104104 (2)(a) The legislative body of a specified municipality shall submit an initial report to

108108 (b)(i) This Subsection (2)(b) applies to a municipality that is not a specified

110110 municipality as of January 1, 2023.

112112 (ii) As of January 1, if a municipality described in Subsection (2)(b)(i) changes from

114114 one class to another or grows in population to qualify as a specified municipality,
115115 56
116116 the municipality shall submit an initial plan to the division on or before August 1

118118 of the first calendar year beginning on January 1 in which the municipality
119119 58
120120 qualifies as a specified municipality.

122122 (c) The initial report shall:

124124 (i) identify each moderate income housing strategy selected by the specified

126126 municipality for continued, ongoing, or one-time implementation, restating the

128128 exact language used to describe the moderate income housing strategy in

130130 Subsection 10-9a-403(2)(b)(iii); and

132132 (ii) include an implementation plan.

134134 (3)(a) After the division approves a specified municipality's initial report under this

137137 section, the specified municipality shall, as an administrative act, [annually ]submit

139139 to the division a subsequent progress report on or before August 1 of each third year

145145 (b) The subsequent progress report shall include:

147147 (i) subject to Subsection (3)(c), a description of each action, whether one-time or

149149 ongoing, taken by the specified municipality during the previous [12] 36-month

151151 period to implement the moderate income housing strategies identified in the
152152 74
153153 initial report for implementation;

155155 (ii) a description of each land use regulation or land use decision made by the
156156 76
157157 specified municipality during the previous [12] 36-month period to implement the
158158 77
159159 moderate income housing strategies, including an explanation of how the land use
160160 78
161161 regulation or land use decision supports the specified municipality's efforts to
162162 79
163163 implement the moderate income housing strategies;
164164 80
165165 (iii) a description of any barriers encountered by the specified municipality in the
166166 81
167167 previous [12] 36-month period in implementing the moderate income housing
168168 82
169169 strategies;
170170 83
171171 (iv) information regarding the number of internal and external or detached accessory
172172 84
173173 dwelling units located within the specified municipality for which the specified
174174 85
175175 municipality:
176176 86
177177 (A) issued a building permit to construct; or
178178 87
179179 (B) issued a business license or comparable license or permit to rent;

181181 (v) the number of residential dwelling units that have been entitled that have not
182182 89
183183 received a building permit as of the submission date of the progress report;

185185 (vi) shapefiles, or website links if shapefiles are not available, to current maps and
186186 91
187187 tables related to zoning;

189189 (vii) a description of how the market has responded to the selected moderate income
190190 93
191191 housing strategies, including the number of entitled moderate income housing
192192 94
193193 units or other relevant data; and
194194 95
195195 (viii) any recommendations on how the state can support the specified municipality
196196 96
197197 in implementing the moderate income housing strategies.

199199 (c) For purposes of describing actions taken by a specified municipality under
200200 98
201201 Subsection (3)(b)(i), the specified municipality may include an ongoing action taken
202202 99
203203 by the specified municipality prior to the [12] 36-month reporting period applicable to

206206 the subsequent progress report if the specified municipality:

208208 (i) has already adopted an ordinance, approved a land use application, made an

210210 investment, or approved an agreement or financing that substantially promotes the

212212 implementation of a moderate income housing strategy identified in the initial
213213 104
214214 report; and

216216 (ii) demonstrates in the subsequent progress report that the action taken under
217217 106
218218 Subsection (3)(c)(i) is relevant to making meaningful progress towards the
219219 107
220220 specified municipality's implementation plan.

222222 (d) A specified municipality's report shall be in a form:
223223 109
224224 (i) approved by the division; and
225225 110
226226 (ii) made available by the division on or before May 1 of the year in which the report
227227 111
228228 is required.

230230 (4) Within 90 days after the day on which the division receives a specified municipality's
231231 113
232232 report, the division shall:
233233 114
234234 (a) post the report on the division's website;
235235 115
236236 (b) send a copy of the report to the Department of Transportation, the Governor's Office
237237 116
238238 of Planning and Budget, the association of governments in which the specified
239239 117
240240 municipality is located, and, if the specified municipality is located within the
241241 118
242242 boundaries of a metropolitan planning organization, the appropriate metropolitan
243243 119
244244 planning organization; and
245245 120
246246 (c) subject to Subsection (5), review the report to determine compliance with this section.

248248 (5)(a) An initial report does not comply with this section unless the report:
249249 122
250250 (i) includes the information required under Subsection (2)(c);

252252 (ii) demonstrates to the division that the specified municipality made plans to

254254 implement:

256256 (A) three or more moderate income housing strategies if the specified
257257 126
258258 municipality does not have a fixed guideway public transit station; or

260260 (B) subject to Subsection 10-9a-403(2)(b)(iv), five or more moderate income

262262 housing strategies if the specified municipality has a fixed guideway public
263263 129
264264 transit station; and
265265 130
266266 (iii) is in a form approved by the division.

