(Buff) H.B. 370 Sandra Hollins proposes the following substitute bill: 1 State Holiday Modifications 2025 GENERAL SESSION STATE OF UTAH Chief Sponsor: Sandra Hollins Senate Sponsor: 2 3 LONG TITLE 4 General Description: 5 This bill modifies the day on which Juneteenth National Freedom Day is recognized in 6 Utah. 7 Highlighted Provisions: 8 This bill: 9 ▸ provides that June 19, called Juneteenth National Freedom Day, is a legal holiday in Utah; 10 ▸ consistent with other legal holidays in Utah, provides for recognition of Juneteenth 11 National Freedom Day on the preceding Friday or subsequent Monday if the holiday 12 falls on a Saturday or Sunday, respectively; and 13 ▸ amends parent-time schedules in relation to Juneteenth National Freedom Day. 14 Money Appropriated in this Bill: 15 None 16 Other Special Clauses: 17 This bill provides a special effective date. 18 Utah Code Sections Affected: 19 AMENDS: 20 63G-1-301, as last amended by Laws of Utah 2022, Chapter 331 21 81-9-302, as renumbered and amended by Laws of Utah 2024, Chapter 366 22 81-9-303, as renumbered and amended by Laws of Utah 2024, Chapter 366 23 81-9-304, as renumbered and amended by Laws of Utah 2024, Chapter 366 24 25 Be it enacted by the Legislature of the state of Utah: 26 Section 1. Section 63G-1-301 is amended to read: 27 63G-1-301 . Legal holidays -- Personal preference day -- Governor authorized to 28 declare additional days. 29 (1)(a) The following named days are legal holidays in this state: 1st Sub. H.B. 370 1st Sub. (Buff) H.B. 370 02-06 12:20 30 (i) every Sunday, except as provided in Subsection (1)(e); 31 (ii) January 1, called New Year's Day; 32 (iii) the third Monday of January, called Dr. Martin Luther King, Jr. Day; 33 (iv) the third Monday of February, called Washington and Lincoln Day; 34 (v) the last Monday of May, called Memorial Day; 35 (vi) [on the day described in Subsection (1)(f),] June 19, called Juneteenth National 36 Freedom Day; 37 (vii) July 4, called Independence Day; 38 (viii) July 24, called Pioneer Day; 39 (ix) the first Monday of September, called Labor Day; 40 (x) the second Monday of October, called Columbus Day; 41 (xi) November 11, called Veterans Day; 42 (xii) the fourth Thursday of November, called Thanksgiving Day; 43 (xiii) December 25, called Christmas; and 44 (xiv) all days which may be set apart by the President of the United States, or the 45 governor of this state by proclamation as days of fast or thanksgiving. 46 (b) If any of the holidays under Subsections (1)(a)(ii) [through (v) or Subsections 47 (1)(a)(vii) ]through (xiv), falls on Sunday, then the following Monday shall be the 48 holiday. 49 (c) If any of the holidays under Subsections (1)(a)(ii) [through (v) or Subsections 50 (1)(a)(vii) ]through (xiv) falls on Saturday, then the preceding Friday shall be the 51 holiday. 52 (d) Each employee may select one additional day, called Personal Preference Day, to be 53 scheduled pursuant to rules adopted by the Division of Human Resource 54 Management. 55 (e) For purposes of Utah Constitution Article VI, Section 16, Subsection (1), regarding 56 the exclusion of state holidays from the 45-day legislative general session, Sunday is 57 not considered a state holiday. 58 [(f)(i) The Juneteenth National Freedom Day holiday is on June 19, if that day is on 59 a Monday.] 60 [(ii) If June 19 is on a Tuesday, Wednesday, Thursday, or Friday, the Juneteenth 61 National Freedom Day holiday is on the immediately preceding Monday.] 62 [(iii) If June 19 is on a Saturday or Sunday, the Juneteenth National Freedom Day 63 holiday is on the immediately following Monday.] - 2 - 02-06 12:20 1st Sub. (Buff) H.B. 370 64 (2)(a) Whenever in the governor's opinion extraordinary conditions exist justifying the 65 action, the governor may: 66 (i) declare, by proclamation, legal holidays in addition to those holidays under 67 Subsection (1); and 68 (ii) limit the holidays to certain classes of business and activities to be designated by 69 the governor. 70 (b) A holiday may not extend for a longer period than 60 consecutive days. 71 (c) Any holiday may be renewed for one or more periods not exceeding 30 days each as 72 the governor may consider necessary, and any holiday may, by like proclamation, be 73 terminated before the expiration of the period for which it was declared. 