1414 9 This bill modifies provisions relating to mailed ballots.
1515 10Highlighted Provisions:
1616 11 This bill:
1717 12 <provides that, subject to certain exceptions, an election officer is only required to
1818 13send ballots by mail to active voters who request, in a voter registration form or
1919 14another written document, to receive ballots for all future elections by mail;
2020 15 <modifies the voter registration form to permit a voter to make the request described
2121 16in the preceding paragraph;
2222 17 <requires a county clerk to, subject to certain exceptions:

4545 38Be it enacted by the Legislature of the state of Utah:
4646 39 Section 1. Section 20A-1-102 is amended to read:
4747 40 20A-1-102. Definitions.
4848 41 As used in this title:
4949 42 (1) "Active voter" means a registered voter who has not been classified as an inactive
5050 43voter by the county clerk.
5151 44 (2) "Automatic tabulating equipment" means apparatus that automatically examines
5252 45and counts votes recorded on ballots and tabulates the results.
5353 46 (3) (a) "Ballot" means the storage medium, including a paper, mechanical, or electronic
5454 47storage medium, that records an individual voter's vote.
5555 48 (b) "Ballot" does not include a record to tally multiple votes.
5656 49 (4) "Ballot proposition" means a question, issue, or proposal that is submitted to voters
5757 50on the ballot for their approval or rejection including:
5858 51 (a) an opinion question specifically authorized by the Legislature;
5959 52 (b) a constitutional amendment;
6060 53 (c) an initiative;
6161 54 (d) a referendum;
6262 55 (e) a bond proposition;
6363 56 (f) a judicial retention question;
6464 57 (g) an incorporation of a city or town; or

6767 59 (5) "Bind," "binding," or "bound" means securing more than one piece of paper
6868 60together using staples or another means in at least three places across the top of the paper in the
6969 61blank space reserved for securing the paper.
7070 62 (6) "Board of canvassers" means the entities established by Sections 20A-4-301 and
7171 6320A-4-306 to canvass election returns.
7272 64 (7) "Bond election" means an election held for the purpose of approving or rejecting
7373 65the proposed issuance of bonds by a government entity.
7474 66 (8) "Business reply mail envelope" means an envelope that may be mailed free of
7575 67charge by the sender.
7676 68 (9) "Canvass" means the review of election returns and the official declaration of
7777 69election results by the board of canvassers.
7878 70 (10) "Canvassing judge" means a poll worker designated to assist in counting ballots at
7979 71the canvass.
8080 72 (11) "Contracting election officer" means an election officer who enters into a contract
8181 73or interlocal agreement with a provider election officer.
8282 74 (12) "Convention" means the political party convention at which party officers and
8383 75delegates are selected.
8484 76 (13) "Counting center" means one or more locations selected by the election officer in
8585 77charge of the election for the automatic counting of ballots.
8686 78 (14) "Counting judge" means a poll worker designated to count the ballots during
8787 79election day.
8888 80 (15) "Counting room" means a suitable and convenient private place or room for use
8989 81by the poll workers and counting judges to count ballots.
9090 82 (16) "County officers" means those county officers that are required by law to be
9191 83elected.
9292 84 (17) "Date of the election" or "election day" or "day of the election":
9393 85 (a) means the day that is specified in the calendar year as the day that the election
9494 86occurs; and
9595 87 (b) does not include:
9696 88 (i) deadlines established for voting by mail, military-overseas voting, or emergency

9999 90 (ii) any early voting or early voting period as provided under Chapter 3a, Part 6, Early

101101 92 (18) "Elected official" means:
102102 93 (a) a person elected to an office under Section 20A-1-303 or Chapter 4, Part 6,
103103 94Municipal Alternate Voting Methods Pilot Project;
104104 95 (b) a person who is considered to be elected to a municipal office in accordance with
105105 96Subsection 20A-1-206(1)(c)(ii); or
106106 97 (c) a person who is considered to be elected to a local district office in accordance with
107107 98Subsection 20A-1-206(3)(b)(ii).
108108 99 (19) "Election" means a regular general election, a municipal general election, a
109109 100statewide special election, a local special election, a regular primary election, a municipal
110110 101primary election, and a local district election.
111111 102 (20) "Election Assistance Commission" means the commission established by the Help
112112 103America Vote Act of 2002, Pub. L. No. 107-252.
113113 104 (21) "Election cycle" means the period beginning on the first day persons are eligible to
114114 105file declarations of candidacy and ending when the canvass is completed.
115115 106 (22) "Election judge" means a poll worker that is assigned to:
116116 107 (a) preside over other poll workers at a polling place;
117117 108 (b) act as the presiding election judge; or
118118 109 (c) serve as a canvassing judge, counting judge, or receiving judge.
119119 110 (23) "Election officer" means:
120120 111 (a) the lieutenant governor, for all statewide ballots and elections;
121121 112 (b) the county clerk for:
122122 113 (i) a county ballot and election; and
123123 114 (ii) a ballot and election as a provider election officer as provided in Section
124124 11520A-5-400.1 or 20A-5-400.5;
125125 116 (c) the municipal clerk for:
126126 117 (i) a municipal ballot and election; and
127127 118 (ii) a ballot and election as a provider election officer as provided in Section
128128 11920A-5-400.1 or 20A-5-400.5;

