147147 actment of this Act, the Secretary of State and the Attor-3
148148 ney General shall jointly provide to the appropriate com-4
149149 mittees of Congress a classified briefing on— 5
150150 (1) outreach and negotiations undertaken by 6
151151 the United States Government with the Government 7
152152 of the PRC that was aimed at securing the approval 8
153153 of the Government of the PRC to establish of United 9
154154 States Drug Enforcement Administration offices in 10
155155 Shanghai and Guangzhou, the PRC; and 11
156156 (2) additional efforts to establish new partner-12
157157 ships with provincial-level authorities in the PRC to 13
158158 counter the illicit trafficking of fentanyl, fentanyl 14
159159 analogues, and their precursors. 15
160160 SEC. 4. PRIORITIZATION OF IDENTIFICATION OF PERSONS 16
161161 FROM THE PEOPLE’S REPUBLIC OF CHINA. 17
162162 Section 7211 of the Fentanyl Sanctions Act (21 18
163163 U.S.C. 2311) is amended— 19
164164 (1) in subsection (a)— 20
165165 (A) by redesignating paragraphs (3) and 21
166166 (4) as paragraphs (4) and (5), respectively; and 22
167167 (B) by inserting after paragraph (2) the 23

177177 ‘‘(i) an individual who is a citizen or 4
178178 national of the People’s Republic of China; 5

180180 ‘‘(ii) an entity organized under the 7
181181 laws of the People’s Republic of China or 8
182182 otherwise subject to the jurisdiction of the 9
183183 Government of the People’s Republic of 10

187187 port required under paragraph (1), the Presi-13
188188 dent shall prioritize, to the greatest extent prac-14
189189 ticable, the identification of persons of the Peo-15
190190 ple’s Republic of China involved in the shipment 16
191191 of fentanyl, fentanyl analogues, fentanyl precur-17
192192 sors, precursors for fentanyl analogues, pre-pre-18
193193 cursors for fentanyl and fentanyl analogues, 19
194194 and equipment for the manufacturing of 20
195195 fentanyl and fentanyl-laced counterfeit pills to 21
196196 Mexico or any other country that is involved in 22
197197 the production of fentanyl trafficked into the 23
198198 United States, including— 24

207207 ERMINATION OF PRIORITIZATION .— 5
208208 The President shall continue the prioritization 6
209209 required under subparagraph (B) until the 7
210210 President certifies to the appropriate congres-8
211211 sional committees that the People’s Republic of 9
212212 China is no longer the primary source for the 10
213213 shipment of fentanyl, fentanyl analogues, 11
214214 fentanyl precursors, precursors for fentanyl 12
215215 analogues, pre-precursors for fentanyl and 13
216216 fentanyl analogues, and equipment for the man-14
217217 ufacturing of fentanyl and fentanyl-laced coun-15
218218 terfeit pills to Mexico or any other country that 16
219219 is involved in the production of fentanyl traf-17
220220 ficked into the United States.’’; and 18
221221 (2) in subsection (c), by striking ‘‘the date that 19
222222 is 5 years after such date of enactment’’ and insert-20
223223 ing ‘‘December 31, 2030’’. 21
224224 SEC. 5. EXPANSION OF SANCTIONS UNDER THE FENTANYL 22
225225 SANCTIONS ACT. 23
226226 Section 7212 of the Fentanyl Sanctions Act (21 24
227227 U.S.C. 2312) is amended— 25

244244 ‘‘(i) constitutes or is derived from the 14
245245 proceeds of an activity or transaction de-15
246246 scribed in paragraph (3); or 16
247247 ‘‘(ii) was used or intended to be used 17
248248 to commit or to facilitate such an activity 18
249249 or transaction; 19
250250 ‘‘(B) has knowingly provided significant fi-20
251251 nancial, material, or technological support for, 21
252252 including through the provision of goods or 22
253253 services in support of— 23
254254 ‘‘(i) any activity or transaction de-24
255255 scribed in paragraph (3); or 25

265265 on behalf of, directly or indirectly, such a for-7

267267 SEC. 6. IMPOSITION OF SANCTIONS WITH RESPECT TO 9
268268 AGENCIES OR INSTRUMENTALITIES OF FOR-10
269269 EIGN STATES. 11

271271 EFINITIONS.—In this section, the terms ‘‘know-12
272272 ingly’’ and ‘‘opioid trafficking’’ have the meanings given 13
273273 such terms in section 7203 of the Fentanyl Sanctions Act 14
274274 (21 U.S.C. 2302). 15
275275 (b) I
276276 NGENERAL.—The President may— 16
277277 (1) impose one or more of the sanctions de-17
278278 scribed in section 7213 of the Fentanyl Sanctions 18
279279 Act (21 U.S.C. 2313) with respect to each political 19
280280 subdivision, agency, or instrumentality of a foreign 20
281281 government, including any financial institution 21
282282 owned or controlled by a foreign government, that 22
283283 the President determines has knowingly, on or after 23
284284 the date of the enactment of this Act— 24

294294 nificant activity or significant financial trans-7
295295 action described in subparagraph (A); and 8
296296 (2) impose one or more of the sanctions de-9
297297 scribed in section 7213(a)(6) of the Fentanyl Sanc-10
298298 tions Act (21 U.S.C. 2313(a)(6)) with respect to 11
299299 each senior official of a political subdivision, agency, 12
300300 or instrumentality of a foreign government that the 13
301301 President determines has knowingly, on or after the 14
302302 date of the enactment of this Act, facilitated a sig-15
303303 nificant activity or a significant financial transaction 16
304304 described in paragraph (1). 17
305305 SEC. 7. ANNUAL REPORT ON EFFORTS TO PREVENT THE 18
306306 SMUGGLING OF METHAMPHETAMINE INTO 19
307307 THE UNITED STATES FROM MEXICO. 20
308308 Section 723(c) of the Combat Methamphetamine Epi-21
309309 demic Act of 2005 (22 U.S.C. 2291 note) is amended by 22
310310 striking the period at the end and inserting the following 23
311311 ‘‘, which shall— 24
