105107 Section 1. Section 41-1a-401 is amended to read:

111113 (1)(a) Except as provided in Subsections (1)(c), (d), and (e), the division upon

113115 registering a vehicle shall issue to the owner:

115117 (i) one license plate for a motorcycle, trailer, or semitrailer;

117119 (ii) one registration decal for a park model recreational vehicle, in lieu of a license

119121 plate, which shall be attached in plain sight to the rear of the park model

121123 recreational vehicle;

123125 (iii) one registration decal for a camper, in lieu of a license plate, which shall be

125127 attached in plain sight to the rear of the camper; and

127129 (iv) one license plate for every other vehicle.

130131 (b) The license plate or registration decal issued under Subsection (1)(a) is for the

132134 particular vehicle registered and may not be removed during the term for which the

134136 license plate or registration decal is issued or used upon any other vehicle than the

138140 (c)(i) Notwithstanding Subsections (1)(a) and (b) and except as provided in

140142 Subsection (1)(c)(ii), the division, upon registering a motor vehicle that has been

142144 sold, traded, or the ownership of which has been otherwise released, shall transfer

144146 the license plate issued to the person applying to register the vehicle if:

146148 (A) the previous registered owner has included the license plate as part of the sale,

148150 trade, or ownership release; and

150152 (B) the person applying to register the vehicle applies to transfer the license plate

152154 to the new registered owner of the vehicle.

154156 (ii) The division may not transfer a personalized or special group license plate to a

156158 new registered owner under this Subsection (1)(c) if the new registered owner

158160 does not meet the qualification or eligibility requirements for that personalized or

160162 special group license plate under this part or Part 16, Sponsored Special Group

162164 License Plates.

164166 (d)(i) For a vehicle described in Section 41-1a-301, the division upon registering a

166168 vehicle shall issue a license plate or set of license plates as provided in that section.

168170 (ii) For any [commercial vehicle that operates intrastate] vehicle not described in

170172 Subsection (1)(d)(i), at the request of the registrant, the division upon registering a

172174 vehicle may issue two license plates, for display on both the front and rear of the [

174176 intrastate commercial ]vehicle.

176178 (e) The division upon registering a vehicle may, until inventory of license plate sets is

178180 exhausted, but no later than December 31, 2025, issue a set of two plates.

180182 (f) The division shall ensure that license plates are distributed from a central location as

182184 soon as practicable, but no later than July 1, 2025.

184186 (2) The division may receive applications for registration renewal, renew registration, and

186188 issue a new license plate or registration decal at any time prior to the expiration of

190192 (3)(a)(i) Except as provided in Subsection (3)(a)(ii), all license plates to be

192194 manufactured and issued by the division shall be treated with a fully reflective

194196 material on the plate face that provides effective and dependable reflective

215217 manufacturers may qualify as suppliers.

217219 (d) The granting of contracts for the materials shall be by public bid.

219221 (4)(a) The commission may issue, adopt, and require the use of indicia of registration it

221223 considers advisable in lieu of or in conjunction with license plates as provided in this

225227 (b) All provisions of this part relative to license plates apply to these indicia of

227229 registration, so far as the provisions are applicable.

235237 (1) In accordance with this chapter, the division shall issue to an eligible applicant a special

237239 group license plate in one of the following categories:

239241 (a) a disability special group license plate issued in accordance with Section 41-1a-420;

241243 (b) a special group license plate issued for a:

243245 (i) vintage vehicle;

245247 (ii) farm truck; or

247249 (iii) special group license plate described in Section 41-1a-1602.

249251 (2) The division may not issue a new type of special group license plate or symbol decal

251253 unless the division receives:

253255 (a) a private donation for the start-up fee established under Section 63J-1-504 for the

255257 production and administrative costs of providing the new special group license plate

257259 or symbol decal; or

259261 (b) a legislative appropriation for the start-up fee described in Subsection (2)(a).

261263 (3) Notwithstanding other provisions of this chapter, the division may not require a

274276 (1)(a) In accordance with Subsection (1)(c), and except as provided in Subsection (1)(b),

276278 the division shall determine the design and number of numerals or characters on a

280282 (b)(i) When the division has technology and processes in place to centrally distribute

282284 license plates, but no later than July 1, 2025, subject to Subsection (1)(c)(iii), an

284286 institution may design a collegiate special group license plate for the institution in

286288 accordance with Subsection (1)(c).

288290 (ii) If an institution chooses to design a collegiate special group license plate for the

290292 institution, the institution is responsible for any design costs.

292294 (c)(i) Except as provided in Subsection (1)(c)(ii), each special group license plate

294296 shall display:

296298 (A) the word Utah;

298300 (B) the name or identifying slogan of the special group; and

300302 (C) the combination of letters, numbers, or both uniquely identifying the

302304 registered vehicle.