74 Section 2. Section 81-9-302 is amended to read: 75 81-9-302 . Minimum schedule for parent-time for a minor child five to 18 years 76 old. 77 (1) The parent-time schedule in this section applies to a minor child who is five to 18 years 78 old. 79 (2) If the parties do not agree to a parent-time schedule for a minor child described in 80 Subsection (1), the following schedule is considered the minimum parent-time to which 81 the noncustodial parent is entitled to the minor child: 82 (a)(i) one weekday evening to be specified by the noncustodial parent or the court or 83 Wednesday evening if not specified, beginning at 5:30 p.m. and ending at 8:30 84 p.m.; or 85 (ii) at the election of the noncustodial parent, one weekday to be specified by the 86 noncustodial parent or the court: 87 (A) beginning at the time that the minor child's school is regularly dismissed and 88 ending at 8:30 p.m.; or 89 (B) if school is not in session, the noncustodial parent is available to be with the 90 minor child, and in accommodation with the custodial parent's work schedule, 91 beginning at 9 a.m. and ending at 8:30 p.m.; 92 (b)(i) beginning on the first weekend after entry of the decree, alternating weekends 93 beginning at 6 p.m. on Friday and ending on Sunday at 7 p.m.; or 94 (ii) at the election of the noncustodial parent and beginning on the first weekend after 95 the entry of the decree, alternating weekends: 96 (A) beginning at the time that the minor child's school is regularly dismissed on 97 Friday and ending on Sunday at 7 p.m.; or - 3 - 1st Sub. (Buff) H.B. 370 02-06 12:20 98 (B) if school is not in session, the noncustodial parent is available to be with the 99 minor child, and in accommodation with the custodial parent's work schedule, 100 beginning on Friday at 9 a.m. and ending on Sunday at 7 p.m.; 101 (c) each holiday granted to the noncustodial parent in accordance with the holiday 102 schedule described in Subsection (12); and 103 (d) extended parent-time with the minor child when school is not in session for summer 104 break in accordance with Subsection (3). 105 (3)(a) For extended parent-time with the minor child under Subsection (2)(d) and at the 106 election of the noncustodial parent, the noncustodial parent is entitled up to four 107 weeks of parent-time with the minor child, which may be consecutive, when school is 108 not in session for summer break. 109 (b) For the four weeks of extended parent-time for a noncustodial parent under 110 Subsection (3)(a): 111 (i) two weeks, which may be consecutive, shall be uninterrupted parent-time for the 112 noncustodial parent; and 113 (ii) two weeks, which may be consecutive, may be interrupted by the custodial parent 114 for a weekday visit on the same day on which the noncustodial parent is granted 115 weekday day parent-time. 116 (c) A custodial parent is entitled to uninterrupted parent-time with the minor child for 117 two weeks, which may be consecutive, when school is not in session for summer 118 break. 119 (4)(a) Each parent shall provide notification to the other parent of the parent's plans for 120 the exercise of extended parent-time for summer break under Subsection (3). 121 (b) For the notification requirement under Subsection (4)(a): 122 (i) in odd-numbered years: 123 (A) the noncustodial parent shall provide notice to the custodial parent by May 1; 124 and 125 (B) the custodial parent shall provide notice to the noncustodial parent by May 15; 126 and 127 (ii) in even-numbered years: 128 (A) the custodial parent shall provide notice to the noncustodial parent by May 1; 129 and 130 (B) the noncustodial parent shall provide notice to the custodial parent by May 15. 131 (c)(i) If a parent fails to provide a notification within the time periods described in - 4 - 02-06 12:20 1st Sub. (Buff) H.B. 370 132 Subsection (4)(b), the complying parent may determine the schedule for summer 133 break for the noncomplying parent. 134 (ii) If both parents fail to provide notice within the time periods described in 135 Subsection (4)(b), the first parent to provide notice may determine the schedule 136 for summer break for the other parent. 137 (d) If a custodial parent intends to interrupt a noncustodial parent's parent-time under 138 Subsection (3)(b)(ii), the custodial parent shall provide notification to the 139 noncustodial parent of the intent to interrupt parent-time within 10 days after the day 140 on which the custodial parent receives notification of the noncustodial parent's plans 141 for the exercise of interrupted extended parent-time. 142 (5)(a) An election should be made by the noncustodial parent at the time of entry of the 143 divorce decree or court order, except that the election may be changed by mutual 144 agreement, court order, or by the noncustodial parent in the event of a change in the 145 minor child's schedule. 146 (b) An election by either parent concerning parent-time shall be made a part of the 147 decree and made a part of the parent-time order. 