131131 121 (i) a local district ballot and election; and
132132 122 (ii) a ballot and election as a provider election officer as provided in Section
133133 12320A-5-400.1 or 20A-5-400.5; or
134134 124 (e) the business administrator or superintendent of a school district for:
135135 125 (i) a school district ballot and election; and
136136 126 (ii) a ballot and election as a provider election officer as provided in Section
137137 12720A-5-400.1 or 20A-5-400.5.
138138 128 (24) "Election official" means any election officer, election judge, or poll worker.
139139 129 (25) "Election results" means:
140140 130 (a) for an election other than a bond election, the count of votes cast in the election and
141141 131the election returns requested by the board of canvassers; or
142142 132 (b) for bond elections, the count of those votes cast for and against the bond
143143 133proposition plus any or all of the election returns that the board of canvassers may request.
144144 134 (26) "Election returns" includes the pollbook, the military and overseas absentee voter
145145 135registration and voting certificates, one of the tally sheets, any unprocessed ballots, all counted
146146 136ballots, all excess ballots, all unused ballots, all spoiled ballots, the ballot disposition form, and
147147 137the total votes cast form.
148148 138 (27) "Electronic signature" means an electronic sound, symbol, or process attached to
149149 139or logically associated with a record and executed or adopted by a person with the intent to sign
150150 140the record.
151151 141 (28) "Inactive voter" means a registered voter who is listed as inactive by a county
152152 142clerk under Subsection 20A-2-306(4)(c)(i) or (ii).
153153 143 (29) "Judicial office" means the office filled by any judicial officer.
154154 144 (30) "Judicial officer" means any justice or judge of a court of record or any county
155155 145court judge.
156156 146 (31) "Local district" means a local government entity under Title 17B, Limited Purpose
157157 147Local Government Entities - Local Districts, and includes a special service district under Title
158158 14817D, Chapter 1, Special Service District Act.
159159 149 (32) "Local district officers" means those local district board members that are required
160160 150by law to be elected.
161161 151 (33) "Local election" means a regular county election, a regular municipal election, a H.B. 537 02-21-23 1:34 PM

163163 152municipal primary election, a local special election, a local district election, and a bond
164164 153election.
165165 154 (34) "Local political subdivision" means a county, a municipality, a local district, or a
166166 155local school district.
167167 156 (35) "Local special election" means a special election called by the governing body of a
168168 157local political subdivision in which all registered voters of the local political subdivision may
169169 158vote.
170170 159 (36) "Manual ballot" means a paper document produced by an election officer on
171171 160which an individual records an individual's vote by directly placing a mark on the paper
172172 161document using a pen or other marking instrument.
173173 162 (37) "Mechanical ballot" means a record, including a paper record, electronic record, or
174174 163mechanical record, that:
175175 164 (a) is created via electronic or mechanical means; and
176176 165 (b) records an individual voter's vote cast via a method other than an individual directly
177177 166placing a mark, using a pen or other marking instrument, to record an individual voter's vote.
178178 167 (38) "Municipal executive" means:
179179 168 (a) the mayor in the council-mayor form of government defined in Section 10-3b-102;
180180 169 (b) the mayor in the council-manager form of government defined in Subsection
181181 17010-3b-103(7); or
182182 171 (c) the chair of a metro township form of government defined in Section 10-3b-102.
183183 172 (39) "Municipal general election" means the election held in municipalities and, as
184184 173applicable, local districts on the first Tuesday after the first Monday in November of each
185185 174odd-numbered year for the purposes established in Section 20A-1-202.
186186 175 (40) "Municipal legislative body" means:
187187 176 (a) the council of the city or town in any form of municipal government; or
188188 177 (b) the council of a metro township.
189189 178 (41) "Municipal office" means an elective office in a municipality.
190190 179 (42) "Municipal officers" means those municipal officers that are required by law to be
191191 180elected.
192192 181 (43) "Municipal primary election" means an election held to nominate candidates for

195195 183 (44) "Municipality" means a city, town, or metro township.
196196 184 (45) "Official ballot" means the ballots distributed by the election officer for voters to
197197 185record their votes.
198198 186 (46) "Official endorsement" means the information on the ballot that identifies:
199199 187 (a) the ballot as an official ballot;
200200 188 (b) the date of the election; and
201201 189 (c) (i) for a ballot prepared by an election officer other than a county clerk, the
202202 190facsimile signature required by Subsection 20A-6-401(1)(a)(iii); or
203203 191 (ii) for a ballot prepared by a county clerk, the words required by Subsection
204204 19220A-6-301(1)(b)(iii).
205205 193 (47) "Official register" means the official record furnished to election officials by the
206206 194election officer that contains the information required by Section 20A-5-401.
207207 195 (48) "Political party" means an organization of registered voters that has qualified to
208208 196participate in an election by meeting the requirements of Chapter 8, Political Party Formation
209209 197and Procedures.
210210 198 (49) (a) "Poll worker" means a person assigned by an election official to assist with an
211211 199election, voting, or counting votes.
212212 200 (b) "Poll worker" includes election judges.
213213 201 (c) "Poll worker" does not include a watcher.
214214 202 (50) "Pollbook" means a record of the names of voters in the order that they appear to
215215 203cast votes.
216216 204 (51) "Polling place" means a building where voting is conducted.
217217 205 (52) "Position" means a square, circle, rectangle, or other geometric shape on a ballot
218218 206in which the voter marks the voter's choice.
219219 207 (53) "Presidential Primary Election" means the election established in Chapter 9, Part
220220 2088, Presidential Primary Election.
221221 209 (54) "Primary convention" means the political party conventions held during the year
222222 210of the regular general election.
223223 211 (55) "Protective counter" means a separate counter, which cannot be reset, that:
224224 212 (a) is built into a voting machine; and

