1414 9 This bill addresses construction groundbearing equipment requirements.

3131 26Be it enacted by the Legislature of the state of Utah:
3232 27 Section 1. Section 15A-6-301 is enacted to read:

3535 28 Part 3. Groundbearing Equipment Requirements
3636 29 15A-6-301. Groundbearing equipment geotechnical report.
3737 30 (1) As used in this section, "groundbearing equipment" means a power-operated
3838 31machine used in construction, demolition, or excavation work.
3939 32 (2) Before using groundbearing equipment for a construction project on real property,
4040 33the owner of the real property shall:
4141 34 (a) obtain a geotechnical report detailing whether the existing soil and subgrade
4242 35conditions of the real property are able to support the groundbearing equipment in addition to
4343 36the other equipment or materials to be used or structures to be built as part of the project; and
4444 37 (b) if the owner determines from the geotechnical report that the soil and subgrade
4545 38conditions on the real property are unable to support the groundbearing equipment in addition
4646 39to the other equipment, materials, and structures, develop or design a solution to ensure the
4747 40support.
