Ipson 2 3 LONG TITLE 4 General Description: 5 This bill addresses disorderly conduct. 6 Highlighted Provisions: 7 This bill: 8 ▸ creates the criminal offense aggravated disorderly conduct on a street or highway. 9 Money Appropriated in this Bill: 10 None 11 Other Special Clauses: 12 None 13 Utah Code Sections Affected: 14 ENACTS: 15 76-9-102.1, Utah Code Annotated 1953 16 17 Be it enacted by the Legislature of the state of Utah: 18 Section 1. Section 76-9-102.1 is enacted to read: 19 76-9-102.1 . Aggravated disorderly conduct on a street or highway. 20 (1) Terms defined in Section 76-1-101.5 apply to this section. 21 (2) An actor commits aggravated disorderly conduct on a street or highway if the actor: 22 (a) intentionally, knowingly, or recklessly obstructs vehicular or pedestrian traffic on a 23 street or highway with: 24 (i) a speed limit of 40 miles per hour or more; or 25 (ii) at least two lanes in the same direction of travel; and 26 (b) refuses to comply with the lawful order of a law enforcement officer to move from 27 the street or highway. 28 (3)(a) Except as provided in Subsection (3)(b), a violation of Subsection (2) is a class B H.B. 80 Enrolled Copy 29 misdemeanor. 30 (b) A violation of Subsection (2) is a class A misdemeanor if within one year before the 31 day on which the actor violates this section, the actor was previously convicted of a 32 violation of Subsection (2). 33 Section 2.
