1818 This Act may be cited as the ‘‘Telework Reform Act 4

5151 or ‘working remotely’ means a category of telework 21

9494 less frequently than annually based on the 4
9595 needs of the agency, which shall include an 5

9797 ‘‘(i) whether agency telework policies 7
9898 and procedures, the duties of the employee, 8
9999 or the approved alternative worksite or 9
100100 agency-designated worksite of the employee 10
101101 need to be changed; 11
102102 ‘‘(ii) the performance of the employee, 12
103103 as determined under the performance ap-13
104104 praisal system of the agency developed 14
105105 under section 4302 (or under a similar 15
106106 legal authority for an executive agency or 16
107107 employee to which section 4302 does not 17
108108 apply); and 18
109109 ‘‘(iii) the needs of the agency, as de-19
110110 termined by the head of the agency;’’; 20

123123 ciplined for being absent without permission for 5

127127 ‘‘(B) the performance of the employee falls 9
128128 below acceptable levels, as determined under the 10
129129 performance appraisal system of the agency de-11
130130 veloped under section 4302 (or under a similar 12
131131 legal authority for an executive agency or em-13
132132 ployee to which section 4302 does not apply); or 14
133133 ‘‘(C) the conduct of the employee violates 15
134134 other terms or conditions of the policy.’’; and 16
135135 (B) by adding at the end the following: 17
136136 ‘‘(d) L
137137 IMITATIONS ON REMOTEWORK.—The fol-18
138138 lowing shall apply with respect to an employee working 19
139139 remotely: 20
140140 ‘‘(1) The employee may be expected to report to 21
141141 the agency-designated worksite of the employee on a 22
142142 periodic basis. 23
143143 ‘‘(2) Notwithstanding any other provision of 24
144144 law or regulation, if the employee is working re-25

149149 located within a radius of not more than 75 miles 2
150150 from the agency-designated worksite of the em-3
151151 ployee, the employee may not be compensated or re-4
152152 imbursed for any travel to or from that agency-des-5
153153 ignated worksite unless that travel is— 6
154154 ‘‘(A) required during the workday; and 7
155155 ‘‘(B) approved by the head of the applica-8
156156 ble executive agency (or the designee of such an 9
157157 official), in the sole and exclusive discretion of 10
158158 that official.’’. 11

160160 PPLICABILITY.—With respect to subpara-12
161161 graph (C) of section 6502(b)(2) of title 5, United 13
162162 States Code, as added by paragraph (1) of this sub-14
163163 section— 15
164164 (A) such subparagraph (C) shall not be en-16
165165 forced to the extent that such subparagraph 17
166166 conflicts with any applicable agreement de-18
167167 scribed in section 7103(a)(8) of such title 5, if 19
168168 the agreement was in effect before October 1, 20
169169 2024; and 21
170170 (B) to the extent that an agreement de-22
171171 scribed in subparagraph (A) of this paragraph 23
172172 conflicts with the requirements of such subpara-24

184184 RAINING ANDMONITORING.—Section 6503(a) 8
185185 of title 5, United States Code, is amended— 9
186186 (1) in paragraph (1)— 10
187187 (A) in subparagraph (A)— 11
188188 (i) by inserting ‘‘, which shall include 12
189189 training on accurate reporting of remote 13
190190 work and telework usage’’ after ‘‘agency’’; 14

192192 (ii) by striking subparagraph (B) and 16

194194 ‘‘(B) all managers and supervisors of tele-18
195195 workers and remote workers, which shall— 19
196196 ‘‘(i) be provided on an annual basis; 20

248248 EVIEW.—The Director of the Office of 15
249249 Management and Budget, in coordination with the 16
250250 Department of Homeland Security and the National 17
251251 Institute of Standards and Technology, shall— 18
252252 ‘‘(A) perform an annual review of the 19
253253 guidelines issued under this subsection; and 20
254254 ‘‘(B) make any updates to the guidelines 21
255255 issued under this subsection that are deter-22
256256 mined to be appropriate as a result of a review 23
257257 conducted under subparagraph (A).’’. 24

