Section 41-6a-604 is amended to read: 19 41-6a-604 . Maximum speed in a school zone -- Penalty -- Minimum fines -- 20 Compensatory service -- Waiver -- Recordkeeping. 21 (1) A person may not operate a vehicle at a speed greater than 20 miles per hour in a 22 reduced speed school zone as defined in Section 41-6a-303. 23 (2)(a) A violation of Subsection (1) is a class C misdemeanor and the minimum fine: 24 (i) for a first offense shall be calculated according to the following schedule: 25 Vehicle Speed Minimum Fine26 21 - 29 MPH $ 260 27 30 - 39 MPH $ 420 28 40 MPH and greater $ 760 H.B. 225 H.B. 225 02-26 09:20 29 (ii) for a second and subsequent offense within three years of a previous conviction 30 or bail forfeiture shall be calculated according to the following schedule: 31 Vehicle Speed Minimum Fine32 21 - 29 MPH $ 320 33 30 - 39 MPH $ 560 34 40 MPH and greater $ 960 35 (b)(i) Except as provided under Subsection (2)(a)(ii), the court may order the person 36 to perform compensatory service in lieu of the fine or any portion of the fine for 37 an offense with a vehicle speed above 20 miles per hour. 38 (ii) The court Ŝ→ [shall] may ←Ŝ order the person to perform compensatory 38a service observing a 39 crossing guard if the conviction is for[ a:] : 40 (A) a first offense with a vehicle speed of [30 Ŝ→ 40] 35 ←Ŝ 40a miles per hour or more; or 41 (B) [second and subsequent offense within three years of a previous conviction or 42 bail forfeiture.] a second or subsequent offense if the driver has a prior 43 conviction or bail forfeiture within three years of the conviction. 44 (iii) The court may waive the compensatory service required under Subsection 45 (2)(b)(ii) if the court makes the reasons for the waiver part of the record. 46 (3) The Driver License Division shall develop and implement a record system to 47 distinguish: 48 (a) a conviction or bail forfeiture under this section from other convictions; and 49 (b) between a first and subsequent conviction or bail forfeiture under this section. 50 (4) The provisions of this section take precedence over the provisions of Sections 41-6a-601, 51 41-6a-602, 41-6a-603, and 76-3-301. 52 Section 2. Effective Date. 53 This bill takes effect on May 7, 2025. - 2 -