227227 214 (56) "Provider election officer" means an election officer who enters into a contract or
228228 215interlocal agreement with a contracting election officer to conduct an election for the
229229 216contracting election officer's local political subdivision in accordance with Section
230230 21720A-5-400.1.
231231 218 (57) "Provisional ballot" means a ballot voted provisionally by a person:
232232 219 (a) whose name is not listed on the official register at the polling place;
233233 220 (b) whose legal right to vote is challenged as provided in this title; or
234234 221 (c) whose identity was not sufficiently established by a poll worker.
235235 222 (58) "Provisional ballot envelope" means an envelope printed in the form required by
236236 223Section 20A-6-105 that is used to identify provisional ballots and to provide information to
237237 224verify a person's legal right to vote.
238238 225 (59) (a) "Public figure" means an individual who, due to the individual being
239239 226considered for, holding, or having held a position of prominence in a public or private capacity,
240240 227or due to the individual's celebrity status, has an increased risk to the individual's safety.
241241 228 (b) "Public figure" does not include an individual:
242242 229 (i) elected to public office; or
243243 230 (ii) appointed to fill a vacancy in an elected public office.
244244 231 (60) "Qualify" or "qualified" means to take the oath of office and begin performing the
245245 232duties of the position for which the individual was elected.
246246 233 (61) "Receiving judge" means the poll worker that checks the voter's name in the
247247 234official register at a polling place and provides the voter with a ballot.
248248 235 (62) "Registration form" means a form by which an individual may register to vote
249249 236under this title.
250250 237 (63) "Regular ballot" means a ballot that is not a provisional ballot.
251251 238 (64) "Regular general election" means the election held throughout the state on the first
252252 239Tuesday after the first Monday in November of each even-numbered year for the purposes
253253 240established in Section 20A-1-201.
254254 241 (65) "Regular primary election" means the election, held on the date specified in
255255 242Section 20A-1-201.5, to nominate candidates of political parties and candidates for nonpartisan
256256 243local school board positions to advance to the regular general election.

259259 245 (67) "Return envelope" means the envelope, described in Subsection [20A-3a-202(4)]
260260 24620A-3a-202(5), provided to a voter with a manual ballot:
261261 247 (a) into which the voter places the manual ballot after the voter has voted the manual
262262 248ballot in order to preserve the secrecy of the voter's vote; and
263263 249 (b) that includes the voter affidavit and a place for the voter's signature.
264264 250 (68) "Sample ballot" means a mock ballot similar in form to the official ballot,
265265 251published as provided in Section 20A-5-405.
266266 252 (69) "Special election" means an election held as authorized by Section 20A-1-203.
267267 253 (70) "Spoiled ballot" means each ballot that:
268268 254 (a) is spoiled by the voter;
269269 255 (b) is unable to be voted because it was spoiled by the printer or a poll worker; or
270270 256 (c) lacks the official endorsement.
271271 257 (71) "Statewide special election" means a special election called by the governor or the
272272 258Legislature in which all registered voters in Utah may vote.
273273 259 (72) "Tabulation system" means a device or system designed for the sole purpose of
274274 260tabulating votes cast by voters at an election.
275275 261 (73) "Ticket" means a list of:
276276 262 (a) political parties;
277277 263 (b) candidates for an office; or
278278 264 (c) ballot propositions.
279279 265 (74) "Transfer case" means the sealed box used to transport voted ballots to the
280280 266counting center.
281281 267 (75) "Vacancy" means the absence of a person to serve in any position created by
282282 268statute, whether that absence occurs because of death, disability, disqualification, resignation,
283283 269or other cause.
284284 270 (76) "Valid voter identification" means:
285285 271 (a) a form of identification that bears the name and photograph of the voter which may
286286 272include:
287287 273 (i) a currently valid Utah driver license;
288288 274 (ii) a currently valid identification card that is issued by:

