(Cherry) Representative Andrew Stoddard proposes the following substitute bill: 1 MENTAL HEALTH SUPPORT AND LAW ENFORCEMENT 2 CO-RESPONSE 3 2023 GENERAL SESSION 4 STATE OF UTAH 5 Chief Sponsor: Andrew Stoddard 6 Senate Sponsor: Stephanie Pitcher 7 8LONG TITLE 9General Description: 10 This bill requires the Division of Integrated Healthcare to establish a grant program to 11fund best practice crisis intervention teams. 12Highlighted Provisions: 13 This bill: 14 <requires the Division of Integrated Healthcare to establish a grant program to fund 15best practice crisis intervention teams; and 16 <requires tracking and reporting of activities and outcomes funded through the grant 17program. 18Money Appropriated in this Bill: 19 This bill appropriates for fiscal year 2024: 20 <to the Department of Health and Human Services - Integrated Health Care Services, 21as a one-time appropriation: 22 Cfrom the General Fund, One-time, $2,000,000. 23Other Special Clauses: 24 None 25Utah Code Sections Affected: *HB0029S03* 3rd Sub. (Cherry) H.B. 29 02-06-23 2:14 PM - 2 - 26ENACTS: 27 26B-4-102, Utah Code Annotated 1953 28 29Be it enacted by the Legislature of the state of Utah: 30 Section 1. Section 26B-4-102 is enacted to read: 31 26B-4-102. Best practice crisis intervention team grant program. 32 (1) As used in this section: 33 (a) "Best practice crisis intervention team" means a team created under a best practice 34crisis intervention team program that: 35 (i) is comprised of law enforcement officers and mental health professionals certified 36by the division; and 37 (ii) is intended to support an outcome for an individual in crisis that: 38 (A) increases engagement with appropriate community resources and services; and 39 (B) reduces the likelihood of commitment, hospitalization, or incarceration. 40 (b) "Best practice crisis intervention team program" means a community partnership 41between law enforcement, mental health systems, and advocates to improve mental health and 42substance use crisis response through best practice crisis intervention teams. 43 (c) "Division" means the Division of Integrated Healthcare created in Section 4426B-1-204. 45 (d) "Law enforcement officer" means the same as that term is defined in Section 4653-13-103. 47 (e) "Local law enforcement agency" means the same as that term is defined in Section 4853-13-101. 49 (f) "Mobile crisis outreach team" means the same as that term is defined in Section 5062A-15-102. 51 (2) (a) The division shall establish and administer a grant program for local law 52enforcement agencies to create or expand a best practice crisis intervention program. 53 (b) A law enforcement agency awarded a grant under this section shall use the grant to 54assist best practice crisis intervention teams to respond to an incident upon request of a mobile 55crisis outreach team or if a mobile crisis outreach team is not available. 56 (3) A law enforcement agency that submits a proposal for a grant to the division shall 02-06-23 2:14 PM 3rd Sub. (Cherry) H.B. 29 - 3 - 57include in the proposal: 58 (a) a plan for creating or expanding the law enforcement agency's best practice crisis 59intervention program; 60 (b) any funding sources in addition to the grant for the proposal; 61 (c) any existing or planned partnerships between the law enforcement agency and 62another entity to implement the proposal; and 63 (d) other information the division determines necessary to evaluate the proposal. 64 (4) The division: 65 (a) shall establish data tracking and reporting requirements for a local law enforcement 66agency that receives a grant that includes: 67 (i) activities; 68 (ii) outcomes; and 69 (iii) collaborations; and 70 (b) may make rules in accordance with Title 63G, Chapter 3, Utah Administrative 71Rulemaking Act, to establish: 72 (i) standards, qualifications, and training requirements for the certification of best 73practice crisis intervention teams providing services under a best practice intervention program; 74and 75 (ii) (A) eligibility criteria for a grant; 76 (B) the form and process for submitting a proposal to the division for a grant; 77 (C) the method and formula for determining a grant amount; and 78 (D) reporting requirements for a grant recipient. 79 Section 2. Appropriation. 80 The following sums of money are appropriated for the fiscal year beginning July 1, 812023, and ending June 30, 2024. These are additions to amounts previously appropriated for 82fiscal year 2024. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures 83Act, the Legislature appropriates the following sums of money from the funds or accounts 84indicated for the use and support of the government of the state of Utah. 85ITEM 1 86To Department of Health and Human Services - Integrated Health Care Services 87 From General Fund, One-time 2,000,000 3rd Sub. (Cherry) H.B. 29 02-06-23 2:14 PM - 4 - 88 Schedule of Programs: 89 Non-Medicaid Behavioral Health Treatment and 90 Crisis Response 2,000,000 91 The Legislature intends that: 92 (1) the appropriation under this item be used to award grants under Section 26B-4-102; 93and 94 (2) under Section 63J-1-603, the appropriation under this item not lapse at the close of 95fiscal year 2024 and the use of any nonlapsing funds is limited to the purposes described in 96Subsection (1) of this item.
