14 ‘‘(ii) in the upper reaches of estuaries; 15 ‘‘(iii) in freshwater lakes and rivers; 16 ‘‘(iv) in coastal and marine waters; 17 and 18 ‘‘(v) that originate in freshwater lakes 19 or rivers and migrate to coastal waters; 20 ‘‘(B) examine the causes, ecological con-21 sequences or physiological consequences on 22 wildlife function, and economic or cultural im-23 pacts, including food safety and security and 24 subsistence use, of harmful algal blooms; 2 ‘‘(D) examine potential methods to pre-3 vent, control, and mitigate harmful algal blooms 4 and the potential ecological, subsistence use, 5 and economic costs and benefits of such meth-6 ods; 7 ‘‘(E) identify priorities for research needed 8 to advance techniques and technologies to de-9 tect, predict, monitor, respond to, and minimize 10 the occurrence, duration, and severity of harm-11 ful algal blooms, including recommendations to 12 eliminate significant gaps in harmful algal 13 bloom forecasting, monitoring, and observation 14 data; 15 ‘‘(F) evaluate progress made by, and the 16 needs of, activities and actions of the Task 17 Force to prevent, control, and mitigate harmful 18 algal blooms; 19 ‘‘(G) identify ways to improve coordination 20 and prevent unnecessary duplication of effort 21 among Federal agencies with respect to re-22 search on harmful algal blooms; and 8 ‘‘(2) appropriate industries (including fisheries, 9 agriculture, and fertilizer), academic institutions, 10 and nongovernmental organizations with relevant ex-11 pertise.’’. 12 (2) C LERICAL AMENDMENT .—The table of con-13 tents in section 2 of the Coast Guard Authorization 14 Act of 1998 (Public Law 105–383; 3 ‘‘(G) to support the resilience of the sea-4 food industry to harmful algal blooms and to 5 expand access to testing for harmful algal 6 bloom toxins, including for subsistence and rec-7 reational harvesters, through innovative meth-8 ods that increase the efficiency and effective-9 ness of such testing in rural and remote areas; 10 ‘‘(H) to support sustained observations to 11 provide State and local entities, Indian tribes, 12 and other entities access to real-time or near 13 real-time observations data for decision making 14 to protect human and ecological health and 15 local economies; and 16 ‘‘(I) to assess the combined effects of 17 harmful algal blooms, hypoxia, and stressors 18 such as runoff and infrastructure changes on 19 marine, freshwater, or estuarine ecosystems and 20 living resources;’’; Environmental Protection Agency activities.’’. (e) NATIONALHARMFULALGALBLOOMOBSERVING 12 N ETWORK.— 13 (1) I N GENERAL.—Section 606 of the Harmful 14 Algal Bloom and Hypoxia Research and Control Act 15 of 1998 (33 U.S.C. 4005) is amended to read as fol-16 lows: 17 ‘‘SEC. 606. NATIONAL-LEVEL INCUBATOR PROGRAM. 5 ‘‘(a) I NGENERAL.—The Under Secretary, in collabo-6 ration with the Administrator and research universities 7 and institutions, shall establish a national-level incubator 8 program (in this section referred to as the ‘program’) to 9 increase the number of strategies, technologies, and meas-10 ures available to prevent, mitigate, and control harmful 11 algal blooms. 12 ‘‘(b) F RAMEWORK.—The program shall establish a 13 framework for preliminary assessments of novel strategies, 14 technologies, and measures to prevent, mitigate, and con-15 trol harmful algal blooms in order to determine the poten-16 tial effectiveness and scalability of such technologies. 17 ‘‘(c) F UNDING.—The program shall provide merit- 18 based funding, using amounts otherwise available to the 19 Under Secretary for the award of grants, for strategies, 20 technologies, and measures that eliminate or reduce, 21 through biological, chemical, or physical means, the levels 22 of harmful algae and associated toxins resulting from 23 harmful algal blooms. 24 VerDate Sep 11 2014 22:12 Feb 03, 2025 Jkt 059200 PO 00000 Frm 00017 Fmt 6652 Sfmt 6201 E:\BILLS\S93.IS S93 kjohnson on DSK7ZCZBW3PROD with $$_JOB 18 •S 93 IS ‘‘(d) DATABASE.—The program shall include a data-1 base for cataloging the licensing and permitting require-2 ments, economic costs, feasibility, effectiveness, and 3 scalability of novel and established strategies, tech-4 nologies, and measures to prevent, mitigate, and control 5 harmful algal blooms. 6 ‘‘(e) P RIORITIZATION.—In carrying out the program, 7 the Under Secretary shall prioritize proposed strategies, 8 technologies, and measures that would, to the maximum 9 extent practicable— 10 ‘‘(1) protect key habitats for fish and wildlife; 11 ‘‘(2) maintain biodiversity; 12 ‘‘(3) protect public health; 13 ‘‘(4) protect coastal resources of national, his-14 torical, and cultural significance; or 15 ‘‘(5) benefit low-income communities, Indian 16 tribes, and rural communities.’’. 17 (2) C LERICAL AMENDMENT .—The table of con-18 tents in section 2 of the Coast Guard Authorization 19 Act of 1998 (Public Law 105–383; 112 Stat. 3412; 20 136 Stat. 1268) is amended by inserting after the 21 item relating to section 606 the following: 22 ‘‘Sec. 606A. National-level incubator program.’’. OTHER HARMFUL ALGAL BLOOM AND HYPOXIA 8 MATTERS. 9 Section 9(g) of the National Integrated Drought In-10 formation System Reauthorization Act of 2018 (33 U.S.C. 11 4010) is amended— 12 (1) in paragraph (1)— 13 (A) in subparagraph (B), by adding at the 14 end the following new sentence: ‘‘The appro-15 priate Federal official may waive the non-Fed-16 eral share requirements of the preceding sen-17 tence if such official determines no reasonable 18 means are available through which the recipient 19 of the Federal share can meet the non-Federal 20 share requirement.’’; 10 ‘‘(IV) reports of human or ani-11 mal illnesses or mortalities during the 12 event; 13 ‘‘(V) any closures of fishing or 14 shellfish harvesting locations or rec-15 reational public waters, including 16 beaches, during the event; 8 ‘‘(II) losses to commercial fish-9 eries and aquaculture industries, 10 recreation and tourism, real estate, 11 and other impacted industries or busi-12 nesses; 13 ‘‘(III) increases in monitoring 14 and management expenditures, includ-15 ing costs incurred for event response 16 and clean-up (such as for beach clean- 17 up following an influx of biomass or a 18 fish-kill) by public or private sectors; and 4 ‘‘(iv) the geographic scope of the hy-5 poxia or harmful algal bloom event, includ-6 ing the potential of the event to affect sev-7 eral municipalities, to affect more than 1 8 State, or to cross an international bound-9 ary.’’;