291291 276 (B) a branch, department, or agency of the United States;
292292 277 (iii) a currently valid Utah permit to carry a concealed weapon;
293293 278 (iv) a currently valid United States passport; or
294294 279 (v) a currently valid United States military identification card;
295295 280 (b) one of the following identification cards, whether or not the card includes a
296296 281photograph of the voter:
297297 282 (i) a valid tribal identification card;
298298 283 (ii) a Bureau of Indian Affairs card; or
299299 284 (iii) a tribal treaty card; or
300300 285 (c) two forms of identification not listed under Subsection (76)(a) or (b) but that bear
301301 286the name of the voter and provide evidence that the voter resides in the voting precinct, which
302302 287may include:
303303 288 (i) a current utility bill or a legible copy thereof, dated within the 90 days before the
304304 289election;
305305 290 (ii) a bank or other financial account statement, or a legible copy thereof;
306306 291 (iii) a certified birth certificate;
307307 292 (iv) a valid social security card;
308308 293 (v) a check issued by the state or the federal government or a legible copy thereof;
309309 294 (vi) a paycheck from the voter's employer, or a legible copy thereof;
310310 295 (vii) a currently valid Utah hunting or fishing license;
311311 296 (viii) certified naturalization documentation;
312312 297 (ix) a currently valid license issued by an authorized agency of the United States;
313313 298 (x) a certified copy of court records showing the voter's adoption or name change;
314314 299 (xi) a valid Medicaid card, Medicare card, or Electronic Benefits Transfer Card;
315315 300 (xii) a currently valid identification card issued by:
316316 301 (A) a local government within the state;
317317 302 (B) an employer for an employee; or
318318 303 (C) a college, university, technical school, or professional school located within the
319319 304state; or
320320 305 (xiii) a current Utah vehicle registration.

323323 307candidate by following the procedures and requirements of this title.
324324 308 (78) "Vote by mail" means to vote, using a manual ballot that is mailed to the voter, by:
325325 309 (a) mailing the ballot to the location designated in the mailing; or
326326 310 (b) depositing the ballot in a ballot drop box designated by the election officer.
327327 311 (79) "Voter" means an individual who:
328328 312 (a) meets the requirements for voting in an election;
329329 313 (b) meets the requirements of election registration;
330330 314 (c) is registered to vote; and
331331 315 (d) is listed in the official register book.
332332 316 (80) "Voter registration deadline" means the registration deadline provided in Section
333333 31720A-2-102.5.
334334 318 (81) "Voting area" means the area within six feet of the voting booths, voting
335335 319machines, and ballot box.
336336 320 (82) "Voting booth" means:
337337 321 (a) the space or compartment within a polling place that is provided for the preparation
338338 322of ballots, including the voting enclosure or curtain; or
339339 323 (b) a voting device that is free standing.
340340 324 (83) "Voting device" means any device provided by an election officer for a voter to
341341 325vote a mechanical ballot.
342342 326 (84) "Voting precinct" means the smallest geographical voting unit, established under
343343 327Chapter 5, Part 3, Duties of the County and Municipal Legislative Bodies.
344344 328 (85) "Watcher" means an individual who complies with the requirements described in
345345 329Section 20A-3a-801 to become a watcher for an election.
346346 330 (86) "Write-in ballot" means a ballot containing any write-in votes.
347347 331 (87) "Write-in vote" means a vote cast for an individual, whose name is not printed on
348348 332the ballot, in accordance with the procedures established in this title.
349349 333 Section 2. Section 20A-2-104 is amended to read:
350350 334 20A-2-104. Voter registration form -- Registered voter lists -- Fees for copies.
351351 335 (1) (a) As used in this section:
352352 336 (i) "Candidate for public office" means an individual:

355355 338 (B) who files a notice of intent to gather signatures under Section 20A-9-408; or
356356 339 (C) employed by, under contract with, or a volunteer of, an individual described in
357357 340Subsection (1)(a)(i)(A) or (B) for political campaign purposes.
358358 341 (ii) "Dating violence" means the same as that term is defined in [Section 78B-7-402
359359 342and] the federal Violence Against Women Act of 1994, as amended.
360360 343 (iii) "Domestic violence" means the same as that term is defined in Section 77-36-1
361361 344and the federal Violence Against Women Act of 1994, as amended.
362362 345 (b) An individual applying for voter registration, or an individual preregistering to
363363 346vote, shall complete a voter registration form in substantially the following form:

492492 471 (i) a government official or government employee acting in the government official's or
493493 472government employee's capacity as a government official or a government employee;
494494 473 (ii) a health care provider, as defined in Section 26-33a-102, or an agent, employee, or
495495 474independent contractor of a health care provider;
496496 475 (iii) an insurance company, as defined in Section 67-4a-102, or an agent, employee, or
497497 476independent contractor of an insurance company;
498498 477 (iv) a financial institution, as defined in Section 7-1-103, or an agent, employee, or
499499 478independent contractor of a financial institution;
500500 479 (v) a political party, or an agent, employee, or independent contractor of a political
501501 480party;
502502 481 (vi) a candidate for public office, or an employee, independent contractor, or volunteer
503503 482of a candidate for public office; or
504504 483 (vii) a person, or an agent, employee, or independent contractor of the person, who:
505505 484 (A) provides the year of birth of a registered voter that is obtained from the list of
506506 485registered voters only to a person who is a qualified person;
507507 486 (B) verifies that a person, described in Subsection (4)(a)(vii)(A), to whom a year of
508508 487birth that is obtained from the list of registered voters is provided, is a qualified person;
509509 488 (C) ensures, using industry standard security measures, that the year of birth of a
510510 489registered voter that is obtained from the list of registered voters may not be accessed by a

