66-45Be it enacted by the Legislature of the state of Utah:
67-46 Section 1. Section 53E-7-402 is amended to read:
68-47 53E-7-402. Special Needs Opportunity Scholarship Program.
69-48 (1) There is established the Special Needs Opportunity Scholarship Program under
70-49which a parent may apply to a scholarship granting organization on behalf of the parent's
71-50student for a scholarship to help cover the cost of a scholarship expense.
72-51 (2) (a) A scholarship granting organization shall:
73-52 (i) award, in accordance with this part, scholarships to eligible students; and
74-53 (ii) determine the amount of a scholarship in accordance with Subsection (3).
75-54 (b) In awarding scholarships, a scholarship granting organization shall give priority to

42+35Be it enacted by the Legislature of the state of Utah:
43+36 Section 1. Section 53E-7-402 is amended to read:
44+37 53E-7-402. Special Needs Opportunity Scholarship Program.
45+38 (1) There is established the Special Needs Opportunity Scholarship Program under
46+39which a parent may apply to a scholarship granting organization on behalf of the parent's
47+40student for a scholarship to help cover the cost of a scholarship expense.
48+41 (2) (a) A scholarship granting organization shall:
49+42 (i) award, in accordance with this part, scholarships to eligible students; and
50+43 (ii) determine the amount of a scholarship in accordance with Subsection (3).
51+44 (b) In awarding scholarships, a scholarship granting organization shall give priority to
52+45an eligible student described in Subsection 53E-7-401(1)(a) by:
53+46 (i) establishing an August 10 deadline for an eligible student described in Subsection
54+4753E-7-401(1)(b) to apply for a scholarship; and
55+48 (ii) awarding a scholarship to an eligible student described in Subsection
56+4953E-7-401(1)(b) only if funds exist after awarding scholarships to all eligible students
57+50described in Subsection 53E-7-401(1)(a) who have applied and qualify.
58+51 (c) Subject to available funds, a scholarship awarded to an eligible student described in
59+52Subsection 53E-7-401(1)(b) shall be for a similar term as a scholarship awarded to the eligible
60+53student's sibling.
61+54 (3) A scholarship granting organization shall determine a full-year scholarship award to
62+55pay for the cost of one or more scholarship expenses in an amount not more than:
63+56 (a) for an eligible student described in Subsection 53E-7-401(1)(a) who is[:]
64+57 [(i)] in grades 1 through 12 with an IEP and whose family income is:
65+58 [(A)] (i) at or below 185% of the federal poverty level, the value of the weighted pupil 02-14-23 4:43 PM H.B. 477

78-56 (i) establishing an August 10 deadline for an eligible student described in Subsection
79-5753E-7-401(1)(b) to apply for a scholarship; and
80-58 (ii) awarding a scholarship to an eligible student described in Subsection
81-5953E-7-401(1)(b) only if funds exist after awarding scholarships to all eligible students
82-60described in Subsection 53E-7-401(1)(a) who have applied and qualify.
83-61 (c) Subject to available funds, a scholarship awarded to an eligible student described in
84-62Subsection 53E-7-401(1)(b) shall be for a similar term as a scholarship awarded to the eligible
85-63student's sibling.
86-64 (3) A scholarship granting organization shall determine a full-year scholarship award to
87-65pay for the cost of one or more scholarship expenses in an amount not more than:
88-66 (a) for an eligible student described in Subsection 53E-7-401(1)(a) who is[:]
89-67 [(i)] in grades 1 through 12 with an IEP and whose family income is:
90-68 [(A)] (i) at or below 185% of the federal poverty level, the value of the weighted pupil
91-69unit multiplied by 2.5;
92-70 [(B)] (ii) between 185% and 555% of the federal poverty level, the value of the
93-71weighted pupil unit multiplied by two; or
94-72 [(C)] (iii) above 555% of the federal poverty level, the value of the weighted pupil unit
95-73multiplied by 1.5;
96-74 (b) for a fiscal year before July 1, 2023, for an eligible student who is:
97-75 [(ii)] (i) in grades 1 through 12 and who does not have an IEP, the value of the
98-76weighted pupil unit;
99-77 [(iii)] (ii) in kindergarten with an IEP, the value of the weighted pupil unit; or
100-78 [(iv)] (iii) in kindergarten and who does not have an IEP, half the value of the weighted
101-79pupil unit; [or]
102-80 [(b)] (c) for a fiscal year beginning on or after July 1, 2023, for an eligible student in
103-81kindergarten or grades 1 through 12, the value of the weighted pupil unit; or
104-82 (d) for an eligible student described in Subsection 53E-7-401(1)(b), half the value of

