity ammunition feeding 11
128128 device manufactured after the date of enactment of the 12
129129 Keep Americans Safe Act shall be identified by a serial 13
130130 number and the date on which the device was manufac-14
131131 tured or made, legibly and conspicuously engraved or cast 15
132132 on the device, and such other identification as the Attor-16
133133 ney General shall by regulations prescribe.’’. 17

178178 Control and Safe Streets Act of 1968 (34 U.S.C. 5
179179 10152(a)(1)) is amended by adding at the end the fol-6

181181 ‘‘(J) Compensation for surrendered large 8
182182 capacity ammunition feeding devices, as that 9
183183 term is defined in section 921 of title 18, 10
184184 United States Code, under buy-back programs 11
185185 for large capacity ammunition feeding devices.’’. 12
186186 SEC. 6. SEVERABILITY. 13
187187 If any provision of this Act, an amendment made by 14
188188 this Act, or the application of such provision or amend-15
189189 ment to any person or circumstance is held to be unconsti-16
190190 tutional, the remainder of this Act, the amendments made 17
191191 by this Act, and the application of such provision or 18
192192 amendment to any person or circumstance shall not be af-19
193193 fected thereby. 20