513513 491 (D) verifies that each qualified person, other than a qualified person described in
514514 492Subsection (4)(a)(i), (v), or (vi), to whom the person provides the year of birth of a registered
515515 493voter that is obtained from the list of registered voters, will only use the year of birth to verify
516516 494the accuracy of personal information submitted by an individual or to confirm the identity of a
517517 495person in order to prevent fraud, waste, or abuse;
518518 496 (E) verifies that each qualified person described in Subsection (4)(a)(i), to whom the
519519 497person provides the year of birth of a registered voter that is obtained from the list of registered
520520 498voters, will only use the year of birth in the qualified person's capacity as a government official
521521 499or government employee; and
522522 500 (F) verifies that each qualified person described in Subsection (4)(a)(v) or (vi), to
523523 501whom the person provides the year of birth of a registered voter that is obtained from the list of
524524 502registered voters, will only use the year of birth for a political purpose of the political party or
525525 503candidate for public office.
526526 504 (b) Notwithstanding Subsection 63G-2-302(1)(j)(iv), and except as provided in
527527 505Subsection 63G-2-302(1)(k) or (l), the lieutenant governor or a county clerk shall, when
528528 506providing the list of registered voters to a qualified person under this section, include, with the
529529 507list, the years of birth of the registered voters, if:
530530 508 (i) the lieutenant governor or a county clerk verifies the identity of the person and that
531531 509the person is a qualified person; and
532532 510 (ii) the qualified person signs a document that includes the following:
533533 511 (A) the name, address, and telephone number of the person requesting the list of
534534 512registered voters;
535535 513 (B) an indication of the type of qualified person that the person requesting the list
536536 514claims to be;
537537 515 (C) a statement regarding the purpose for which the person desires to obtain the years
538538 516of birth;
539539 517 (D) a list of the purposes for which the qualified person may use the year of birth of a
540540 518registered voter that is obtained from the list of registered voters;
541541 519 (E) a statement that the year of birth of a registered voter that is obtained from the list
542542 520of registered voters may not be provided or used for a purpose other than a purpose described

545545 522 (F) a statement that if the person obtains the year of birth of a registered voter from the
546546 523list of registered voters under false pretenses, or provides or uses the year of birth of a
547547 524registered voter that is obtained from the list of registered voters in a manner that is prohibited
548548 525by law, is guilty of a class A misdemeanor and is subject to a civil fine;
549549 526 (G) an assertion from the person that the person will not provide or use the year of
550550 527birth of a registered voter that is obtained from the list of registered voters in a manner that is
551551 528prohibited by law; and
552552 529 (H) notice that if the person makes a false statement in the document, the person is
553553 530punishable by law under Section 76-8-504.
554554 531 (c) The lieutenant governor or a county clerk may not disclose the year of birth of a
555555 532registered voter to a person that the lieutenant governor or county clerk reasonably believes:
556556 533 (i) is not a qualified person or a person described in Subsection (4)(l); or
557557 534 (ii) will provide or use the year of birth in a manner prohibited by law.
558558 535 (d) The lieutenant governor or a county clerk may not disclose the voter registration
559559 536form of a person, or information included in the person's voter registration form, whose voter
560560 537registration form is classified as private under Subsection (4)(h) to a person other than:
561561 538 (i) a government official or government employee acting in the government official's or
562562 539government employee's capacity as a government official or government employee; or
563563 540 (ii) except as provided in Subsection (7) and subject to Subsection (4)(e), a person
564564 541described in Subsection (4)(a)(v) or (vi) for a political purpose.
565565 542 (e) When disclosing a record or information under Subsection (4)(d)(ii), the lieutenant
566566 543governor or county clerk shall exclude the information described in Subsection
567567 54463G-2-302(1)(j), other than the year of birth.
568568 545 (f) The lieutenant governor or a county clerk may not disclose a withholding request
569569 546form, described in Subsections (7) and (8), submitted by an individual, or information obtained
570570 547from that form, to a person other than a government official or government employee acting in
571571 548the government official's or government employee's capacity as a government official or
572572 549government employee.
573573 550 (g) A person is guilty of a class A misdemeanor if the person:
574574 551 (i) obtains the year of birth of a registered voter from the list of registered voters under

577577 553 (ii) uses or provides the year of birth of a registered voter that is obtained from the list
578578 554of registered voters in a manner that is not permitted by law;
579579 555 (iii) obtains a voter registration record described in Subsection 63G-2-302(1)(k) under

