Section 26B-2-602 is amended to read: 23 26B-2-602 . Department rulemaking authority. 24 The department shall make rules under Title 63G, Chapter 3, Utah Administrative 25 Rulemaking Act: 26 (1) establishing quality assurance standards for all facilities performing screening or 27 diagnostic mammography and developing mammogram x-ray films, including 28 notification and procedures for clinical follow-up of abnormal mammograms; and H.B. 146 Enrolled Copy 29 (2) providing for: 30 (a) collection and periodic reporting of mammography examinations and clinical 31 follow-up data to the department; 32 (b) certification and revocation of certification of mammogram facilities; 33 (c) inspection of mammogram facilities, including entry of agents of the department into 34 the facilities for inspections; 35 (d) setting fees for certification; and 36 (e) an appeal process regarding department certification decisions[; and] . 37 [(3) requiring a facility that is certified under Section 26B-2-603 to comply with the 38 notification requirement described in Section 26B-2-605. ] 39 Section 2. Section 26B-2-604 is amended to read: 40 26B-2-604 . Department duties. 41 The department shall: 42 (1) enforce rules established under this part; 43 [(2) implement and enforce the notice requirement in Section 26B-2-605;] 44 [(3)] (2) authorize qualified department agents to conduct inspections of mammogram 45 facilities under department rules; 46 [(4)] (3) collect and credit fees for certification established by the department in accordance 47 with Section 63J-1-504; and 48 [(5)] (4) provide necessary administrative and staff support to the committee. 49 Section 3. Repealer. 50 This bill repeals: 51 Section 26B-2-605, Women's cancer screening notification requirement. 52 Section 4. Effective date. 53 This bill takes effect on May 7, 2025. - 2 -
