2121 This Act may be cited as the ‘‘Arsenal Workload 4
2222 Sustainment Act’’. 5
2323 SEC. 2. PILOT PROGRAM ON ARSENAL WORKLOAD 6

2626 INDINGS.—Congress finds the following: 8

3030 (1) The United States has a long and proud 1
3131 history of manufacturing defense products. 2
3232 (2) Factories and arsenals of the Department 3
3333 of the Army that are owned and operated by the 4
3434 United States Government are a critical component 5
3535 of the organic industrial base. 6
3636 (3) The first ever National Defense Industrial 7
3737 Strategy released in 2024 recognized the need of the 8
3838 Department of Defense to more strategically utilize 9
3939 the organic industrial base in order to maintain a 10
4040 competitive military advantage. 11
4141 (4) Sufficient workload at arsenals of the De-12
4242 partment of the Army that are owned and operated 13
4343 by the United States Government ensure cost effi-14
4444 ciency and technical competence in peacetime, while 15
4545 preserving the ability to provide an effective and 16
4646 timely response to mobilizations, national defense 17
4747 contingency situations, and other emergency require-18
4848 ments. 19

5050 STABLISHMENT OF PILOTPROGRAM.—Not 20
5151 later than 90 days after the date of the enactment of this 21
5252 Act, the Secretary of Defense shall establish a pilot pro-22
5353 gram to be known as the ‘‘Arsenal Workload Sustainment 23
5454 Pilot Program’’ (in this section referred to as the ‘‘pilot 24
5555 program’’). 25

5959 (c) DURATION.—The pilot program shall be con-1
6060 ducted for a period of five years. 2

6464 OLICITATIONS.— 4

6666 N GENERAL.—In carrying out the pilot 5
6767 program, the Secretary of Defense shall give a pref-6
6868 erence described in paragraph (2) for any procure-7
6969 ment action or solicitation by a non-public partner 8
7070 who has entered into a public-private partnership 9
7171 with the Secretary in the source selection process if 10
7272 such non-public partner uses an arsenal of the De-11
7373 partment of the Army that is owned and operated by 12
7474 the United States Government as a partner in any 13
7575 type of contractual agreement with the United 14
7676 States Government. 15

7878 REFERENCE DESCRIBED .—A preference 16
7979 described in this paragraph is the addition of 20 17
8080 percent to the price of any offer by a non-public 18
8181 partner that does not use an arsenal of the Depart-19
8282 ment of the Army that is owned and operated by the 20
8383 United States Government as a partner in its bid for 21
8484 the same procurement action or solicitation de-22
8585 scribed in paragraph (1). 23

8787 URTHER PREFERENCE .—In selecting non- 24
8888 public partners under paragraph (1), the Secretary 25

9494 (A) utilize the Advanced Manufacturing 3
9595 Center of Excellence of the Army; and 4
9696 (B) ensure not less than 25 percent of the 5
9797 activities under the partnership are performed 6
9898 by employees of the Department of Defense. 7

100100 EPORTREQUIRED.— 8

102102 N GENERAL.—Not later than one year 9
103103 after the date of the enactment of this Act, the Sec-10
104104 retary of Defense shall submit to the appropriate 11
105105 congressional committees a report on the activities 12
106106 carried out under the pilot program, including a de-13
107107 scription of any operational challenges identified. 14
108108 (2) E
109109 LEMENTS.—The report required under 15
110110 paragraph (1) shall include the following: 16
111111 (A) A breakout, by relevant budget ac-17
112112 counts, of workload at an arsenal of the De-18
113113 partment of the Army that is owned and oper-19
114114 ated by the United States Government that was 20
115115 achieved in the prior fiscal year, whether di-21
116116 rectly or through public-private partnerships 22
117117 under the pilot program. 23
118118 (B) An assessment of relevant budget ac-24
119119 counts where such an arsenal can be utilized to 25

124124 ment of Defense, irrespective of cost. 2
125125 (C) An outlook of expected workload at 3
126126 each such arsenal during the period covered by 4
127127 the future-years defense program submitted to 5
128128 Congress under section 221 of title 10, United 6
129129 States Code. 7
130130 (D) The capital investments required to be 8
131131 made at each such arsenal to ensure compliance 9
132132 and operational capacity. 10
