3737 SECTION 1. SHORT TITLE. 1
3838 This Act may be cited as the ‘‘Rights for the Trans-2
3939 portation Security Administration Workforce Act’’ or the 3
4040 ‘‘Rights for the TSA Workforce Act’’. 4
4141 SEC. 2. DEFINITIONS. 5
4242 In this Act— 6
4343 (1) the term ‘‘2022 Determination’’ means the 7
4444 publication, entitled ‘‘Determination on Transpor-8
4545 tation Security Officers and Collective Bargaining’’, 9
4646 issued on December 30, 2022, by Administrator 10
4747 David P. Pekoske, as modified, or any superseding 11
4848 subsequent determination; 12
4949 (2) the term ‘‘adjusted basic pay’’ means— 13
5050 (A) the rate of pay fixed by law or admin-14
5151 istrative action for a position occupied by a cov-15
5252 ered employee before any deductions; and 16
5353 (B) any regular, fixed supplemental pay-17
5454 ment for non-overtime hours of work creditable 18
5555 as basic pay for retirement purposes, including 19
5656 any applicable locality payment and any special 20
5757 rate supplement; 21
5858 (3) the term ‘‘Administration’’ means the 22
5959 Transportation Security Administration; 23
6060 (4) the term ‘‘Administrator’’ means the Ad-24

108108 N GENERAL.—Notwithstanding any other 14
109109 provision of law, effective as of the date of enact-15
110110 ment of this Act— 16
111111 (A) any TSA personnel management sys-17
112112 tem in use for covered employees and covered 18
113113 positions on the day before that date of enact-19
114114 ment, and any personnel management policy, 20
115115 letter, guideline, or directive of the Administra-21
116116 tion in effect on that day, may not be modified; 22
117117 (B) no personnel management policy, let-23
118118 ter, guideline, or directive of the Administration 24
119119 that was not established before that date issued 25

136136 (1)(A), the limitation in that paragraph shall 12
137137 not apply to any personnel management policy, 13
138138 letter, guideline, or directive of the Administra-14
139139 tion relating to annual adjustments to pay 15
140140 schedules and locality-based comparability pay-16
141141 ments in order to maintain parity with those 17
142142 adjustments authorized under sections 5303, 18
143143 5304, 5304a, and 5318 of title 5, United States 19
144144 Code. 20
145145 (B) A
146146 DDITIONAL POLICY .—Notwith-21
147147 standing paragraph (1)(B), new personnel man-22
148148 agement policy of the Administration may be 23
149149 issued if— 24

174174 rity, may be modified or established until 20

198198 of the Administration in effect on the day before the date 13
199199 of enactment of this Act, shall remain in effect until the 14
200200 conversion date. 15

206206 by the Secretary, but in no event later than Decem-19

209209 tems shall cease to be in effect; 22
210210 (B) section 114(n) of title 49, United 23
211211 States Code, is repealed; 24

231231 HAPTERS 71 AND 77 OF TITLE 5 .—Not 16
232232 later than 90 days after the date of enactment of 17
233233 this Act— 18
234234 (A) chapters 71 and 77 of title 5, United 19
235235 States Code, shall apply to covered employees 20
236236 carrying out screening functions pursuant to 21
237237 section 44901 of title 49, United States Code; 22
238238 and 23
239239 (B) any policy, letter, guideline, or direc-24
240240 tive issued under section 111(d) of the Aviation 25

249249 SSISTANCE OF OTHER AGENCIES .—Not 5
250250 later than 180 days after the date of enactment of 6
251251 this Act, or December 31, 2025, whichever is ear-7
252252 lier— 8
253253 (A) the Director of the Office of Personnel 9
254254 Management shall establish a position series 10
255255 and classification standard for the positions of 11
256256 Transportation Security Officer, Federal air 12
257257 marshal, Transportation Security Inspector, 13
258258 and other positions requested by the Adminis-14
259259 trator; and 15
260260 (B) the National Finance Center of the 16
261261 Department of Agriculture shall make nec-17
262262 essary changes to Financial Management Serv-18
263263 ices and Human Resources Management Serv-19
264264 ices to ensure payroll, leave, and other per-20
265265 sonnel processing systems for covered employees 21
266266 are consistent with chapter 53 of title 5, United 22
267267 States Code, and provide functions as needed to 23
268268 implement this Act. 24

