15	15	to Congress regarding incidents of terrorism, and for
16	16	other purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLES. 3
20	20	This Act may be cited as the ‘‘Reporting Efficiently 4
21	21	to Proper Officials in Response to Terrorism Act of 2025’’ 5
22	22	or the ‘‘REPORT Act’’. 6
23	23	SEC. 2. DUTY TO REPORT. 7

25	25	EFINITIONS.—In this section: 8

29	29	(1) ACT OF TERRORISM.—The term ‘‘act of ter-1
30	30	rorism’’ has the meaning given such term in section 2
31	31	3077(1) of title 18, United States Code. 3

33	33	PPROPRIATE CONGRESSIONAL COMMIT -4
34	34	TEES.—The term ‘‘appropriate congressional com-5
35	35	mittees’’ means— 6
36	36	(A) the Committee on Homeland Security 7
37	37	and Governmental Affairs of the Senate; 8
38	38	(B) the Committee on the Judiciary of the 9
39	39	Senate; 10
40	40	(C) the Select Committee on Intelligence of 11
41	41	the Senate; 12
42	42	(D) the Committee on Homeland Security 13
43	43	of the House of Representatives; 14
44	44	(E) the Committee on the Judiciary of the 15
45	45	House of Representatives; and 16
46	46	(F) the Permanent Select Committee on 17
47	47	Intelligence of the House of Representatives. 18

49	49	EQUIREMENT.— 19
50	50	(1) I
51	51	N GENERAL.—Whenever an act of ter-20
52	52	rorism occurs in the United States, the Secretary of 21
53	53	Homeland Security, the Attorney General, the Direc-22
54	54	tor of the Federal Bureau of Investigation, and, as 23
55	55	appropriate, the head of the National Counterter-24
56	56	rorism Center shall— 25

60	60	(A) submit to the appropriate congres-1
61	61	sional committees, by not later than 1 year 2
62	62	after the completion of the investigation con-3
63	63	cerning such act by the primary Government 4
64	64	agency conducting such investigation, an un-5
65	65	classified report (which may be accompanied by 6
66	66	a classified annex) concerning such act of ter-7
67	67	rorism; and 8
68	68	(B) make the report required under sub-9
69	69	paragraph (A) available on a publicly accessible 10
70	70	website. 11
71	71	(2) O
72	72	THER REPORTS.—Reports required under 12
73	73	this subsection may be combined into a quarterly re-13
74	74	port submitted to Congress. 14
75	75	(3) A
76	76	VAILABILITY.—Each unclassified report 15
77	77	and classified annex described in paragraph (1)(A) 16
78	78	shall be made available upon request by any Member 17
79	79	of Congress. 18

81	81	ONTENT OFREPORTS.—Each report submitted 19
82	82	pursuant to subsection (b) shall— 20
83	83	(1) include a statement of the facts of each act 21
84	84	of terrorism covered by the report, to the extent 22
85	85	such facts are known at the time the report is sub-23
86	86	mitted to the appropriate congressional committees; 24

90	90	(2) identify any gaps in homeland or national 1
91	91	security that could be addressed to prevent similar 2
92	92	future acts of terrorism; and 3
93	93	(3) include any recommendations for additional 4
94	94	measures that could be taken to improve homeland 5
95	95	or national security, including recommendations re-6
96	96	lating to potential changes in law enforcement prac-7
97	97	tices or changes in law, with particular attention to 8
98	98	changes that could help prevent future acts of ter-9
99	99	rorism. 10

101	101	XCEPTION.— 11
102	102	(1) I
103	103	N GENERAL.—If the Secretary of Home-12
104	104	land Security, the Attorney General, or the Director 13
105	105	of the Federal Bureau of Investigation determines 14
106	106	any information described in subsection (c) that is 15
107	107	required to be included in the report required under 16
108	108	subsection (b) could jeopardize an ongoing investiga-17
109	109	tion or prosecution, the Secretary, Attorney General, 18
110	110	or Director, as the case may be— 19
111	111	(A) may withhold from reporting such in-20
112	112	formation; and 21
113	113	(B) shall notify the appropriate congres-22
114	114	sional committees of such determination. 23
115	115	(2) S
116	116	AVINGS PROVISION.—Withholding of infor-24
117	117	mation pursuant to a determination described in 25

121	121	paragraph (1) shall not affect, in any manner, the 1
122	122	responsibility of the appropriate Federal official to 2
123	123	submit a report required under subsection (b) con-3
124	124	taining other information described in subsection (c) 4
125	125	that is not subject to such determination. 5

127	127	UNSET.—This section shall terminate on the 6
128	128	date that is 5 years after the date of the enactment of 7
129	129	this Act. 8

131	131	AVINGSPROVISION.—Nothing in this Act may 9
132	132	be construed to provide the National Counterterrorism 10
133	133	Center with prosecutorial or investigatory authority. 11
