2020 Supporting the Local Radio Freedom Act.
2121 Whereas the United States enjoys broadcasting and sound re-
2222 cording industries that are the envy of the world due to
2323 the mutually beneficial relationship that has existed
2424 among these industries for many decades;
2525 Whereas, for nearly a century, Congress has rejected re-
2626 peated calls by the recording industry to impose a per-
2727 formance fee on local radio stations for simply playing
2828 music on the radio, as such a fee would upset the mutu-
2929 ally beneficial relationship between local radio and the re-
3030 cording industry;
3131 Whereas local radio stations provide free publicity and pro-
3232 motion to the recording industry and performers of music

3636 in the form of radio airplay, interviews with performers,
3737 introduction of new performers, concert promotions, and
3838 publicity that promotes the sale of music, concert tickets,
3939 ring tones, music videos, and associated merchandise;
4040 Whereas committees in the Senate and the House of Rep-
4141 resentatives have previously reported that ‘‘the sale of
4242 many sound recordings and the careers of many per-
4343 formers have benefitted considerably from airplay and
4444 other promotional activities provided by both noncommer-
4545 cial and advertiser-supported, free over-the-air broad-
4646 casting’’;
4747 Whereas local radio broadcasters provide tens of thousands of
4848 hours of essential local news and weather information
4949 during times of national emergencies and natural disas-
5050 ters, as well as public affairs programming, sports, and
5151 hundreds of millions of dollars worth of time for public
5252 service announcements and local fundraising efforts for
5353 worthy charitable causes, all of which are jeopardized if
5454 local radio stations are forced to divert revenues to pay
5555 for a new performance fee;
5656 Whereas there are many thousands of local radio stations
5757 that will suffer severe economic hardship if any new per-
5858 formance fee is imposed, as will many other small busi-
5959 nesses that play music, including bars, restaurants, retail
6060 establishments, sports and other entertainment venues,
6161 shopping centers, and transportation facilities; and
6262 Whereas the hardship that would result from a new perform-
6363 ance fee would hurt businesses in the United States and
6464 ultimately the consumers in the United States who rely
6565 on local radio for news, weather, and entertainment, and
6666 such a performance fee is not justified when the current
6767 system has produced the most prolific and innovative

7171 broadcasting, music, and sound recording industries in
7272 the world: Now, therefore, be it
7373 Resolved by the Senate (the House of Representatives 1
7474 concurring), That Congress should not impose any new 2
7575 performance fee, tax, royalty, or other charge— 3
7676 (1) relating to the public performance of sound 4
7777 recordings on a local radio station for broadcasting 5
7878 sound recordings over the air; or 6
7979 (2) on any business for the public performance 7
8080 of sound recordings on a local radio station broad-8
8181 cast over the air. 9