304306 (ii) The division, in consultation with the Utah State Historical Society, shall design

306308 the historical support special group license plate, which shall:

308310 (A) have a black background;

310312 (B) have white characters; and

312314 (C) display the word Utah.

314316 (iii) The division shall design a classic support special group license plate, which

318320 (A) have a white background;

324326 [(iii)] (iv) The design of a special group license plate is subject to approval by the

326328 license plate design review board as described in Subsection 41-1a-402(3).

328330 (2)(a) The division shall, after consultation with a representative designated by the

330332 sponsoring organization as defined in Section 41-1a-1601, specify the word or words

351353 (3) The license plates issued for horseless carriages prior to July 1, 1992, are valid without

353355 renewal as long as the vehicle is owned by the registered owner and the license plates

355357 may not be recalled by the division.

357359 (4) A person who meets the requirements described in this part or Part 16, Sponsored

359361 Special Group License Plates, for a special group license plate may, apply for a

361363 personalized special group license plate in accordance with Sections 41-1a-410 and

365367 (5) Subject to this chapter, the commission shall make rules in accordance with Title 63G,

367369 Chapter 3, Utah Administrative Rulemaking Act, to:

369371 (a) establish qualifying criteria for persons to receive, renew, or surrender special group

373375 (b) establish the number of numerals or characters for special group license plates.

387389 (i) relief of the poor, the distressed, or the underprivileged;

393395 (iv) erecting or maintaining a public building, monument, or work;

395397 (v) reducing the burdens of government;

401403 (viii) defending human rights and civil rights secured by law; or

446448 (b) a private institution of higher education in the state accredited by a regional or

450452 (9) "Major league sport" means the same as that term is defined in Section 11-70-101.

454456 (i) qualifies as being tax exempt under Section 501(c)(3) of the Internal Revenue

566568 (a) in a form and manner that the division prescribes, a complete application;

568570 (b) payment of the fee for the issuance of the sponsored special group license plate

572574 (c) the required contribution for the sponsored special group license plate, unless the

574576 applicant previously paid the required contribution as part of a preorder application

576578 described in Subsection [(4)] (3); and

578580 (d) if the sponsoring organization elects to require verification as described in Section

580582 41-1a-1604, a verification form obtained from the sponsoring organization.

582584 (2) An applicant who owns a vehicle with the sponsoring organization's sponsored special

584586 group license plate shall submit to the division the required contribution to renew the

586588 sponsored special group license plate.

588590 (3)(a) An applicant who wishes to obtain a new type of sponsored special group license

590592 plate may preorder the new type of sponsored special group license plate by:

592594 (i) submitting to the sponsoring organization associated with the new type of

594596 sponsored special group license plate a complete preorder form created by the
595597 292
596598 division; and

598600 (ii) making the required contribution to the sponsoring organization.

600602 (b) After the division approves the sponsoring organization's request for the new type of

602604 sponsored special group license plate under Section 41-1a-1604, an applicant who

604606 submitted a preorder in accordance with Subsection (3)(a) may apply for the

606608 sponsored special group license plate in accordance with Subsection (1).

608610 (4)(a) The division shall, in accordance with Section 63J-1-504, establish:

610612 (i) the fee to charge an applicant for the division's costs of issuing or renewing a

621623 (iii) subject to [Subsection (4)(b)] Subsections (4)(b) and (6), in an amount equal to at

623625 least $25, the minimum annual contribution amount an applicant is required to

625627 make to obtain or renew the sponsoring organization's sponsored special group

629631 (b) A fee paid in accordance with Subsection (4)(a)(i) shall be deposited into the License

631633 Plate Restricted Account created in [Subsection] Section 41-1a-122.

633635 (c) A sponsoring organization may establish a required contribution amount for the

635637 sponsoring organization's sponsored special group license plate that is greater than

637639 the amount established by the division under Subsection (4)(a)(ii).

639641 (5) An applicant's contribution is a voluntary contribution for funding the sponsoring

641643 organization's activities and not a motor vehicle registration fee.

643645 (6) Beginning on July 1, 2025, an applicant's voluntary contribution described in

645647 Subsection (4)(a)(iii) for the historical support special group license plate described in

647649 Section 41-1a-419 is $25 which the division shall allocate as follows:

649651 (a) $2 to the Utah State Historical Society as the sponsoring organization; and

651653 (b) $23 into the Transportation Investment Fund of 2005, created in Section 72-2-124.

653655 (7) For a fiscal year beginning on July 1, 2025, only, the division shall transfer into the

655657 General Fund $3,500,000 from the Sponsored Special Group License Plate Fund created

657659 in Section 41-1a-1610 from funds generated by the historical support special group
