1919 This Act may be cited as the ‘‘Make American Flags 4
2020 in America Act of 2025’’. 5

3535 EFINITIONS.—In this section: 5
3636 ‘‘(1) F
3737 EDERAL AGENCY .—The term ‘Federal 6
3838 agency’ means— 7
3939 ‘‘(A) an Executive agency; 8
4040 ‘‘(B) a military department; 9
4141 ‘‘(C) an office, agency, or other establish-10
4242 ment in the legislative branch; 11
4343 ‘‘(D) an office, agency, or other establish-12
4444 ment in the judicial branch; 13
4545 ‘‘(E) the Government of the District of Co-14
4646 lumbia; and 15
4747 ‘‘(F) a Government controlled corporation. 16
4848 ‘‘(2) F
4949 EDERAL PROPERTY .—The term ‘Federal 17
5050 property’ means real property owned, leased, or oc-18
5151 cupied by a Federal agency or an instrumentality 19
5252 wholly owned by the United States. 20
5353 ‘‘(3) M
5454 ADE IN THE UNITED STATES .—The term 21
5555 ‘made in the United States’ means 100 percent 22
5656 manufactured in the United States from articles, 23
5757 materials, or supplies that have been 100 percent 24
5858 produced or manufactured in the United States. 25

6262 ‘‘(4) UNITED STATES.—The term ‘United 1
6363 States’, when used in a geographic sense, includes 2
6464 each of the several States, the District of Columbia, 3
6565 Tribal lands, and the territories or possessions of the 4
6666 United States. 5

6868 ISPLAY ONFEDERALPROPERTY.—A Federal 6
6969 agency may not display a flag of the United States on 7
7070 Federal property unless such flag has been made in the 8
7171 United States. 9

7373 ROCUREMENT BY FEDERALAGENCIES.— 10
7474 Funds appropriated or otherwise made available to a Fed-11
7575 eral agency may not be used for the procurement of a flag 12
7676 of the United States unless such flag has been made in 13
7777 the United States. 14
7878 ‘‘(d) I
7979 NTERNATIONAL AGREEMENTS.—This section 15
8080 shall be applied in a manner consistent with the obliga-16
8181 tions of the United States under international agreements. 17

8383 ULE OFCONSTRUCTION.—Nothing in this sec-18
8484 tion may be construed to apply to the display or procure-19
8585 ment of a flag of the United States by a private actor.’’. 20

8787 LERICALAMENDMENT.—The table of sections 21
8888 for chapter 1 of title 4, United States Code, is amended 22
8989 by adding at the end the following: 23
9090 ‘‘11. Display on Federal property; procurement by Federal agencies.’’.
9191 (c) APPLICABILITY.—Section 11 of title 4, United 24
9292 States Code, as added by subsection (a), shall apply— 25

9696 (1) with respect to the display of a flag of the 1
9797 United States by a Federal agency, on and after the 2
9898 date that is 2 years after the date of the enactment 3
9999 of this Act; and 4
100100 (2) with respect to the procurement of a flag of 5
101101 the United States by a Federal agency, on and after 6
102102 the date that is 90 days after the date of the enact-7
103103 ment of this Act. 8
104104 SEC. 3. STUDY ON COUNTRY-OF-ORIGIN LABELING FOR 9
105105 FLAGS OF THE UNITED STATES. 10
106106 (a) S
107107 TUDY.—The Chair of the Federal Trade Com-11
108108 mission shall conduct a study that— 12
109109 (1) assesses and describes the enforcement 13
110110 scheme for country-of-origin labeling for flags of the 14
111111 United States; 15
112112 (2) determines how many fines or penalties, if 16
113113 any, have been imposed for violations of such en-17
114114 forcement scheme; and 18
115115 (3) identifies the percentage of violations of 19
116116 such enforcement scheme that are subsequent viola-20
117117 tions committed by an entity that has previously 21
118118 been found to have violated such scheme. 22
119119 (b) R
120120 EPORT.—Not later than 1 year after the date 23
121121 of the enactment of this Act, the Chair of the Federal 24
122122 Trade Commission shall submit to the Committee on En-25

127127 the Committee on Commerce, Science, and Transportation 2
128128 of the Senate a report containing— 3
129129 (1) the results of the study conducted under 4
130130 subsection (a); and 5
131131 (2) any recommendations to improve— 6
132132 (A) the enforcement scheme for country-of- 7
133133 origin labeling for flags of the United States; 8
134134 and 9
135135 (B) the deterrent effect of such scheme. 10