270270 AFEGUARDS ON GRIEVANCES ANDAPPEALS.— 25

274274 (1) IN GENERAL.—Each covered employee with 1
275275 a grievance or appeal pending within the Adminis-2
276276 tration on the date of enactment of this Act, or initi-3
277277 ated during the 90-day period beginning on the date 4
278278 of enactment of this Act, may have that grievance 5
279279 or appeal removed to proceedings pursuant to title 6
280280 5, United States Code, or continued within TSA. 7
281281 (2) A
282282 UTHORITY.—With respect to any griev-8
283283 ance or appeal continued within the Administration 9
284284 under paragraph (1), the Administrator may con-10
285285 sider and finally adjudicate that grievance or appeal 11
286286 notwithstanding any other provision of this Act. 12
287287 (3) P
288288 RESERVATION OF RIGHTS .—Notwith-13
289289 standing any other provision of law, any appeal or 14
290290 grievance continued under this subsection that is not 15
291291 finally adjudicated under paragraph (2) shall be pre-16
292292 served and all timelines tolled until the rights af-17
293293 forded by application of chapters 71 and 77 of title 18
294294 5, United States Code, are made available under 19
295295 subsection (c)(2). 20
296296 SEC. 4. TRANSITION RULES. 21

298298 ONREDUCTION IN PAY ANDCOMPENSATION.— 22
299299 Under such pay conversion rules as the Secretary may pre-23
300300 scribe to carry out this Act, a covered employee converted 24
301301 from a TSA personnel management system to the provi-25

307307 (1) may not be subject to any reduction in ei-3
308308 ther the rate of adjusted basic pay payable or law 4
309309 enforcement availability pay payable to that covered 5
310310 employee; and 6
311311 (2) shall be credited for years of service in a 7
312312 specific pay band under a TSA personnel manage-8
313313 ment system as if the covered employee had served 9
314314 in an equivalent General Schedule position at the 10
315315 same grade, for purposes of determining the appro-11
316316 priate step within a grade at which to establish the 12
317317 converted rate of pay of the covered employee. 13

319319 ETIREMENTPAY.— 14
320320 (1) I
321321 N GENERAL.—Not later than 90 days after 15
322322 the date of enactment of this Act, the Secretary 16
323323 shall submit to the appropriate congressional com-17
324324 mittees a proposal, including proposed legislative 18
325325 changes if needed, for determining the average pay 19
326326 of any covered employee who retires not later than 20
327327 3 years after the conversion date for purposes of cal-21
328328 culating the retirement annuity of the covered em-22
329329 ployee. 23

333333 (2) REQUIREMENTS.—The proposal required 1
334334 under paragraph (1) shall be structured in a manner 2
335335 that— 3
336336 (A) is consistent with title 5, United States 4
337337 Code; and 5
338338 (B) appropriately accounts for the service 6
339339 of a covered employee to which the proposal ap-7
340340 plies, and the annual rate of basic pay of such 8
341341 a covered employee, following the conversion 9
342342 date. 10

344344 IMITATION ONPREMIUMPAY.— 11
345345 (1) I
346346 N GENERAL.—Notwithstanding section 12
347347 5547 of title 5, United States Code, or any other 13
348348 provision of law, a Federal air marshal or criminal 14
349349 investigator who is appointed to that position before 15
350350 the date of enactment of this Act may be eligible for 16
351351 premium pay up to the maximum level allowed by 17
352352 the Administrator before the date of enactment of 18
353353 this Act. 19
354354 (2) OPM
355355 RECOGNITION.—The Director of the 20
356356 Office of Personnel Management shall recognize pre-21
357357 mium pay paid pursuant to paragraph (1) as fully 22
358358 creditable for the purposes of calculating pay and re-23
359359 tirement benefits. 24

369369 (A) in subsection (a)(2), in the matter pre-6
370370 ceding subparagraph (A), by striking ‘‘sub-7
371371 section (k)’’ and inserting ‘‘subsection (l)’’; 8
372372 (B) by redesignating subsection (k) as sub-9
373373 section (l); and 10
374374 (C) by inserting after subsection (j) the 11
375375 following: 12
376376 ‘‘(k) The provisions of subsections (a) through (h) 13
377377 providing for availability pay shall apply to any Federal 14
378378 air marshal who is an employee of the Transportation Se-15
379379 curity Administration.’’. 16

381381 VERTIME.—Section 5542 of title 5, United 17
382382 States Code, is amended by adding at the end the 18
383383 following: 19
384384 ‘‘(i) Notwithstanding any other provision of law, a 20
385385 Federal air marshal who is an employee of the Transpor-21
386386 tation Security Administration shall receive overtime pay 22
387387 under this section, at such a rate and in such a manner 23
388388 so that such Federal air marshal does not receive less 24
389389 overtime pay than such Federal air marshal would receive 25

394394 provisions of section 7 of the Fair Labor Standards Act 2
395395 of 1938 (29 U.S.C. 207).’’. 3

