1313 8General Description:
1414 9 This bill addresses the rural county health care facilities tax.

2929 24Be it enacted by the Legislature of the state of Utah:
3030 25 Section 1. Section 59-12-801 is amended to read:
3131 26 59-12-801. Definitions.
3232 27 As used in this part:

3535 28 (1) "Emergency medical services" [is as] means the same as that term is defined in
3636 29Section 26-8a-102.
3737 30 (2) "Federally qualified health center" is as defined in 42 U.S.C. Sec. 1395x.
3838 31 (3) "Freestanding urgent care center" means a facility that provides outpatient health
3939 32care service:
4040 33 (a) on an as-needed basis, without an appointment;
4141 34 (b) to the public;
4242 35 (c) for the diagnosis and treatment of a medical condition if that medical condition
4343 36does not require hospitalization or emergency intervention for a life threatening or potentially
4444 37permanently disabling condition; and
4545 38 (d) including one or more of the following services:
4646 39 (i) a medical history physical examination;
4747 40 (ii) an assessment of health status; or
4848 41 (iii) treatment:
4949 42 (A) for a variety of medical conditions; and
5050 43 (B) that is commonly offered in a physician's office.
5151 44 (4) "Nursing care facility" [is as] means the same as that term is defined in Section
5252 4526-21-2.
5353 46 (5) "Rural city hospital" means a hospital owned by a city that is located within a third,
5454 47fourth, fifth, or sixth class county.
5555 48 (6) "Rural county health care facility" means a:
5656 49 (a) rural county hospital; or
5757 50 (b) rural county nursing care facility.
5858 51 (7) "Rural county hospital" means a hospital owned by a county that is:
5959 52 (a) a third, fourth, fifth, or sixth class county, as defined in Section 17-50-501; and
6060 53 (b) located outside of a standard metropolitan statistical area, as designated by the
6161 54United States Bureau of the Census.
6262 55 (8) "Rural county nursing care facility" means a nursing care facility owned by:
6363 56 (a) a county that is:
6464 57 (i) a third, fourth, fifth, or sixth class county, as defined in Section 17-50-501; and
6565 58 (ii) located outside of a standard metropolitan statistical area, as designated by the 02-03-23 3:19 PM H.B. 391

6767 59United States Census Bureau; or
6868 60 (b) a special service district if the special service district is:
6969 61 (i) created for the purpose of operating the nursing care facility; and
7070 62 (ii) within a county that is:
7171 63 (A) a third, fourth, fifth, or sixth class county, as defined in Section 17-50-501; and
7272 64 (B) located outside of a standard metropolitan statistical area, as designated by the
7373 65United States Census Bureau.
7474 66 (9) "Rural emergency medical services" means emergency medical services that are
7575 67provided by a county that is:
7676 68 (a) a [fifth] third, fourth, fifth, or sixth class county, as defined in Section 17-50-501;
7777 69and
7878 70 (b) located outside of a standard metropolitan statistical area, as designated by the
7979 71United States Census Bureau.
8080 72 (10) "Rural health clinic" is as defined in 42 U.S.C. Sec. 1395x.