581581 557 (iv) uses or provides information obtained from a voter registration record described in
582582 558Subsection 63G-2-302(1)(k) in a manner that is not permitted by law;
583583 559 (v) unlawfully discloses or obtains a voter registration record withheld under
584584 560Subsection (7) or a withholding request form described in Subsections (7) and (8); or
585585 561 (vi) unlawfully discloses or obtains information from a voter registration record
586586 562withheld under Subsection (7) or a withholding request form described in Subsections (7) and
587587 563(8).
588588 564 (h) The lieutenant governor or a county clerk shall classify the voter registration record
589589 565of a voter as a private record if the voter:
590590 566 (i) submits a written application, created by the lieutenant governor, requesting that the
591591 567voter's voter registration record be classified as private;
592592 568 (ii) requests on the voter's voter registration form that the voter's voter registration
593593 569record be classified as a private record; or
594594 570 (iii) submits a withholding request form described in Subsection (7) and any required
595595 571verification.
596596 572 (i) The lieutenant governor or a county clerk may not disclose to a person described in
597597 573Subsection (4)(a)(v) or (vi) a voter registration record, or information obtained from a voter
598598 574registration record, if the record is withheld under Subsection (7).
599599 575 (j) In addition to any criminal penalty that may be imposed under this section, the
600600 576lieutenant governor may impose a civil fine against a person who violates a provision of this
601601 577section, in an amount equal to the greater of:
602602 578 (i) the product of 30 and the square root of the total number of:
603603 579 (A) records obtained, provided, or used unlawfully, rounded to the nearest whole
604604 580dollar; or
605605 581 (B) records from which information is obtained, provided, or used unlawfully, rounded
606606 582to the nearest whole dollar; or

609609 584 (k) A qualified person may not obtain, provide, or use the year of birth of a registered
610610 585voter, if the year of birth is obtained from the list of registered voters or from a voter
611611 586registration record, unless the person:
612612 587 (i) is a government official or government employee who obtains, provides, or uses the
613613 588year of birth in the government official's or government employee's capacity as a government
614614 589official or government employee;
615615 590 (ii) is a qualified person described in Subsection (4)(a)(ii), (iii), or (iv) and obtains or
616616 591uses the year of birth only to verify the accuracy of personal information submitted by an
617617 592individual or to confirm the identity of a person in order to prevent fraud, waste, or abuse;
618618 593 (iii) is a qualified person described in Subsection (4)(a)(v) or (vi) and obtains,
619619 594provides, or uses the year of birth for a political purpose of the political party or candidate for
620620 595public office; or
621621 596 (iv) is a qualified person described in Subsection (4)(a)(vii) and obtains, provides, or
622622 597uses the year of birth to provide the year of birth to another qualified person to verify the
623623 598accuracy of personal information submitted by an individual or to confirm the identity of a
624624 599person in order to prevent fraud, waste, or abuse.
625625 600 (l) The lieutenant governor or a county clerk may provide a year of birth to a member
626626 601of the media, in relation to an individual designated by the member of the media, in order for
627627 602the member of the media to verify the identity of the individual.
628628 603 (m) A person described in Subsection (4)(a)(v) or (vi) may not use or disclose
629629 604information from a voter registration record for a purpose other than a political purpose.
630630 605 (5) When political parties not listed on the voter registration form qualify as registered
631631 606political parties under Title 20A, Chapter 8, Political Party Formation and Procedures, the
632632 607lieutenant governor shall inform the county clerks of the name of the new political party and
633633 608direct the county clerks to ensure that the voter registration form is modified to include that
634634 609political party.
635635 610 (6) Upon receipt of a voter registration form from an applicant, the county clerk or the
636636 611clerk's designee shall:
637637 612 (a) review each voter registration form for completeness and accuracy; and
638638 613 (b) if the county clerk believes, based upon a review of the form, that an individual

641641 615preregister to vote, refer the form to the county attorney for investigation and possible
642642 616prosecution.
643643 617 (7) The lieutenant governor or a county clerk shall withhold from a person, other than a
644644 618person described in Subsection (4)(a)(i), the voter registration record, and information obtained
645645 619from the voter registration record, of an individual:
646646 620 (a) who submits a withholding request form, with the voter registration record or to the
647647 621lieutenant governor or a county clerk, if:
648648 622 (i) the individual indicates on the form that the individual, or an individual who resides
649649 623with the individual, is a victim of domestic violence or dating violence or is likely to be a
650650 624victim of domestic violence or dating violence; or
651651 625 (ii) the individual indicates on the form and provides verification that the individual, or
652652 626an individual who resides with the individual, is:
653653 627 (A) a law enforcement officer;
654654 628 (B) a member of the armed forces, as defined in Section 20A-1-513;
655655 629 (C) a public figure; or
656656 630 (D) protected by a protective order or protection order; or
657657 631 (b) whose voter registration record was classified as a private record at the request of
658658 632the individual before May 12, 2020.
659659 633 (8) (a) The lieutenant governor shall design and distribute the withholding request form
660660 634described in Subsection (7) to each election officer and to each agency that provides a voter
661661 635registration form.
662662 636 (b) An individual described in Subsection (7)(a)(i) is not required to provide
663663 637verification, other than the individual's attestation and signature on the withholding request
664664 638form, that the individual, or an individual who resides with the individual, is a victim of
665665 639domestic violence or dating violence or is likely to be a victim of domestic violence or dating
666666 640violence.
667667 641 (c) The director of elections within the Office of the Lieutenant Governor shall make
668668 642rules, in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act,
669669 643establishing requirements for providing the verification described in Subsection (7)(a)(ii).
670670 644 (9) An election officer or an employee of an election officer may not encourage an

783783 753lieutenant governor regarding deceased individuals.