397397 FFECTIVE DATE.—The amendments made 4
398398 by paragraphs (1) and (2) shall apply beginning on 5
399399 the conversion date. 6

401401 OLLECTIVE BARGAINING UNIT.—Notwith-7
402402 standing section 7112 of title 5, United States Code, fol-8
403403 lowing the application of chapter 71 of that title pursuant 9
404404 to section 3(c)(2) of this Act, screening agents shall re-10
405405 main eligible to form a collective bargaining unit. 11

407407 RESERVATION OF OTHERRIGHTS.—The Sec-12
408408 retary shall take any actions necessary to ensure that the 13
409409 following rights are preserved and available for each cov-14
410410 ered employee beginning on the conversion date, and for 15
411411 any covered employee appointed after the conversion date, 16
412412 and continue to remain available to covered employees 17
413413 after the conversion date: 18
414414 (1) Any annual leave, sick leave, or other paid 19
415415 leave accrued, accumulated, or otherwise available to 20
416416 a covered employee immediately before the conver-21
417417 sion date shall remain available to the covered em-22
418418 ployee until used, subject to any limitation on accu-23
419419 mulated leave under chapter 63 of title 5, United 24
420420 States Code. 25

426426 the same basis as full-time covered employees. 3
427427 (3) Notwithstanding section 6329a of title 5, 4
428428 United States Code, covered employees are provided 5
429429 appropriate leave during national emergencies to as-6
430430 sist the covered employees and ensure the Adminis-7
431431 tration meets mission requirements. 8
432432 (4) Eligible screening agents receive a split-shift 9
433433 differential for regularly scheduled split-shift work 10
434434 as well as regularly scheduled overtime and irregular 11
435435 and occasional split-shift work. 12
436436 (5) Notwithstanding sections subsections (c), 13
437437 (e), and (f) of section 5754 of title 5, United States 14
438438 Code, eligible covered employees receive group reten-15
439439 tion incentives, as appropriate. 16
440440 SEC. 5. CONSULTATION REQUIREMENT. 17

442442 XCLUSIVEREPRESENTATIVE.— 18

446446 PPLICATION.—Beginning on the date 20
447447 that chapter 71 of title 5, United States Code 21
448448 (referred to in this subsection as ‘‘chapter 71’’), 22
449449 begins to apply to covered employees under sec-23
450450 tion 3(c)(2), the labor organization certified by 24
451451 the Federal Labor Relations Authority on June 25

461461 ULE OF CONSTRUCTION .—Nothing in 6
462462 this subsection may be construed to prevent 7
463463 covered employees from selecting an exclusive 8
464464 representative other than the labor organization 9
465465 described in paragraph (1) for purposes of col-10
466466 lective bargaining under chapter 71. 11

468468 ATIONAL LEVEL.— 12
469469 (A) I
470470 N GENERAL.—Notwithstanding any 13
471471 provision of chapter 71, collective bargaining 14
472472 for any unit of covered employees shall occur at 15
473473 the national level, but may be supplemented by 16
474474 local level bargaining and local level agreements 17
475475 in furtherance of elements of a national agree-18

624624 tion with respect to harassment and assault in the 17
625625 workplace, such as incidents— 18
626626 (A) of sexual harassment and violence and 19
627627 harassment and violence motivated by the per-20
628628 ceived race, ethnicity, religion, gender identity, 21
629629 or sexuality of an individual; and 22
630630 (B) in which the alleged perpetrator is a 23
631631 member of the general public. 24

650650 PPORTUNITY FOR COMMENT .—In con-15

653653 provide opportunities for covered employees of all 18
654654 levels and positions, and labor organizations and as-19
655655 sociations representing those covered employees, to 20
656656 submit comments, including in an anonymous form, 21
657657 and take those comments into account in the final 22
658658 recommendations of the Comptroller General. 23

698698 (1) Reports to the Administrator of instances of 8
699699 physical or verbal assaults or threats made by mem-9
700700 bers of the general public against screening agents 10
701701 since January 1, 2019. 11
702702 (2) Procedures for reporting the assaults and 12
703703 threats described in paragraph (1), including infor-13
704704 mation on how the Administrator communicates the 14
705705 availability of those procedures. 15
706706 (3) Any steps taken by the Administration to 16
707707 prevent and respond to the assaults and threats de-17
708708 scribed in paragraph (1). 18
709709 (4) Any related civil actions and criminal refer-19
710710 rals made annually since January 1, 2019. 20
711711 (5) Any additional authorities needed by the 21
712712 Administrator to better prevent or respond to the as-22
713713 saults and threats described in paragraph (1). 23
