2020 This Act may be cited as the ‘‘Public Health Im-4

2222 SEC. 2. TERMS OF CDC AND NIH DIRECTORS. 6

2525 the Public Health Service Act (42 U.S.C. 242c(a)) is 8

3939 Section 305(c)(2)(A) of the Public Health Service Act 9
4040 (42 U.S.C. 242c(c)(2)(A)) is amended— 10
4141 (1) in clause (i), by striking ‘‘and noncommu-11
4242 nicable diseases or conditions, and addressing inju-12
4343 ries, and occupational and environmental hazards’’ 13
4444 and inserting ‘‘diseases’’; 14
4545 (2) in clause (ii), by striking ‘‘or conditions’’; 15
4646 (3) in clause (iii), by adding ‘‘and’’ at the end; 16
4747 (4) in clause (iv), by striking ‘‘; and’’ and in-17
4848 serting a semicolon; and 18
4949 (5) by striking clause (v). 19
5050 SEC. 4. ADVISORY COMMITTEE TO THE CDC DIRECTOR. 20
5151 Section 305A(c) of the Public Health Service Act (42 21

8585 Section 361(a) of the Public Health Service Act (42 5
8686 U.S.C. 264(a)) is amended to read as follows: 6
8787 ‘‘(a) To prevent the introduction, transmission, or 7
8888 spread of communicable diseases from foreign countries 8
8989 into the States or possessions, or from one State or posses-9
9090 sion into any other State or possession, the Secretary may 10
9191 make and enforce regulations for the inspection, fumiga-11
9292 tion, disinfection, sanitation, pest extermination, or de-12
9393 struction of animals or articles found to be so infected or 13
9494 contaminated as to be sources of dangerous infection to 14
9595 human beings.’’. 15
9696 SEC. 6. CONGRESSIONAL APPROVAL FOR PUBLIC HEALTH 16
9797 EMERGENCIES. 17
9898 Section 319(a) of the Public Health Service Act (42 18
9999 U.S.C. 247d(a)) is amended by striking the third and 19
100100 fourth sentences and inserting the following: ‘‘Determina-20
101101 tions that terminate under the preceding sentence may be 21
102102 renewed by a majority vote in both chambers of Congress, 22
103103 and such a renewal period terminates upon the Secretary 23
104104 declaring that the emergency no longer exists or the expi-24
105105 ration of the 90-day period beginning on the date on which 25
106106 both chambers of Congress have voted in favor of such 26

110110 renewal, whichever occurs first. Not later than 48 hours 1
111111 after making a determination under this subsection of a 2
112112 public health emergency, the Secretary shall submit to the 3
113113 Congress written notification of the determination.’’. 4
114114 SEC. 7. TRANSFER OF OFFICES TO NIH. 5
115115 (a) I
116116 NGENERAL.—Effective on the date that is 2 6
117117 years after the date of enactment of this Act, notwith-7
118118 standing any other provision of law, the authorities, func-8
119119 tions, personnel, and assets of the offices described in sub-9
120120 section (b) shall be transferred from the Centers for Dis-10
121121 ease Control and Prevention to the National Institutes of 11
122122 Health. 12

145145 Not later than 90 days after the date of enactment 6
146146 of this Act, the Secretary of Health and Human Services 7
147147 shall issue such new or revised regulations as are nec-8
148148 essary to carry out this Act (including the amendments 9
149149 made by this Act). 10
150150 SEC. 9. PREEMPTION. 11
151151 The provisions of this Act (including the amendments 12
152152 made by this Act) shall supersede any provision of Fed-13
153153 eral, State, Tribal, territorial, or local law, declaration, 14
154154 guidance, or directive to the extent that such law, declara-15
155155 tion, guidance, or directive is inconsistent with this Act 16
156156 (including such amendments). 17
