16	16	Be it enacted by the Senate and House of Representa-1
17	17	tives of the United States of America in Congress assembled, 2
18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Make American Flags 4
20	20	in America Act of 2025’’. 5
21	21	SEC. 2. REQUIREMENT FOR CERTAIN FLAGS OF UNITED 6
22	22	STATES TO BE MADE IN UNITED STATES. 7

32	32	‘‘SEC. 11. DISPLAY ON FEDERAL PROPERTY; PROCURE-3
33	33	MENT BY FEDERAL AGENCIES. 4
34	34	‘‘(a) D
35	35	EFINITIONS.—In this section: 5
36	36	‘‘(1) F
37	37	EDERAL AGENCY .—The term ‘Federal 6
38	38	agency’ means— 7
39	39	‘‘(A) an Executive agency; 8
40	40	‘‘(B) a military department; 9
41	41	‘‘(C) an office, agency, or other establish-10
42	42	ment in the legislative branch; 11
43	43	‘‘(D) an office, agency, or other establish-12
44	44	ment in the judicial branch; 13
45	45	‘‘(E) the Government of the District of Co-14
46	46	lumbia; and 15
47	47	‘‘(F) a Government controlled corporation. 16
48	48	‘‘(2) F
49	49	EDERAL PROPERTY .—The term ‘Federal 17
50	50	property’ means real property owned, leased, or oc-18
51	51	cupied by a Federal agency or an instrumentality 19
52	52	wholly owned by the United States. 20
53	53	‘‘(3) M
54	54	ADE IN THE UNITED STATES .—The term 21
55	55	‘made in the United States’ means 100 percent 22
56	56	manufactured in the United States from articles, 23
57	57	materials, or supplies that have been 100 percent 24
58	58	produced or manufactured in the United States. 25

62	62	‘‘(4) UNITED STATES.—The term ‘United 1
63	63	States’, when used in a geographic sense, includes 2
64	64	each of the several States, the District of Columbia, 3
65	65	Tribal lands, and the territories or possessions of the 4
66	66	United States. 5
67	67	‘‘(b) D
68	68	ISPLAY ONFEDERALPROPERTY.—A Federal 6
69	69	agency may not display a flag of the United States on 7
70	70	Federal property unless such flag has been made in the 8
71	71	United States. 9
72	72	‘‘(c) P
73	73	ROCUREMENT BY FEDERALAGENCIES.— 10
74	74	Funds appropriated or otherwise made available to a Fed-11
75	75	eral agency may not be used for the procurement of a flag 12
76	76	of the United States unless such flag has been made in 13
77	77	the United States. 14
78	78	‘‘(d) I
79	79	NTERNATIONAL AGREEMENTS.—This section 15
80	80	shall be applied in a manner consistent with the obliga-16
81	81	tions of the United States under international agreements. 17
82	82	‘‘(e) R
83	83	ULE OFCONSTRUCTION.—Nothing in this sec-18
84	84	tion may be construed to apply to the display or procure-19
85	85	ment of a flag of the United States by a private actor.’’. 20
86	86	(b) C
87	87	LERICALAMENDMENT.—The table of sections 21
88	88	for chapter 1 of title 4, United States Code, is amended 22
89	89	by adding at the end the following: 23
90	90	‘‘11. Display on Federal property; procurement by Federal agencies.’’.
91	91	(c) APPLICABILITY.—Section 11 of title 4, United 24
92	92	States Code, as added by subsection (a), shall apply— 25

96	96	(1) with respect to the display of a flag of the 1
97	97	United States by a Federal agency, on and after the 2
98	98	date that is 2 years after the date of the enactment 3
99	99	of this Act; and 4
100	100	(2) with respect to the procurement of a flag of 5
101	101	the United States by a Federal agency, on and after 6
102	102	the date that is 90 days after the date of the enact-7
103	103	ment of this Act. 8
104	104	SEC. 3. STUDY ON COUNTRY-OF-ORIGIN LABELING FOR 9
105	105	FLAGS OF THE UNITED STATES. 10
106	106	(a) S
107	107	TUDY.—The Chair of the Federal Trade Com-11
108	108	mission shall conduct a study that— 12
109	109	(1) assesses and describes the enforcement 13
110	110	scheme for country-of-origin labeling for flags of the 14
111	111	United States; 15
112	112	(2) determines how many fines or penalties, if 16
113	113	any, have been imposed for violations of such en-17
114	114	forcement scheme; and 18
115	115	(3) identifies the percentage of violations of 19
116	116	such enforcement scheme that are subsequent viola-20
117	117	tions committed by an entity that has previously 21
118	118	been found to have violated such scheme. 22
119	119	(b) R
120	120	EPORT.—Not later than 1 year after the date 23
121	121	of the enactment of this Act, the Chair of the Federal 24
122	122	Trade Commission shall submit to the Committee on En-25

127	127	the Committee on Commerce, Science, and Transportation 2
128	128	of the Senate a report containing— 3
129	129	(1) the results of the study conducted under 4
130	130	subsection (a); and 5
131	131	(2) any recommendations to improve— 6
132	132	(A) the enforcement scheme for country-of- 7
133	133	origin labeling for flags of the United States; 8
134	134	and 9
135	135	(B) the deterrent effect of such scheme. 10