268268 (b) A subsequent progress report does not comply with this section unless the report:

270270 (i) demonstrates to the division that the specified municipality made plans to

272272 implement:

277277 municipality does not have a fixed guideway public transit station; or

279279 (B) subject to the requirements of Subsection 10-9a-403(2)(a)(iii)(D), five or more

281281 moderate income housing strategies if the specified municipality has a fixed
282282 138
283283 guideway public transit station;

285285 (ii) is in a form approved by the division; and

287287 (iii) provides sufficient information for the division to:

289289 (A) assess the specified municipality's progress in implementing the moderate
290290 142
291291 income housing strategies;

293293 (B) monitor compliance with the specified municipality's implementation plan;
294294 144
295295 (C) identify a clear correlation between the specified municipality's land use
296296 145
297297 regulations and land use decisions and the specified municipality's efforts to
298298 146
299299 implement the moderate income housing strategies;
300300 147
301301 (D) identify how the market has responded to the specified municipality's selected
302302 148
303303 moderate income housing strategies; and
304304 149
305305 (E) identify any barriers encountered by the specified municipality in
306306 150
307307 implementing the selected moderate income housing strategies.

309309 (6)(a) A specified municipality qualifies for priority consideration under this Subsection
310310 152
311311 (6) if the specified municipality's report:
312312 153
313313 (i) complies with this section; and
314314 154
315315 (ii) demonstrates to the division that the specified municipality made plans to
316316 155
317317 implement:
318318 156
319319 (A) five or more moderate income housing strategies if the specified municipality
320320 157
321321 does not have a fixed guideway public transit station; or
322322 158
323323 (B) six or more moderate income housing strategies if the specified municipality
324324 159
325325 has a fixed guideway public transit station.

327327 (b) The Transportation Commission may, in accordance with Subsection 72-1-304(3)(c),
328328 161
329329 give priority consideration to transportation projects located within the boundaries of
330330 162
331331 a specified municipality described in Subsection (6)(a) until the Department of
332332 163
333333 Transportation receives notice from the division under Subsection (6)(e).

335335 (c) Upon determining that a specified municipality qualifies for priority consideration
336336 165
337337 under this Subsection (6), the division shall send a notice of prioritization to the
338338 166
339339 legislative body of the specified municipality and the Department of Transportation.

341341 (d) The notice described in Subsection (6)(c) shall:

344344 (i) name the specified municipality that qualifies for priority consideration;

346346 (ii) describe the funds or projects for which the specified municipality qualifies to
347347 170
348348 receive priority consideration; and

350350 (iii) state the basis for the division's determination that the specified municipality
351351 172
352352 qualifies for priority consideration.

354354 (e) The division shall notify the legislative body of a specified municipality and the
355355 174
356356 Department of Transportation in writing if the division determines that the specified
357357 175
358358 municipality no longer qualifies for priority consideration under this Subsection (6).

360360 (7)(a) If the division, after reviewing a specified municipality's report, determines that
361361 177
362362 the report does not comply with this section, the division shall send a notice of
363363 178
364364 noncompliance to the legislative body of the specified municipality.

366366 (b) A specified municipality that receives a notice of noncompliance may:
367367 180
368368 (i) cure each deficiency in the report within 90 days after the day on which the notice
369369 181
370370 of noncompliance is sent; or
371371 182
372372 (ii) request an appeal of the division's determination of noncompliance within 10
373373 183
374374 days after the day on which the notice of noncompliance is sent.

376376 (c) The notice described in Subsection (7)(a) shall:
377377 185
378378 (i) describe each deficiency in the report and the actions needed to cure each
379379 186
380380 deficiency;
381381 187
382382 (ii) state that the specified municipality has an opportunity to:
383383 188
384384 (A) submit to the division a corrected report that cures each deficiency in the
385385 189
386386 report within 90 days after the day on which the notice of compliance is sent; or
387387 190
388388 (B) submit to the division a request for an appeal of the division's determination of
389389 191
390390 noncompliance within 10 days after the day on which the notice of
391391 192
392392 noncompliance is sent; and

394394 (iii) state that failure to take action under Subsection (7)(c)(ii) will result in the
395395 194
396396 specified municipality's ineligibility for funds under Subsection (9).

398398 (d) For purposes of curing the deficiencies in a report under this Subsection (7), if the
399399 196
400400 action needed to cure the deficiency as described by the division requires the
401401 197
402402 specified municipality to make a legislative change, the specified municipality may
403403 198
404404 cure the deficiency by making that legislative change within the 90-day cure period.

