17	17	To amend the Foreign Agents Registration Act of 1938,
18	18	as amended to clarify that the obligation of individuals
19	19	who formerly served as agents of foreign principals to
20	20	register as foreign agents under the Act is continuing
21	21	with respect to activities carried out previously on behalf
22	22	of such foreign principals, and for other purposes.
23	23	Be it enacted by the Senate and House of Representa-1
24	24	tives of the United States of America in Congress assembled, 2
25	25	SECTION 1. SHORT TITLE. 3
26	26	This Act may be cited as the ‘‘Foreign Agents Trans-4
27	27	parency Act’’. 5

32	32	REGISTER AS AN AGENT OF A FOREIGN PRIN-2

34	34	(a) O
35	35	BLIGATION.—The third sentence of section 2(a) 4
36	36	of the Foreign Agents Registration Act of 1938, as 5
37	37	amended (22 U.S.C. 612(a)) is amended by striking ‘‘for 6
38	38	the period’’ and inserting ‘‘covering the period’’. 7
39	39	(b) E
40	40	FFECTIVEDATE.—The amendment made by 8
41	41	subsection (a) shall apply with respect to any individual 9
42	42	who serves as the agent of a foreign principal under the 10
43	43	Foreign Agents Registration Act of 1938, as amended (22 11
44	44	U.S.C. 611 et seq.)— 12
45	45	(1) during the 5-year period ending on the date 13
46	46	of enactment of this Act; 14
47	47	(2) on the date of enactment of this Act; or 15
48	48	(3) after the date of enactment of this Act. 16
49	49	SEC. 3. PERMITTING ORDER REQUIRING COMPLIANCE TO 17
50	50	APPLY AFTER FARA ACTIVITIES HAVE 18
51	51	ENDED. 19

53	53	ONTINUALCOMPLIANCE.—Section 8(f) of the 20
54	54	Foreign Agents Registration Act of 1938, as amended (22 21
55	55	U.S.C. 618(f)) is amended— 22
56	56	(1) by inserting after the first sentence the fol-23
57	57	lowing: ‘‘The Attorney General may make applica-24
58	58	tion for an order requiring a person to comply with 25
59	59	any appropriate provision of this Act or any regula-26

63	63	tion thereunder while the person acts as an agent of 1
64	64	a foreign principal or at any time thereafter.’’; and 2
65	65	(2) by striking the period at the end and insert-3
66	66	ing the following: ‘‘, including an order requiring a 4
67	67	person to comply with section 2 with respect to any 5
68	68	period during which the person acts as the agent of 6
69	69	a foreign principal notwithstanding that the person 7
70	70	does not act as the agent of a foreign principal at 8
71	71	the time the court issues the order.’’. 9

73	73	FFECTIVEDATE.—The amendments made by 10
74	74	subsection (a) shall apply with respect to any individual 11
75	75	who serves as the agent of a foreign principal under the 12
76	76	Foreign Agents Registration Act of 1938, as amended (22 13
77	77	U.S.C. 611 et seq.)— 14
78	78	(1) during the 5-year period ending on the date 15
79	79	of enactment of this Act; 16
80	80	(2) on the date of enactment of this Act; or 17
81	81	(3) after the date of enactment of this Act. 18
82	82	SEC. 4. ANNUAL REPORTS RELATING TO COMPLIANCE. 19
83	83	(a) D
84	84	EFINITIONS.—In this section— 20
85	85	(1) the term ‘‘covered action’’ means an action 21
86	86	taken by the Attorney General against a covered in-22
87	87	dividual to enforce the Foreign Agents Registration 23
88	88	Act of 1938, as amended (22 U.S.C. 611 et seq.), 24
89	89	as amended by sections 2 and 3 of this Act; and 25

93	93	(2) the term ‘‘covered individual’’ means an in-1
94	94	dividual who served as the agent of a foreign prin-2
95	95	cipal under the Foreign Agents Registration Act of 3
96	96	1938, as amended (22 U.S.C. 611 et seq.) during 4
97	97	the 5-year period ending on the date of enactment 5
98	98	of this Act. 6
99	99	(b) I
100	100	NGENERAL.—Not later than 1 year after the 7
101	101	date of enactment of this Act, and each year from that 8
102	102	date thereafter, the Attorney General shall submit to the 9
103	103	Committee on the Judiciary and the Committee on For-10
104	104	eign Relations of the Senate and the Committee on the 11
105	105	Judiciary of the House of Representatives, as well as any 12
106	106	other Member of Congress upon request of such Member, 13
107	107	a written, machine-readable report that describes each 14
108	108	covered action taken by the Attorney General. 15
109	109	(c) O
110	110	RGANIZATION.—Each report submitted under 16
111	111	subsection (b) shall be organized by each covered action 17
112	112	taken and shall include, with respect to each covered ac-18
113	113	tion— 19
114	114	(1) the name of each covered individual against 20
115	115	whom the covered action was taken; 21
116	116	(2) a description of the rationale behind taking 22
117	117	the covered action; and 23
118	118	(3) the status of the covered action. 24
