15	15	To allow Federal employees who are involuntarily separated
16	16	from Government service while serving a probationary
17	17	or trial period to resume that period upon reinstatement,
18	18	and for other purposes.
19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. SHORT TITLE. 3
22	22	This Act may be cited as the ‘‘Protect Our Proba-4
23	23	tionary Employees Act’’. 5
24	24	SEC. 2. RESUMPTION OF PROBATIONARY PERIOD. 6
25	25	(a) D
26	26	EFINITIONS.—In this section: 7

30	30	(1) COVERED APPOINTMENT .—The term ‘‘cov-1
31	31	ered appointment’’ means an appointment of a cov-2
32	32	ered probationary employee to a position in the 3
33	33	former employing agency of that covered proba-4
34	34	tionary employee that, to the extent practicable, is 5
35	35	the same as the previous Federal position occupied 6
36	36	by that covered probationary employee. 7
37	37	(2) C
38	38	OVERED PROBATIONARY EMPLOYEE .—The 8
39	39	term ‘‘covered probationary employee’’ means an in-9
40	40	dividual who— 10
41	41	(A) is, or was, involuntarily separated from 11
42	42	Government service during the period beginning 12
43	43	on January 20, 2025, and ending on the date 13
44	44	described in subsection (c); and 14
45	45	(B) immediately before the involuntary 15
46	46	separation described in subparagraph (A), occu-16
47	47	pied a position in an Executive agency under 17
48	48	which the individual served a probationary or 18
49	49	trial period under an initial appointment. 19

51	51	XECUTIVE AGENCY.—The term ‘‘Executive 20
52	52	agency’’ has the meaning given the term in section 21
53	53	105 of title 5, United States Code. 22

55	55	ORMER EMPLOYING AGENCY .—With re-23
56	56	spect to a covered probationary employee, the term 24
57	57	‘‘former employing agency’’ means the Executive 25

61	61	agency from which the involuntary separation of 1
62	62	that individual made that individual a covered pro-2
63	63	bationary employee. 3
64	64	(5) P
65	65	REVIOUS FEDERAL POSITION .—The term 4
66	66	‘‘previous Federal position’’ means, with respect to 5
67	67	a covered probationary employee, the position in an 6
68	68	Executive agency occupied by the covered proba-7
69	69	tionary employee immediately before becoming a cov-8
70	70	ered probationary employee. 9

72	72	ESUMPTION OFPROBATIONARYPERIOD.—Not-10
73	73	withstanding any other provision of law, the duration of 11
74	74	the probationary or trial period for a covered appointment 12
75	75	of a covered probationary employee to become final shall 13
76	76	be equal to the difference between— 14
77	77	(1) the duration of that probationary or trial 15
78	78	period that, but for this Act, would apply to that 16
79	79	covered appointment; and 17
80	80	(2) the duration of the probationary or trial pe-18
81	81	riod that the covered probationary employee served 19
82	82	in the previous Federal position of that covered pro-20
83	83	bationary employee, to the extent that such duration 21
84	84	does not exceed the duration described in paragraph 22
85	85	(1). 23

89	89	(c) SUNSET.—This Act shall terminate on January 1
90	90	20, 2029. 2
