26	26	take into custody certain aliens who have been charged
27	27	in the United States with a crime that resulted in the
28	28	death or serious bodily injury of another person, and
29	29	for other purposes.
30	30	Be it enacted by the Senate and House of Representa-1
31	31	tives of the United States of America in Congress assembled, 2
32	32	SECTION 1. SHORT TITLE. 3
33	33	This Act may be cited as ‘‘Sarah’s Law’’. 4

37	37	SEC. 2. MANDATORY DETENTION OF CERTAIN ALIENS 1
38	38	CHARGED WITH A CRIME RESULTING IN 2
39	39	DEATH OR SERIOUS BODILY INJURY. 3
40	40	Section 236(c) of the Immigration and Nationality 4
41	41	Act (8 U.S.C. 1226(c)) is amended— 5
42	42	(1) in paragraph (1)— 6
43	43	(A) in subparagraph (A), by striking the 7
44	44	comma at the end and inserting a semicolon; 8
45	45	(B) in subparagraph (B), by striking the 9
46	46	comma at the end and inserting a semicolon; 10
47	47	(C) in subparagraph (C)— 11
48	48	(i) by striking ‘‘sentence’’ and insert-12
49	49	ing ‘‘sentenced’’; and 13
50	50	(ii) by striking ‘‘, or’’ and inserting a 14
51	51	semicolon; 15
52	52	(D) in subparagraph (D), by striking the 16
53	53	comma at the end and inserting ‘‘; or’’; and 17
54	54	(E) by inserting after subparagraph (D) 18
55	55	the following: 19
56	56	‘‘(E)(i)(I) was not inspected and admitted 20
57	57	into the United States; 21
58	58	‘‘(II) held a nonimmigrant visa (or other 22
59	59	documentation authorizing admission into the 23
60	60	United States as a nonimmigrant) that has 24
61	61	been revoked under section 221(i); or 25

65	65	‘‘(III) is described in section 1
66	66	237(a)(1)(C)(i); and 2
67	67	‘‘(ii) has been charged by a prosecuting au-3
68	68	thority in the United States with any crime 4
69	69	that resulted in the death or serious bodily in-5
70	70	jury (as defined in section 1365(h)(3) of title 6
71	71	18, United States Code) of another person,’’; 7
72	72	and 8
73	73	(2) by adding at the end the following: 9
74	74	‘‘(3) N
75	75	OTIFICATION REQUIREMENT .—Upon en-10
76	76	countering or gaining knowledge of an alien de-11
77	77	scribed in paragraph (1), the Assistant Secretary of 12
78	78	Homeland Security for Immigration and Customs 13
79	79	Enforcement shall make reasonable efforts— 14
80	80	‘‘(A) to obtain information from law en-15
81	81	forcement agencies and from other available 16
82	82	sources regarding the identity of any victims of 17
83	83	the crimes for which such alien was charged or 18
84	84	convicted; and 19
85	85	‘‘(B) to provide the victim or, if the victim 20
86	86	is deceased, a parent, guardian, spouse, or clos-21
87	87	est living relative of such victim, with informa-22
88	88	tion, on a timely and ongoing basis, including— 23
89	89	‘‘(i) the alien’s full name, aliases, date 24
90	90	of birth, and country of nationality; 25

95	95	and criminal history; 2
96	96	‘‘(iii) the alien’s custody status and 3
97	97	any changes related to the alien’s custody; 4
98	98	and 5
99	99	‘‘(iv) a description of any efforts by 6
100	100	the United States Government to remove 7
101	101	the alien from the United States.’’. 8
102	102	SEC. 3. SAVINGS PROVISION. 9
103	103	Nothing in this Act, or the amendments made by this 10
104	104	Act, may be construed to limit the rights of crime victims 11
105	105	under any other provision of law, including section 3771 12
106	106	of title 18, United States Code. 13
