46	46	Be it enacted by the Legislature of the state of Utah:

48	48	Section 1. Section 76-6-202.3 is enacted to read:

50	50	76-6-202.3 . Damaging a firearm storage container or safety device in the

52	52	commission of a burglary.

54	54	(1)(a) As used in this section:

56	56	(i) "Burglary" means:
57	57	27
58	58	(A) the offense of burglary as described in Section 76-6-202;

60	60	(B) the offense of aggravated burglary as described in Section 76-6-203;

62	62	(C) the offense of burglary of a vehicle as described in Section 76-6-204; or

64	64	(D) the offense of burglary of a railroad car as described in Section 76-6-204.5.

68	68	prevent a firearm from being able to fire.

70	70	(iii) "Firearm storage container" means a box, case, chest, locker, safe, or similar

72	72	receptacle that:

74	74	(A) can be locked or otherwise secured in a manner to prevent an individual from

76	76	accessing the contents of the container; and

78	78	(B) is designed to contain, or contains, a firearm.

80	80	(b) Terms defined in Sections 76-1-101.5 and 76-6-201 apply to this section.

82	82	(2) An actor commits damaging a firearm storage container or safety device in the

84	84	commission of a burglary if, in attempting, committing, or fleeing from a burglary, the

86	86	actor knowingly damages, disables, or otherwise tampers with:

88	88	(a) a firearm storage container; or

90	90	(b) a firearm safety device.

92	92	(3) A violation of Subsection (2) is a third degree felony.