296296 ‘‘(4) maintain an executive agency remote work 8
297297 and telework web page that serves as an information 9
298298 portal for employees of the executive agency who are 10
299299 seeking information with respect to remote work and 11
300300 telework policies, contact information for remote 12
301301 work and telework coordinators, and remote work 13
302302 and telework training resources; and’’. 14

355355 ‘‘(B) establish a process through which the 7
356356 executive agency shall determine the agency- 8
357357 designated worksite and approved alternative 9
358358 worksite for the position; and 10
359359 ‘‘(C) consider the potential costs and sav-11
360360 ings associated with approving a position as eli-12
361361 gible for telework or remote work; 13
362362 ‘‘(2) processing a change in the eligibility for an 14
363363 employee working remotely from an approved alter-15
364364 native worksite within a radius of more than 75 16
365365 miles from the agency-designated worksite of the 17
366366 employee; 18
367367 ‘‘(3) establishing which officials within an exec-19
368368 utive agency may designate a position within the ex-20
369369 ecutive agency as eligible for remote work; 21
370370 ‘‘(4) if necessary, defining a limited geo-22
371371 graphical boundary within which the approved alter-23
372372 native worksite of an employee must be located, 24
373373 which shall be based on— 25

382382 ‘‘(5) for an employee working remotely, proc-6
383383 essing and approving a change of the approved alter-7
384384 native worksite of the employee when the employee 8
385385 requests such a change; and 9
386386 ‘‘(6) for an employee working remotely, the 10
387387 ability of whom to continue working remotely is not 11
388388 offered by the applicable executive agency after the 12
389389 expiration of a written agreement entered into under 13
390390 section 6502(b)(2) for a reason that does not include 14
391391 the conduct or performance of the employee, enter-15
392392 ing into a written remote work transition agreement, 16
393393 which shall— 17
394394 ‘‘(A) be for a period of not longer than 1 18
395395 year; 19
396396 ‘‘(B) provide the employee with the ability 20
397397 to participate in remote work during the period 21
398398 in which the transition agreement is in effect; 22
399399 and 23
400400 ‘‘(C) otherwise satisfy the requirements of 24
401401 section 6502(b)(2).’’. 25

418418 HIEF HUMAN CAPITAL OFFICERS .—Not 11
419419 later than 180 days after the date of enactment of 12
420420 this Act, the Chief Human Capital Officer of each 13
421421 executive agency shall submit to the Director of the 14
422422 Office of Personnel Management and Congress a re-15
423423 port that contains— 16
424424 (A) an overview of a process to update cur-17
425425 rent (as of the date on which the report is sub-18
426426 mitted) telework and remote work eligibility re-19
427427 quirements of the executive agency; 20
428428 (B) recommendations regarding ways in 21
429429 which to update matters relating to telework 22
430430 and remote work practices, including practices 23
431431 relating to core business hours, flexible sched-24

442442 (D) metrics used by the executive agency 8
443443 to evaluate the performance of employees of the 9
444444 executive agency; and 10
445445 (E) methods used by the executive agency 11
446446 to track and evaluate the productivity of em-12
447447 ployees of the executive agency when those em-13
448448 ployees are teleworking. 14
449449 (3) E
450450 XECUTIVE AGENCIES.—Not later than 1 15
451451 year after the date of enactment of this Act, the 16
452452 head of each executive agency, in coordination with 17
453453 the Director of the Office of Personnel Management, 18
454454 the Chief Human Capital Officer of the executive 19
455455 agency, the Chief Financial Officer of the executive 20
456456 agency, the Chief Information Officer of the execu-21
457457 tive agency, the Director of the Office of Manage-22
458458 ment and Budget, and the Administrator of General 23
459459 Services, shall submit to the Committee on Home-24
460460 land Security and Governmental Affairs of the Sen-25

473473 teleworking opportunities for employees of par-10
474474 ticular components within the executive agency, 11
475475 including the effects of remote work on— 12
476476 (i) newly appointed employees; 13
477477 (ii) collaboration between employees; 14
478478 (iii) the ability of managers to effec-15
479479 tively supervise other employees; and 16
480480 (iv) employee productivity; 17