67+59unit multiplied by 2.5;
68+60 [(B)] (ii) between 185% and 555% of the federal poverty level, the value of the
69+61weighted pupil unit multiplied by two; or
70+62 [(C)] (iii) above 555% of the federal poverty level, the value of the weighted pupil unit
71+63multiplied by 1.5;
72+64 (b) for a fiscal year before July 1, 2023, for an eligible student who is:
73+65 [(ii)] (i) in grades 1 through 12 and who does not have an IEP, the value of the
74+66weighted pupil unit;
75+67 [(iii)] (ii) in kindergarten with an IEP, the value of the weighted pupil unit; or
76+68 [(iv)] (iii) in kindergarten and who does not have an IEP, half the value of the weighted
77+69pupil unit; [or]
78+70 [(b)] (c) for a fiscal year beginning on or after July 1, 2023, for an eligible student in
79+71kindergarten or grades 1 through 12, the value of the weighted pupil unit; or
80+72 (d) for an eligible student described in Subsection 53E-7-401(1)(b), half the value of
81+73the weighted pupil unit.
82+74 (4) Eligibility for a scholarship as determined by a multidisciplinary evaluation team
83+75under this program does not establish eligibility for an IEP under the Individuals with
84+76Disabilities Education Act, Subchapter II, 20 U.S.C. Secs. 1400 to 1419, and is not binding on
85+77any LEA that is required to provide an IEP under the Individuals with Disabilities Education
86+78Act.
87+79 (5) The scholarship granting organizations shall prepare and disseminate information
88+80on the program to a parent applying for a scholarship on behalf of a student.
89+81 Section 2. Section 53F-2-302 is amended to read:
90+82 53F-2-302. Determination of weighted pupil units.
91+83 (1) The number of weighted pupil units in the Minimum School Program for each year
92+84is the total of the units for each school district and, subject to Subsection [(4)] (5), charter
93+85school, determined [as follows:] in accordance with this section.
94+86 [(1)] (2) The number of weighted pupil units is computed by adding the average daily
95+87membership of all pupils of the school district or charter school attending schools, other than
96+88[kindergarten and] self-contained classes for children with a disability.

107-84 (4) Eligibility for a scholarship as determined by a multidisciplinary evaluation team
108-85under this program does not establish eligibility for an IEP under the Individuals with
109-86Disabilities Education Act, Subchapter II, 20 U.S.C. Secs. 1400 to 1419, and is not binding on
110-87any LEA that is required to provide an IEP under the Individuals with Disabilities Education
111-88Act.

125-102school enrolled in kindergarten.
126-103 (b) The number of weighted pupil units is computed by [adding] multiplying the
127-104average daily membership [of all pupils of the school district or charter school enrolled in
128-105kindergarten and multiplying the total] for the number of students who are enrolled in
129-106kindergarten for less than the equivalent length of the schedule for grades 1 through 3, based on
130-107the October 1 data described in Section 53F-2-302, by .55.
131-108 [(a) In those school districts or charter schools that do not hold kindergarten for a full
132-109nine-month term, the local school board or charter school governing board may approve a
133-110shorter term of nine weeks' duration.]

99+90after July 1, 2023, the number of weighted pupil units for kindergarten students shall be
100+91computed by adding the average daily membership of all pupils of the school district or charter
101+92school enrolled in kindergarten.
102+93 (b) The number of weighted pupil units is computed by [adding] multiplying the
103+94average daily membership [of all pupils of the school district or charter school enrolled in
104+95kindergarten and multiplying the total] for the number of students who are enrolled in
105+96kindergarten for less than the equivalent length of the schedule for grades 1 through 3, based on
106+97the October 1 data described in Section 53F-2-302, by .55.
107+98 [(a) In those school districts or charter schools that do not hold kindergarten for a full
108+99nine-month term, the local school board or charter school governing board may approve a
109+100shorter term of nine weeks' duration.]
110+101 [(b) Upon LEA governing board approval, the number of pupils in average daily
111+102membership at the short-term kindergarten shall be counted for the purpose of determining the
112+103number of units allowed in the same ratio as the number of days the short-term kindergarten is
113+104held, not exceeding nine weeks, compared to the total number of days schools are held in that
114+105school district or charter school in the regular school year.]
115+106 [(3)] (4) (a) The state board shall use prior year plus growth to determine average daily
116+107membership in distributing money under the Minimum School Program where the distribution
117+108is based on kindergarten through grade 12 ADMs or weighted pupil units.
118+109 (b) Under prior year plus growth, kindergarten through grade 12 average daily
119+110membership for the current year is based on the actual kindergarten through grade 12 average
120+111daily membership for the previous year plus an estimated percentage growth factor.
121+112 (c) The growth factor is the percentage increase in total average daily membership on
122+113the first school day of October in the current year as compared to the total average daily
123+114membership on the first school day of October of the previous year.
124+115 [(4)] (5) In distributing funds to charter schools under this section, charter school
125+116pupils shall be weighted, where applicable, as follows:
126+117 [(a) .55 for kindergarten pupils;]
127+118 [(b)] (a) except as provided in Subsection (3)(b), .9 for pupils in [grades 1]
128+119kindergarten through grade 6;

