To establish the Space National Guard.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Space National Guard 4
Establishment Act of 2025’’. 5
SEC. 2. ESTABLISHMENT OF SPACE NATIONAL GUARD. 6
(a) E
STABLISHMENT.— 7
(1) I
N GENERAL.—There is established a Space 8
National Guard that is part of the organized militia 9
of the States specified in paragraph (3), active and 10
inactive, that— 11

(A) is a space force; 1
(B) is trained, and has its officers ap-2
pointed, under the sixteenth clause of section 8, 3
article I of the Constitution; 4
(C) is organized, armed, and equipped 5
wholly or partly at Federal expense; and 6
(D) is federally recognized. 7
(2) R
ESERVE COMPONENT .—The Space Na-8
tional Guard shall be the reserve component of the 9
Space Force all of whose members are members of 10
the Space National Guard. 11

TATES SPECIFIED.—The States specified 12
in this paragraph are— 13
(A) Alaska. 14
(B) California. 15
(C) Colorado. 16
(D) Florida. 17
(E) Hawaii. 18

N GENERAL.—The Director of Space 24
Operations for the National Guard Bureau shall 25

be transferred to the Space National Guard and 1
be known as the Director of the Space National 2
Guard. 3

ANK.—The Director of the Space 4
National Guard shall carry the rank of Briga-5
dier General and shall report to the Director of 6
the Air National Guard. 7
(2) T
RANSFER OF SPACE OPERATIONS .— 8
(A) I
N GENERAL.—The staff assigned to 9
space operations in the National Guard Bureau 10
and the units specified in subparagraph (B) 11
shall be transferred to the Space National 12
Guard. 13
(B) U
NITS SPECIFIED.—The units speci-14
fied in this subparagraph are the following: 15
(i) 213th Space Warning Squadron, 16
Alaska Air National Guard. 17
(ii) 148th Space Operations Squad-18
ron, California Air National Guard. 19
(iii) 216th Electromagnetic Warfare 20
Squadron, California Air National Guard. 21
(iv) 234th Intelligence Squadron, 22

(A) I
N GENERAL.—There shall be no per-22
sonnel assigned or allocated to the Space Na-23
tional Guard other than the personnel provided 24
for by paragraphs (1) and (2). 25

(B) ASSISTANT ADJUTANT GENERAL .— 1
Each Space National Guard unit shall be orga-2
nized under the Assistant Adjutant General for 3
the Air Force in the State in which the unit is 4
located on the day before the enactment of this 5
Act. 6
(C) E
FFECT ON STATES.—Except as pro-7
vided in paragraphs (1) and (2), no State shall 8
receive any additional personnel, to include any 9
general officer or staff, to assist with the ad-10
ministration and operation of the Space Na-11
tional Guard. 12
SEC. 3. NO EFFECT ON MILITARY FACILITIES, INFRASTRUC-13
TURE, AND INSTALLATIONS. 14
(a) I
NGENERAL.—The Space National Guard shall 15
make use of facilities, infrastructure, and installations 16
constructed before the date of the enactment of this Act. 17
(b) P
ROHIBITION ONNEWCONSTRUCTION.—Except 18
as provided by subsection (a), no additional facility, infra-19
structure, or installation shall be constructed or modified 20
to accommodate the Space National Guard. 21
SEC. 4. IMPLEMENTATION OF SPACE NATIONAL GUARD. 22
(a) R
EQUIREMENT.—Except as specifically provided 23
by this Act, the Secretary of the Air Force and the Chief 24
of the National Guard Bureau shall implement this Act 25

and the amendments made by this Act not later than one 1
year after the date of the enactment of this Act. 2
(b) B
RIEFINGREQUIRED.— 3
(1) I
N GENERAL.—Not later than 90 days after 4
the date of the enactment of this Act, and annually 5
thereafter for 5 years, the Secretary of the Air 6
Force, the Chief of the Space Force, and the Chief 7
of the National Guard Bureau shall jointly provide 8
to the congressional defense committees (as defined 9
in section 101 of title 10, United States Code) a 10
briefing on the status of the implementation of the 11
Space National Guard pursuant to this Act and the 12
amendments made by this Act. 13
(2) E
LEMENTS.—The briefing required by 14
paragraph (1) shall address— 15
(A) the current missions, operations and 16
activities, personnel requirements and status, 17
and budget and funding requirements and sta-18
tus of the Space National Guard; and 19
(B) such other matters with respect to the 20
implementation and operation of the Space Na-21
tional Guard as the Secretary and the Chiefs 22
jointly determine appropriate to keep Congress 23
fully and currently informed on the status of 24

SEC. 5. CONFORMING AMENDMENTS AND CLARIFICATION 3
OF AUTHORITIES. 4
(a) D
EFINITIONS.— 5

ITLE 10, UNITED STATES CODE.—Title 10, 6
United States Code, is amended— 7
(A) in section 101— 8
(i) in subsection (c)— 9
(I) in paragraph (1), by striking 10
‘‘and the Air National Guard’’ and in-11
serting ‘‘, the Air National Guard, 12
and the Space National Guard’’; 13
(II) by redesignating paragraphs 14
(6) and (7) as paragraphs (8) and 15
(9), respectively; and 16
(III) by inserting after paragraph 17
(5) the following new paragraphs: 18
‘‘(6) The term ‘Space National Guard’ means 19
that part of the organized militia of the States speci-20
fied in section 2(a)(3) of the Space National Guard 21
Establishment Act of 2025, active and inactive, 22
that— 23
‘‘(A) is a space force; 24

‘‘§ 10115. Space National Guard of the United States: 1
composition 2
‘‘The Space National Guard of the United States is 3
the reserve component of the Space Force that consists 4
of— 5
‘‘(1) federally recognized units and organiza-6
tions of the Space National Guard; and 7
‘‘(2) members of the Space National Guard who 8
are also Reserves of the Space Force. 9
‘‘§ 10116. Space National Guard: when a component of 10
the Space Force 11
‘‘The Space National Guard while in the service of 12
the United States is a component of the Space Force. 13
‘‘§ 10117. Space National Guard of the United States: 14
status when not in Federal service 15
‘‘When not on active duty, members of the Space Na-16
tional Guard of the United States shall be administered, 17
armed, equipped, and trained in their status as members 18
of the Space National Guard.’’; and 19
(2) in the table of sections at the beginning of 20
such chapter, by adding at the end the following new 21
items: 22
‘‘10115. Space National Guard of the United States: composition.
‘‘10116. Space National Guard: when a component of the Space Force.
‘‘10117. Space National Guard of the United States: status when not in Federal
service.’’.
