14	14	To reform the Centers for Disease Control and Prevention,
15	15	limit the scope of public health authorities, and for other
16	16	purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Public Health Im-4
21	21	provement Act’’. 5
22	22	SEC. 2. TERMS OF CDC AND NIH DIRECTORS. 6
23	23	(a) T
24	24	ERM OFCDC DIRECTOR.—Section 305(a) of 7
25	25	the Public Health Service Act (42 U.S.C. 242c(a)) is 8
26	26	amended by adding at the end the following: ‘‘No indi-9

33	33	ERM OFNIH DIRECTOR.—Section 402(a) of the 3
34	34	Public Health Service Act (42 U.S.C. 282(a)) is amended 4
35	35	by adding at the end the following: ‘‘No individual may 5
36	36	serve as Director of NIH for a total period of more than 6
37	37	12 years.’’. 7
38	38	SEC. 3. LIMITING THE CDC STRATEGIC PLAN. 8
39	39	Section 305(c)(2)(A) of the Public Health Service Act 9
40	40	(42 U.S.C. 242c(c)(2)(A)) is amended— 10
41	41	(1) in clause (i), by striking ‘‘and noncommu-11
42	42	nicable diseases or conditions, and addressing inju-12
43	43	ries, and occupational and environmental hazards’’ 13
44	44	and inserting ‘‘diseases’’; 14
45	45	(2) in clause (ii), by striking ‘‘or conditions’’; 15
46	46	(3) in clause (iii), by adding ‘‘and’’ at the end; 16
47	47	(4) in clause (iv), by striking ‘‘; and’’ and in-17
48	48	serting a semicolon; and 18
49	49	(5) by striking clause (v). 19
50	50	SEC. 4. ADVISORY COMMITTEE TO THE CDC DIRECTOR. 20
51	51	Section 305A(c) of the Public Health Service Act (42 21
52	52	U.S.C. 242c–1(c)) is amended— 22
53	53	(1) in paragraph (1), by striking ‘‘by the Sec-23
54	54	retary under’’ and inserting ‘‘as described in’’; and 24

85	85	Section 361(a) of the Public Health Service Act (42 5
86	86	U.S.C. 264(a)) is amended to read as follows: 6
87	87	‘‘(a) To prevent the introduction, transmission, or 7
88	88	spread of communicable diseases from foreign countries 8
89	89	into the States or possessions, or from one State or posses-9
90	90	sion into any other State or possession, the Secretary may 10
91	91	make and enforce regulations for the inspection, fumiga-11
92	92	tion, disinfection, sanitation, pest extermination, or de-12
93	93	struction of animals or articles found to be so infected or 13
94	94	contaminated as to be sources of dangerous infection to 14
95	95	human beings.’’. 15
96	96	SEC. 6. CONGRESSIONAL APPROVAL FOR PUBLIC HEALTH 16
97	97	EMERGENCIES. 17
98	98	Section 319(a) of the Public Health Service Act (42 18
99	99	U.S.C. 247d(a)) is amended by striking the third and 19
100	100	fourth sentences and inserting the following: ‘‘Determina-20
101	101	tions that terminate under the preceding sentence may be 21
102	102	renewed by a majority vote in both chambers of Congress, 22
103	103	and such a renewal period terminates upon the Secretary 23
104	104	declaring that the emergency no longer exists or the expi-24
105	105	ration of the 90-day period beginning on the date on which 25
106	106	both chambers of Congress have voted in favor of such 26

110	110	renewal, whichever occurs first. Not later than 48 hours 1
111	111	after making a determination under this subsection of a 2
112	112	public health emergency, the Secretary shall submit to the 3
113	113	Congress written notification of the determination.’’. 4
114	114	SEC. 7. TRANSFER OF OFFICES TO NIH. 5
115	115	(a) I
116	116	NGENERAL.—Effective on the date that is 2 6
117	117	years after the date of enactment of this Act, notwith-7
118	118	standing any other provision of law, the authorities, func-8
119	119	tions, personnel, and assets of the offices described in sub-9
120	120	section (b) shall be transferred from the Centers for Dis-10
121	121	ease Control and Prevention to the National Institutes of 11
122	122	Health. 12

125	125	this subsection are the following: 14
126	126	(1) The National Center on Birth Defects and 15
127	127	Developmental Disabilities. 16

145	145	Not later than 90 days after the date of enactment 6
146	146	of this Act, the Secretary of Health and Human Services 7
147	147	shall issue such new or revised regulations as are nec-8
148	148	essary to carry out this Act (including the amendments 9
149	149	made by this Act). 10
150	150	SEC. 9. PREEMPTION. 11
151	151	The provisions of this Act (including the amendments 12
152	152	made by this Act) shall supersede any provision of Fed-13
153	153	eral, State, Tribal, territorial, or local law, declaration, 14
154	154	guidance, or directive to the extent that such law, declara-15
155	155	tion, guidance, or directive is inconsistent with this Act 16
156	156	(including such amendments). 17