136-112membership at the short-term kindergarten shall be counted for the purpose of determining the

152-128 [(b)] (a) except as provided in Subsection (3)(b), .9 for pupils in [grades 1]
153-129kindergarten through grade 6;
154-130 [(c)] (b) .99 for pupils in grades 7 through 8; and
155-131 [(d)] (c) 1.2 for pupils in grades 9 through 12.
156-132 [(5) Notwithstanding Subsection (3)(c):]
157-133 [(a) for the 2020-2021 school year the state board may use a count of average daily
158-134membership on any day or days of the current school year in 2020 to calculate a growth factor
159-135for the 2020-2021 school year; and]
160-136 [(b) when calculating the growth factor as described in Subsection (5)(a), the state
161-137board shall comply with all applicable federal requirements.]
162-138 Section 3. Section 53F-2-302.1 is amended to read:

132+122 [(5) Notwithstanding Subsection (3)(c):]
133+123 [(a) for the 2020-2021 school year the state board may use a count of average daily
134+124membership on any day or days of the current school year in 2020 to calculate a growth factor
135+125for the 2020-2021 school year; and]
136+126 [(b) when calculating the growth factor as described in Subsection (5)(a), the state
137+127board shall comply with all applicable federal requirements.]
138+128 Section 3. Section 53F-2-302.1 is amended to read:
139+129 53F-2-302.1. Enrollment Growth Contingency Program.
140+130 (1) As used in this section:
141+131 (a) "Program funds" means money appropriated under the Enrollment Growth
142+132Contingency Program.
143+133 (b) "Student enrollment count" means the enrollment count on the first school day of
144+134October, as described in Subsection [53F-2-302(3)] 53F-2-302(4).
145+135 (2) There is created the Enrollment Growth Contingency Program to mitigate funding
146+136impacts on an LEA resulting from student enrollment irregularities during fiscal years 2021,
147+1372022, and 2023.
148+138 (3) Subject to legislative appropriations, the state board, in consultation with the Office
149+139of the Legislative Fiscal Analyst and the Governor's Office of Planning and Budget, shall use
150+140program funds to:
151+141 (a) for fiscal years 2021, 2022, and 2023 and for an LEA that has declining enrollment,
152+142pay costs associated with Subsection [53F-2-302(3)] 53F-2-302(4) to hold LEA funding
153+143distributions at the prior year's average daily membership;
154+144 (b) for fiscal year 2022, fund ongoing impacts of student enrollment changes in the
155+1452021-2022 academic year, including:
156+146 (i) assigning additional weighted pupil units to an LEA experiencing a net growth in
157+147weighted pupil units over the fiscal year 2022 base allocations associated with student
158+148enrollment increases following the student enrollment count; and
159+149 (ii) at the request of an LEA that experienced a significant decline in student
160+150enrollment during the 2020-2021 academic year, pre-fund significantly higher anticipated

