517+regulated under this chapter; or

519+(iv) violation of this chapter by any person;

521+(d) with the concurrence of the director, impose a sanction as provided in Section

525+(e) advise the director on the administration and enforcement of a matter affecting the

527+division and the real estate sales and property management industries;

529+(f) advise the director on matters affecting the division budget;

533+(h) perform other duties as provided by this chapter.

535+(3)(a) Except as provided in Subsection (3)(b), a state entity may not, without the

537+concurrence of the commission, make a rule that changes the rights, duties, or

539+obligations of buyers, sellers, or persons licensed under this chapter in relation to a

541+real estate transaction between private parties.

543+(b) Subsection (3)(a) does not apply to a rule made:

545+(i) under Title 31A, Insurance Code, or Title 7, Financial Institutions Act; or

552+(4)(a) The commission [shall be comprised] consists of five members appointed by the

554+governor and approved by the Senate in accordance with Title 63G, Chapter 24, Part

558+(b) Four of the commission members shall:

560+(i) have at least five years' experience in the real estate business; and

562+(ii) hold an active principal broker, associate broker, or sales agent license.

566+(d) The governor may not appoint a commission member described in Subsection (4)(b)

568+who, at the time of appointment, resides in the same county in the state as another
