2020 Affirming the rule of law and the legitimacy of judicial
2121 review.
2222 Whereas the Constitution of the United States establishes 3
2323 separate but equal branches of Government;
2424 Whereas Article III of the Constitution of the United States
2525 vests the ‘‘judicial Power of the United States . . . in one
2626 supreme Court, and in such inferior Courts as the Con-
2727 gress may from time to time ordain and establish’’;
2828 Whereas the Supreme Court of the United States, in
2929 Marbury v. Madison, established the principle of judicial
3030 review, which empowers Federal courts to hold that a leg-
3131 islative or executive act violates the Constitution of the
3232 United States;

3636 Whereas Vice President Vance and other prominent elected
3737 officials have made remarks suggesting the President or
3838 the executive branch may ignore the constitutional au-
3939 thority of the Federal Judiciary and disregard a decision
4040 of a Federal court; and
4141 Whereas the President or the executive branch ignoring the
4242 constitutional authority of the Federal Judiciary and dis-
4343 regarding a decision of a Federal court would precipitate
4444 a constitutional crisis: Now, therefore, be it
4545 Resolved, That the Senate affirms that— 1
4646 (1) Article III of the Constitution of the United 2
4747 States vests the ‘‘judicial Power of the United States 3
4848 . . . in one supreme Court, and in such inferior 4
4949 Courts as the Congress may from time to time or-5
5050 dain and establish’’; 6
5151 (2) as Chief Justice Marshall held in the Su-7
5252 preme Court’s landmark 1803 decision Marbury v. 8
5353 Madison, ‘‘It is emphatically the province and duty 9
5454 of the judicial department to say what the law is’’; 10
5555 and 11
5656 (3) the Constitution of the United States and 12
5757 established precedent require the executive branch to 13
5858 comply with all Federal court rulings. 14