165-140 (1) As used in this section:
166-141 (a) "Program funds" means money appropriated under the Enrollment Growth
167-142Contingency Program.
168-143 (b) "Student enrollment count" means the enrollment count on the first school day of
169-144October, as described in Subsection [53F-2-302(3)] 53F-2-302(4).
170-145 (2) There is created the Enrollment Growth Contingency Program to mitigate funding
171-146impacts on an LEA resulting from student enrollment irregularities during fiscal years 2021,
172-1472022, and 2023.
173-148 (3) Subject to legislative appropriations, the state board, in consultation with the Office
174-149of the Legislative Fiscal Analyst and the Governor's Office of Planning and Budget, shall use
175-150program funds to:
176-151 (a) for fiscal years 2021, 2022, and 2023 and for an LEA that has declining enrollment,
177-152pay costs associated with Subsection [53F-2-302(3)] 53F-2-302(4) to hold LEA funding
178-153distributions at the prior year's average daily membership;
179-154 (b) for fiscal year 2022, fund ongoing impacts of student enrollment changes in the
180-1552021-2022 academic year, including:
181-156 (i) assigning additional weighted pupil units to an LEA experiencing a net growth in
182-157weighted pupil units over the fiscal year 2022 base allocations associated with student
183-158enrollment increases following the student enrollment count; and
184-159 (ii) at the request of an LEA that experienced a significant decline in student
185-160enrollment during the 2020-2021 academic year, pre-fund significantly higher anticipated
186-161student enrollment growth before the student enrollment count; and
187-162 (c) for fiscal years 2022 and 2023, with any remaining weighted pupil units, pay other
188-163weighted pupil unit related costs in accordance with Section 53F-2-205.
189-164 (4) If the state board pre-funds anticipated student enrollment growth under Subsection
190-165(3)(b)(ii), the state board shall:
191-166 (a) verify the LEA's enrollment after the student enrollment count; and
192-167 (b) balance funds as necessary based on the actual increase in student enrollment. Enrolled Copy H.B. 477
163+152 (c) for fiscal years 2022 and 2023, with any remaining weighted pupil units, pay other
164+153weighted pupil unit related costs in accordance with Section 53F-2-205.
165+154 (4) If the state board pre-funds anticipated student enrollment growth under Subsection
166+155(3)(b)(ii), the state board shall:
167+156 (a) verify the LEA's enrollment after the student enrollment count; and
168+157 (b) balance funds as necessary based on the actual increase in student enrollment.
169+158 Section 4. Section 53G-7-203 is amended to read:
170+159 53G-7-203. Kindergartens -- Establishment -- Funding -- Assessment.
171+160 (1) Kindergartens are an integral part of the state's public education system.
172+161 (2) (a) Each [local school] LEA governing board shall provide kindergarten classes
173+162free of charge for kindergarten children residing within the district or attending the charter
174+163school.
175+164 (b) Each LEA governing board shall provide a half-day kindergarten option for a
176+165student if the student's parent requests a half-day option.
177+166 [(b)] (c) Nothing in this Subsection (2):
178+167 (i) allows an LEA governing board to require a student to participate in a full-day
179+168kindergarten program;
180+169 (ii) modifies the non-compulsory status of kindergarten under Title 53G, Chapter 6,
181+170Part 2, Compulsory Education; or
182+171 (iii) requires a student who only attends a half day of kindergarten to participate in dual
183+172enrollment under Section 53G-6-702.
184+173 (3) Kindergartens established under Subsection (2) shall receive state money under
185+174Title 53F, Public Education System -- Funding.
186+175 (4) (a) The state board shall:
187+176 (i) develop and collect data from a kindergarten [entry and exit assessments]
188+177assessment that the board selects by rule; and
189+178 (ii) make rules, in accordance with Title 63G, Chapter 3, Utah Administrative
190+179Rulemaking Act, regarding the administration of and reporting regarding the [assessments]
191+180assessment described in Subsection (4)(a)(i).
192+181 (b) An LEA shall:
193+182 (i) administer the [entry and exit assessments] assessment described in Subsection 02-14-23 4:43 PM H.B. 477

194-168 Section 4. Section 53G-7-203 is amended to read:
195-169 53G-7-203. Kindergartens -- Establishment -- Funding -- Assessment.
196-170 (1) Kindergartens are an integral part of the state's public education system.
197-171 (2) (a) Each [local school] LEA governing board shall provide kindergarten classes

200-174 (b) Each LEA governing board shall provide a half-day kindergarten option for a

202-176 [(b)] (c) Nothing in this Subsection (2):
203-177 (i) allows an LEA governing board to require a student to participate in a full-day
204-178kindergarten program;
205-179 (ii) modifies the non-compulsory status of kindergarten under Title 53G, Chapter 6,
206-180Part 2, Compulsory Education; or
207-181 (iii) requires a student who only attends a half day of kindergarten to participate in dual
208-182enrollment under Section 53G-6-702.
209-183 (3) Kindergartens established under Subsection (2) shall receive state money under
210-184Title 53F, Public Education System -- Funding.
211-185 (4) (a) The state board shall:
212-186 (i) develop and collect data from a kindergarten [entry and exit assessments]
213-187assessment that the board selects by rule; and
214-188 (ii) make rules, in accordance with Title 63G, Chapter 3, Utah Administrative
215-189Rulemaking Act, regarding the administration of and reporting regarding the [assessments]
216-190assessment described in Subsection (4)(a)(i).
217-191 (b) An LEA shall:
