To amend the Omnibus Crime Control and Safe Streets 
Act of 1968 to include certain retired law enforcement 
officers in the public safety officers’ death benefits pro-
gram. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Chief Herbert D. 4
Proffitt Act of 2025’’. 5

SEC. 2. INCLUSION OF CERTAIN RETIRED PUBLIC SAFETY 1
OFFICERS IN THE PUBLIC SAFETY OFFICERS’ 2
DEATH BENEFITS PROGRAM. 3
(a) I
NGENERAL.—Section 1201 of title I of the Om-4
nibus Crime Control and Safe Streets Act of 1968 (34 5
U.S.C. 10281) is amended by adding at the end the fol-6
lowing: 7
‘‘(p) P
ERSONALINJURY TORETIREDLAWENFORCE-8
MENTOFFICER.— 9
‘‘(1) D
EFINITION.—In this subsection, the term 10
‘retired law enforcement officer’ means an individual 11
who separated from service in good standing as a 12
law enforcement officer in an official capacity at a 13
public agency with or without compensation. 14
‘‘(2) E
LIGIBILITY.—A retired law enforcement 15
officer shall be eligible for a benefit under this part 16
if the officer died or became permanently and totally 17
disabled as the direct and proximate result of a per-18
sonal injury resulting from a targeted attack be-19
cause of the retired law enforcement officer’s service 20
as a law enforcement officer.’’. 21
(b) R
ETROACTIVEAPPLICABILITY.— 22
(1) I
N GENERAL.—Except as provided in para-23
graph (2), the amendments made by this section 24
shall— 25

(A) take effect on the date of enactment of 1
this Act; and 2
(B) apply to any matter— 3
(i) pending before the Bureau of Jus-4
tice Assistance or otherwise on the date of 5
enactment of this Act; or 6
(ii) filed (consistent with pre-existing 7
effective dates) or accruing after the date 8
of enactment of this Act. 9
(2) E
XCEPTIONS.—The amendment made by 10
this section shall apply to any action taken against 11
a retired law enforcement officer described in section 12
1201(p) of title I of the Omnibus Crime Control and 13
Safe Streets Act of 1968 (as added by this Act) on 14
or after January 1, 2012. 15