785785 755clerk receives the information described in Subsection (5) or Subsections 26-2-13(11) and (12)

845845 813 [(3)] (4) (a) An election officer who mails a manual ballot under Subsection [(2)] (3)

848848 816 (ii) if, at or after the time of registration, the voter files an alternate address request
849849 817form described in Subsection [(3)(b)] (4)(b), the alternate address indicated on the form.
850850 818 (b) The lieutenant governor shall make available to voters an alternate address request
851851 819form that permits a voter to request that the election officer mail the voter's ballot to a location
852852 820other than the voter's residence.
853853 821 (c) A voter shall provide the completed alternate address request form to the election
854854 822officer no later than 11 days before the day of the election.
855855 823 [(4)] (5) [The] A return envelope shall include:
856856 824 (a) the name, official title, and post office address of the election officer on the front of

858858 826 (b) a space where a voter may write an email address and phone number by which the

872872 839identification, the election officer may:
873873 840 (a) mail a ballot to the voter;
874874 841 (b) instruct the voter to include a copy of the voter's valid voter identification with the
875875 842return ballot; and
876876 843 (c) provide instructions to the voter on how the voter may sign up to receive electronic
877877 844ballot status notifications via the ballot tracking system described in Section 20A-3a-401.5.
878878 845 [(6)] (7) An election officer who administers an election shall:
879879 846 (a) (i) before the election, obtain the signatures of each voter qualified to vote in the
880880 847election; or
881881 848 (ii) obtain the signature of each voter within the voting precinct from the county clerk;
882882 849and
883883 850 (b) maintain the signatures on file in the election officer's office.
884884 851 [(7)] (8) Upon receipt of a returned ballot, the election officer shall review and process
885885 852the ballot under Section 20A-3a-401.
886886 853 [(8)] (9) A county that administers an election:
887887 854 (a) shall provide at least one election day voting center in accordance with [Chapter 3a,
888888 855Part 7, Election Day Voting Center] Part 7, Election Day Voting Center, and at least one
889889 856additional election day voting center for every 5,000 active voters in the county who have not
890890 857requested to [not] receive a ballot by mail;
891891 858 (b) shall ensure that each election day voting center operated by the county has at least
892892 859one voting device that is accessible, in accordance with the Help America Vote Act of 2002,
893893 860Pub. L. No. 107-252, for individuals with disabilities;

896896 862 (i) the county clerk conducts early voting on at least four days;
897897 863 (ii) the early voting days are within the period beginning on the date that is 14 days
898898 864before the date of the election and ending on the day before the election; and
899899 865 (iii) the county clerk provides notice of the reduced early voting period in accordance
900900 866with Section 20A-3a-604;
901901 867 (d) is not required to pay return postage for a ballot; and
902902 868 (e) is subject to an audit conducted under Subsection [(9)] (10).
903903 869 [(9)] (10) (a) The lieutenant governor shall:
904904 870 (i) develop procedures for conducting an audit of affidavit signatures on ballots cast in
905905 871an election conducted under this section; and
906906 872 (ii) after each primary, general, or special election conducted under this section, select
907907 873a number of ballots, in varying jurisdictions, to audit in accordance with the procedures
908908 874developed under Subsection [(9)(a)(i)] (10)(a)(i).
909909 875 (b) The lieutenant governor shall post the results of an audit conducted under this
910910 876Subsection [(9)] (10) on the lieutenant governor's website.
911911 877 [(10)] (11) (a) An individual who has previously requested to receive a ballot by mail
912912 878may request that the election officer not send the individual a ballot by mail in the next and
913913 879subsequent elections by submitting a written request to the election officer.
914914 880 (b) An individual shall submit the request described in Subsection [(10)(a)] (11)(a) to
915915 881the election officer before 5 p.m. no later than 60 days before an election if the individual does
916916 882not wish to receive a ballot by mail in that election.
917917 883 (c) An election officer who receives a request from an individual under Subsection
918918 884[(10)(a)] (11)(a):
919919 885 (i) shall remove the individual's name from the list of voters who will receive a ballot
920920 886by mail; and
921921 887 (ii) may not send the individual a ballot by mail for:
922922 888 (A) the next election, if the individual submits the request described in Subsection
923923 889[(10)(a)] (11)(a) before the deadline described in Subsection [(10)(b)] (11)(b); or
924924 890 (B) an election after the election described in Subsection [(10)(c)(ii)(A)] (11)(c)(ii)(A).
925925 891 (d) An individual who submits a request under Subsection [(10)(a)] (11)(a) may

929929 894 Section 5. Section 20A-3a-202.5 is enacted to read:

932932 897mail to each active voter, other than a covered voter, whose principal place of residence is in