406406 (e)(i) If a specified municipality submits to the division a corrected report in
407407 200
408408 accordance with Subsection (7)(b)(i) and the division determines that the
409409 201
410410 corrected report does not comply with this section, the division shall send a

413413 second notice of noncompliance to the legislative body of the specified

415415 municipality within 30 days after the day on which the corrected report is

417417 submitted.

419419 (ii) A specified municipality that receives a second notice of noncompliance may

421421 submit to the division a request for an appeal of the division's determination of
422422 207
423423 noncompliance within 10 days after the day on which the second notice of
424424 208
425425 noncompliance is sent.

427427 (iii) The notice described in Subsection (7)(e)(i) shall:

429429 (A) state that the specified municipality has an opportunity to submit to the
430430 211
431431 division a request for an appeal of the division's determination of
432432 212
433433 noncompliance within 10 days after the day on which the second notice of
434434 213
435435 noncompliance is sent; and
436436 214
437437 (B) state that failure to take action under Subsection (7)(e)(iii)(A) will result in the
438438 215
439439 specified municipality's ineligibility for funds under Subsection (9).

441441 (8)(a) A specified municipality that receives a notice of noncompliance under
442442 217
443443 Subsection (7)(a) or (7)(e)(i) may request an appeal of the division's determination of
444444 218
445445 noncompliance within 10 days after the day on which the notice of noncompliance is
446446 219
447447 sent.

449449 (b) Within 90 days after the day on which the division receives a request for an appeal,
450450 221
451451 an appeal board consisting of the following three members shall review and issue a
452452 222
453453 written decision on the appeal:
454454 223
455455 (i) one individual appointed by the Utah League of Cities and Towns;
456456 224
457457 (ii) one individual appointed by the Utah Homebuilders Association; and
458458 225
459459 (iii) one individual appointed by the presiding member of the association of
460460 226
461461 governments, established pursuant to an interlocal agreement under Title 11,
462462 227
463463 Chapter 13, Interlocal Cooperation Act, of which the specified municipality is a
464464 228
465465 member.

467467 (c) The written decision of the appeal board shall either uphold or reverse the division's
468468 230
469469 determination of noncompliance.

471471 (d) The appeal board's written decision on the appeal is final.

473473 (9)(a) A specified municipality is ineligible for funds under this Subsection (9) if:
474474 233
475475 (i) the specified municipality fails to submit a report to the division;
476476 234
477477 (ii) after submitting a report to the division, the division determines that the report
478478 235
479479 does not comply with this section and the specified municipality fails to:

482482 (A) cure each deficiency in the report within 90 days after the day on which the

484484 notice of noncompliance is sent; or

486486 (B) request an appeal of the division's determination of noncompliance within 10

490490 (iii) after submitting to the division a corrected report to cure the deficiencies in a
491491 241
492492 previously submitted report, the division determines that the corrected report does
493493 242
494494 not comply with this section and the specified municipality fails to request an
495495 243
496496 appeal of the division's determination of noncompliance within 10 days after the
497497 244
498498 day on which the second notice of noncompliance is sent; or
499499 245
500500 (iv) after submitting a request for an appeal under Subsection (8), the appeal board
501501 246
502502 issues a written decision upholding the division's determination of noncompliance.

504504 (b) The following apply to a specified municipality described in Subsection (9)(a) until
505505 248
506506 the division provides notice under Subsection (9)(e):

508508 (i) the executive director of the Department of Transportation may not program funds
509509 250
510510 from the Transportation Investment Fund of 2005, including the Transit
511511 251
512512 Transportation Investment Fund, to projects located within the boundaries of the
513513 252
514514 specified municipality in accordance with Subsection 72-2-124(5);
515515 253
516516 (ii) beginning with a report submitted in 2024, the specified municipality shall pay a
517517 254
518518 fee to the Olene Walker Housing Loan Fund in the amount of $250 per day that
519519 255
520520 the specified municipality:
521521 256
522522 (A) fails to submit the report to the division in accordance with this section,
523523 257
524524 beginning the day after the day on which the report was due; or
525525 258
526526 (B) fails to cure the deficiencies in the report, beginning the day after the day by
527527 259
528528 which the cure was required to occur as described in the notice of
529529 260
530530 noncompliance under Subsection (7); and
531531 261
532532 (iii) beginning with the report submitted in 2025, the specified municipality shall pay
533533 262
534534 a fee to the Olene Walker Housing Loan Fund in the amount of $500 per day that
535535 263
536536 the specified municipality, in a consecutive year:
537537 264
538538 (A) fails to submit the report to the division in accordance with this section,
539539 265
540540 beginning the day after the day on which the report was due; or
541541 266
542542 (B) fails to cure the deficiencies in the report, beginning the day after the day by
543543 267
544544 which the cure was required to occur as described in the notice of
545545 268
546546 noncompliance under Subsection (7).

