39	39		Be it enacted by the Legislature of the state of Utah:

41	41		Section 1. Section 53B-2a-112 is amended to read:

43	43		53B-2a-112 . Technical colleges -- Relationships with other public and higher

45	45		education institutions -- Agreements -- Priorities -- New capital facilities.

47	47		(1) As used in this section, "higher education institution" means:

49	49		(a) Utah State University for:

51	51		(i) Bridgerland Technical College;

53	53		(ii) Tooele Technical College; and

55	55		(iii) Uintah Basin Technical College;

59	59		(i) Ogden-Weber Technical College; and

69	69		(2) A technical college may enter into agreements:

71	71		(a) with other higher education institutions to cultivate cooperative relationships; or

73	73		(b) with other public and higher education institutions to enhance career and technical

75	75		education within the technical college's region.

77	77		(3) Before a technical college develops new instructional facilities, the technical college

79	79		shall give priority to:

81	81		(a) maintaining the technical college's existing instructional facilities for both secondary

83	83		and adult students;

85	85		(b) coordinating with the president of the technical college's degree-granting partner and

87	87		entering into any necessary agreements to provide career and technical education to

89	89		secondary and adult students that:

91	91		(i) maintain and support existing higher education career and technical education

93	93		programs; and
94	94		45
95	95		(ii) maximize the use of existing higher education facilities; and

97	97		(c) developing cooperative agreements with school districts, charter schools, other

99	99		higher education institutions, businesses, industries, and community and private
100	100		48
101	101		agencies to maximize the availability of career and technical education instructional
102	102		49
103	103		facilities for both secondary and adult students.

105	105		(4)(a) Before submitting a funding request pertaining to new capital facilities and land
106	106		51
107	107		purchases to the board, a technical college shall:

109	109		(i) ensure that all available instructional facilities are maximized in accordance with

111	111		Subsections (3)(a) through (c); and
112	112		54
113	113		(ii) coordinate the request with the president of the technical college's
114	114		55
115	115		degree-granting partner, if applicable.

117	117		(b) The Division of Facilities Construction and Management shall make a finding that

119	119		the requirements of this section are met before the Division of Facilities Construction
120	120		58
121	121		and Management may consider a funding request from the board pertaining to new
122	122		59
123	123		capital facilities and land purchases for a technical college.

125	125		(c) A technical college may not construct, approve the construction of, [plan for the

127	127		design or construction of, ]or consent to the construction of a career and technical

129	129		education facility without approval of the Legislature.

132	131		(5) Before acquiring new fiscal and administrative support structures, a technical college

136	136		(a) review the use of existing public or higher education administrative and accounting

138	138		systems, financial record systems, and student and financial aid systems for the

140	140		delivery of education in the region;

142	142		(b) determine the feasibility of using existing systems; and

144	144		(c) with the approval of the technical college board of trustees and the board, use the

146	146		existing systems.