934934 899 (1) a notice informing the voter that, except in limited circumstances, the voter will not
935935 900receive a ballot by mail for an election held after 2023, unless the voter requests otherwise in
936936 901writing; and
937937 902 (2) a form that the voter may use to request that the voter receive a ballot by mail in all
938938 903future elections.
939939 904 Section 6. Section 20A-5-804 is amended to read:
940940 905 20A-5-804. Voting Equipment Grant Program -- Qualifications for receipt --
941941 906Matching funds -- Acceptable uses.
942942 907 (1) As used in this section:
943943 908 (a) "Program" means the Voting Equipment Grant Program created in this section.
944944 909 (b) "Proportional reimbursement rate" means the dollar amount equal to the product of:
945945 910 (i) the total amount of funds appropriated by the Legislature to the program; and
946946 911 (ii) the quotient of:
947947 912 (A) the total number of active voters in a county; and
948948 913 (B) the total number of registered voters in the state.
949949 914 (2) (a) There is created the Voting Equipment Grant Program as a grant program to
950950 915assist counties in purchasing new voting equipment systems.
951951 916 (b) The lieutenant governor shall administer the program using funds appropriated by
952952 917the Legislature for the purpose of administering the program.
953953 918 (3) (a) After January 1, 2018, a county may submit a proposal to the Office of the
954954 919Lieutenant Governor to participate in and receive funds from the program.
955955 920 (b) A proposal described in Subsection (3)(a) shall:
956956 921 (i) describe the current condition of the voting equipment used by the county;
957957 922 (ii) describe the county's need for a new voting equipment system;
958958 923 (iii) describe how the county plans to comply with the requirements described in 02-21-23 1:34 PM H.B. 537

960960 924Subsection (4), including:
961961 925 (A) a description of how the county plans to provide the matching funds described in
962962 926Subsection (4)(b) if the proposal is accepted; and
963963 927 (B) a schedule by which the requirements will be met; and
964964 928 (iv) contain a detailed estimate of the gross cost of procuring a new voting equipment
965965 929system.
966966 930 (4) A county that receives funds through a program grant:
967967 931 (a) shall use the funds to purchase a new voting equipment system that:
968968 932 (i) meets the requirements of Section 20A-5-802;
969969 933 (ii) creates a secure and auditable paper record of each vote; and
970970 934 (iii) complies with any additional binding requirement made under Subsection
971971 93520A-5-803(8) by the Voting Equipment Selection Committee;
972972 936 (b) shall, for the purpose of purchasing a new voting equipment system, appropriate
973973 937matching funds equal to or greater than the difference of:
974974 938 (i) the amount described in Subsection (3)(b)(iv) in the proposal that the lieutenant
975975 939governor accepts under Subsection (6)(b); and
976976 940 (ii) the amount the lieutenant governor is required to disburse to the county under
977977 941Subsection (7)(a);
978978 942 (c) may not use funds disbursed under Subsection (6)(b)(i)(D) or appropriated under
979979 943Subsection (4)(b) for a purpose or in a manner that is not authorized by this section;
980980 944 (d) except as provided in Subsection (5), may not, after using a new voting equipment
981981 945system in an election that was purchased under this section, use voting equipment that does not
982982 946meet the requirements described in Subsection (4)(a); and
983983 947 (e) shall purchase a new voting equipment system described under Subsection (4)(a)
984984 948that provides the best value to the county with consideration for the new voting equipment
985985 949system's:
986986 950 (i) cost of maintenance;
987987 951 (ii) estimated operational lifetime; and
988988 952 (iii) cost of replacement.
989989 953 (5) A county that receives funds through the program may use voting equipment that
990990 954does not comply with the requirements described in Subsection (4)(a)(ii) or (iii): H.B. 537 02-21-23 1:34 PM

992992 955 (a) to the extent that using the voting equipment is necessary to accommodate a person
993993 956with a disability in accordance with the requirements described in Subsection
994994 957[20A-3a-202(8)(b)] 20A-3a-202(9)(b), 20A-3a-603(1)(c), 20A-5-303(8), or
995995 95820A-5-403(2)(b)(iii); or
996996 959 (b) if the county purchased the voting equipment before receiving grant funds under
997997 960Subsection (7)(a).
998998 961 (6) Upon receipt of a proposal described in Subsection (3), the lieutenant governor
999999 962shall:
10001000 963 (a) review the proposal to ensure that:
10011001 964 (i) the proposal complies with the requirements described in Subsection (3); and
10021002 965 (ii) the cost estimate described in Subsection (3)(b)(iv) appears to be reasonable; and
10031003 966 (b) (i) if the proposal complies with the requirements described in Subsection (3), the
10041004 967cost estimate appears to be reasonably accurate, and sufficient program funds are available:
10051005 968 (A) accept the proposal;
10061006 969 (B) notify the county clerk of the county that submitted the proposal that the proposal
10071007 970is accepted;
10081008 971 (C) notify the county clerk of the requirements described in Subsection (7); and
10091009 972 (D) disburse the funds described in Subsection (7)(a), in accordance with the
10101010 973requirements described in Subsection (7)(b), to the county that submitted the proposal; or
10111011 974 (ii) if the proposal does not comply with the requirements described in Subsection (3),
10121012 975the cost estimate does not appear to be reasonable, or sufficient program funds are not
10131013 976available:
10141014 977 (A) reject the proposal; and
10151015 978 (B) notify the county clerk of the county that submitted the proposal that the proposal
10161016 979is rejected, indicating the reason that the proposal is rejected.
10171017 980 (7) The lieutenant governor:
10181018 981 (a) shall disburse funds under Subsection (6)(b)(i)(D) equal to the lesser of:
10191019 982 (i) 50% of the amount described in Subsection (3)(b)(iv) in the proposal that the
10201020 983lieutenant governor accepts under Subsection (6)(b); or
10211021 984 (ii) the proportional reimbursement rate; and
