4646 Be it enacted by the Legislature of the state of Utah:

4848 Section 1. Section 76-6-202.3 is enacted to read:

5050 76-6-202.3 . Damaging a firearm storage container or safety device in the

5252 commission of a burglary.

5454 (1)(a) As used in this section:

5656 (i) "Burglary" means:

5858 (A) the offense of burglary as described in Section 76-6-202;

6060 (B) the offense of aggravated burglary as described in Section 76-6-203;

6262 (C) the offense of burglary of a vehicle as described in Section 76-6-204; or

6464 (D) the offense of burglary of a railroad car as described in Section 76-6-204.5.

6868 prevent a firearm from being able to fire.

7070 (iii) "Firearm storage container" means a box, case, chest, locker, safe, or similar

7474 (A) can be locked or otherwise secured in a manner to prevent an individual from

7676 accessing the contents of the container; and

7878 (B) is designed to contain, or contains, a firearm.

8080 (b) Terms defined in Sections 76-1-101.5 and 76-6-201 apply to this section.

8282 (2) An actor commits damaging a firearm storage container or safety device in the

8484 commission of a burglary if, in attempting, committing, or fleeing from a burglary, the

8686 actor knowingly damages, disables, or otherwise tampers with:

8888 (a) a firearm storage container; or

9090 (b) a firearm safety device.

9292 (3) A violation of Subsection (2) is a third degree felony.
