General Description:

This bill creates the criminal offense of damaging a firearm storage container or safety

device during the commission of a burglary.

Be it enacted by the Legislature of the state of Utah:
22 
Section 1.  Section 76-6-202.3 is enacted to read:
23 
76-6-202.3 . Damaging a firearm storage container or safety device in the
24 
commission of a burglary.
25 
(1)(a) As used in this section:
26 
(i) "Burglary" means:
27 
(A) the offense of burglary as described in Section 76-6-202;
28 
(B) the offense of aggravated burglary as described in Section 76-6-203;
29 
(C) the offense of burglary of a vehicle as described in Section 76-6-204; or
30 
(D) the offense of burglary of a railroad car as described in Section 76-6-204.5.

(ii) "Firearm safety device" means a firearm trigger lock or other device intended to  H.B. 221	01-14 16:04

prevent a firearm from being able to fire.

(iii) "Firearm storage container" means a box, case, chest, locker, safe, or similar
34 
receptacle that:
35 
(A) can be locked or otherwise secured in a manner to prevent an individual from
36 
accessing the contents of the container; and
37 
(B) is designed to contain, or contains, a firearm.
38 
(b) Terms defined in Sections 76-1-101.5 and 76-6-201 apply to this section.
39 
(2) An actor commits damaging a firearm storage container or safety device in the
40 
commission of a burglary if, in attempting, committing, or fleeing from a burglary, the
41 
actor knowingly damages, disables, or otherwise tampers with:
42 
(a) a firearm storage container; or
43 
(b) a firearm safety device.
44 
(3) A violation of Subsection (2) is a third degree felony.
45 
Section 2.  Effective Date.
46 
This bill takes effect on May 7, 2025.