548548 (c) Upon determining that a specified municipality is ineligible for funds under this

551551 Subsection (9), and is required to pay a fee under Subsection (9)(b), if applicable, the

553553 division shall send a notice of ineligibility to the legislative body of the specified
554554 272
555555 municipality, the Department of Transportation, the State Tax Commission, and the

557557 Governor's Office of Planning and Budget.

559559 (d) The notice described in Subsection (9)(c) shall:

561561 (i) name the specified municipality that is ineligible for funds;
562562 276
563563 (ii) describe the funds for which the specified municipality is ineligible to receive;

565565 (iii) describe the fee the specified municipality is required to pay under Subsection
566566 278
567567 (9)(b), if applicable; and
568568 279
569569 (iv) state the basis for the division's determination that the specified municipality is
570570 280
571571 ineligible for funds.

573573 (e) The division shall notify the legislative body of a specified municipality and the
574574 282
575575 Department of Transportation in writing if the division determines that the provisions

577577 of this Subsection (9) no longer apply to the specified municipality.

579579 (f) The division may not determine that a specified municipality that is required to pay a
580580 285
581581 fee under Subsection (9)(b) is in compliance with the reporting requirements of this
582582 286
583583 section until the specified municipality pays all outstanding fees required under
584584 287
585585 Subsection (9)(b) to the Olene Walker Housing Loan Fund, created under Title 35A,

589589 (10) In a civil action seeking enforcement or claiming a violation of this section or of

591591 Subsection 10-9a-404(4)(c), a plaintiff may not recover damages but may be awarded

593593 only injunctive or other equitable relief.

599599 (1)(a) The legislative body may divide the territory over which it has jurisdiction into

601601 zoning districts of a number, shape, and area that it considers appropriate to carry out
602602 296
603603 the purposes of this chapter.

605605 (b) Within those zoning districts, the legislative body may, subject to Section
606606 298
607607 10-9a-505.1, regulate and restrict the erection, construction, reconstruction,
608608 299
609609 alteration, repair, or use of buildings and structures, and the use of land.

611611 (c) A municipality may enact an ordinance regulating land use and development in a
612612 301
613613 flood plain or potential geologic hazard area to:
614614 302
615615 (i) protect life; and

617617 (ii) prevent:

620620 (A) the substantial loss of real property; or

622622 (B) substantial damage to real property.

624624 (2) The legislative body shall ensure that the regulations are uniform for each class or kind

626626 of buildings throughout each zoning district, but the regulations in one zone may differ

628628 from those in other zones.

630630 (3)(a) There is no minimum area or diversity of ownership requirement for a zone
631631 310
632632 designation.

634634 (b) Neither the size of a zoning district nor the number of landowners within the district

636636 may be used as evidence of the illegality of a zoning district or of the invalidity of a

638638 municipal decision.

640640 (4) A municipality may by ordinance exempt from specific zoning district standards a

642642 subdivision of land to accommodate the siting of a public utility infrastructure.

646646 10-9a-505.1 . Accessory dwelling unit permitted in an urban municipality.

648648 (1) As used in this section:

650650 (a) "Adjacent neighbor" means the owner of a property that has a shared boundary with
651651 320
652652 a property on which an owner has applied to build an external accessory dwelling
653653 321
654654 unit.

656656 (b) "Urban municipality" means a municipality in a county of the first or second class.

658658 (2) A single accessory dwelling unit, internal or external, is a permitted use if it is built:

660660 (a) in a residential zone of an urban municipality; and

662662 (b) on a lot that contains a detached single family dwelling.

664664 (3) An urban municipality may not require an external accessory dwelling unit to have:

666666 (a) larger setbacks than are required of a single family dwelling in the same zone; or

668668 (b) have a larger setback than is required for safety purposes if the impacted adjacent

670670 neighbor has consented in writing to the placement of the external accessory dwelling

672672 unit.

674674 (4) An urban municipality may not prohibit the use of a modular unit in a residential zone if

676676 the modular unit complies with the requirements of Title 15A, Chapter 1, Part 3, Factory

926926 unincorporated areas of a specified county described in Subsection (6)(a) until the

928928 Department of Transportation receives notice from the division under Subsection

934934 this Subsection (6), the division shall send a notice of prioritization to the legislative

936936 body of the specified county and the Department of Transportation.

940940 (i) name the specified county that qualifies for priority consideration;

942942 (ii) describe the funds or projects for which the specified county qualifies to receive