148 (6)(a) Changes may not be made to the parent-time schedule under this section, except 149 that if a conflict arises in the parent-time schedule, the following order of precedence 150 shall be applied when determining which parent is entitled to parent-time: 151 (i) the holiday schedule for Mother's Day or Father's Day under Subsection (12); 152 (ii) the holiday schedule for the minor child's birthday, unless a parent is exercising 153 uninterrupted extended parent-time under Subsection (3) and takes the minor child 154 away from that parent's residence during the uninterrupted extended parent-time; 155 (iii) the holiday schedule for any holiday under Subsection (12) that is not Father's 156 Day, Mother's Day, or the minor child's birthday; 157 (iv) extended parent-time under Subsection (3); and 158 (v) the schedule for weekday or weekend parent-time. 159 (b) A parent exercising parent-time for the minor child's birthday may bring other 160 siblings along for the minor child's birthday. 161 (7) A stepparent, grandparent, or other responsible adult designated by the noncustodial 162 parent, may pick up the minor child for parent-time if the custodial parent is aware of 163 the identity of the individual and the noncustodial parent will be with the minor child by 164 7 p.m. 165 (8) If a holiday falls on a regularly scheduled school day, the parent exercising parent-time - 5 - 1st Sub. (Buff) H.B. 370 02-06 12:20 166 shall be responsible for the minor child's attendance at school for that school day. 167 (9) If there is more than one minor child and the minor children's school schedules vary for 168 purpose of a holiday, at the option of the parent exercising the holiday or the parent's 169 half of the holiday, the minor children may remain together for the holiday period 170 beginning the first evening that all minor children's schools are dismissed for the holiday 171 and ending the evening before any minor child returns to school. 172 (10)(a) Telephone contact shall be at reasonable hours and for a reasonable duration. 173 (b)(i) Virtual parent-time, if the equipment is reasonably available and the parents 174 reside at least 100 miles apart, shall be at reasonable hours and for reasonable 175 duration. 176 (ii) If the parties cannot agree on whether the equipment is reasonably available, the 177 court shall decide whether the equipment for virtual parent-time is reasonably 178 available, taking into consideration: 179 (A) the best interests of the minor child; 180 (B) each parent's ability to handle any additional expenses for virtual parent-time; 181 and 182 (C) any other factors the court considers material. 183 (c) Virtual parent-time supplements, but does not replace, in-person parent-time. 184 (11) If there is a minor child five to 18 years old and a minor child under five years old and 185 both minor children are the children of the parties, the parents and the court should 186 consider an upward deviation for parent-time with all the minor children so that 187 parent-time is uniform based on a schedule under this section. 188 (12) The following table is the holiday schedule for parent-time under this section. 189 Holiday Holiday Time Period Years Noncustodial Parent is Granted Holiday Years Custodial Parent is Granted Holiday 190 Dr. Martin Luther King Jr. Day (1) Holiday begins Friday at:(a) 9 a.m. if school is not in session and the parent can be with the minor child; (b) the time that school is regularly dismissed; or (c) 6 p.m. at the election of the parent granted the holiday. (2) Holiday ends at 6 p.m. on the day following Juneteenth National Freedom Day.] (1) Holiday begins on June 18th at 7 p.m. and ends on June 20th at 7 p.m., if Fathers Day is on a day other than June 19th or June 20th. Section 81-9-303 is amended to read: 210 81-9-303 . Optional schedule for parent-time for a minor child five to 18 years 211 old. 212 (1)(a) The optional parent-time schedule in this section applies to a minor child who is 213 five to 18 years old. 214 (b) For purposes of calculating child support, the optional parent-time schedule in this 215 section is 145 overnights. 216 (c) Any impact on child support shall be consistent with joint physical custody. 217 (2) The parents and the court may consider the increased parent-time schedule in this 218 section as a minimum parent-time schedule when the parties agree or the noncustodial 219 parent can demonstrate: 220 (a) the noncustodial parent has been actively involved in the minor child's life; 221 (b) the parties can communicate effectively regarding the minor child or the 222 noncustodial parent has a plan to accomplish effective communications regarding the 223 minor child; 224 (c) the noncustodial parent has the ability to facilitate the increased parent-time; 225 (d) the increased parent-time would be in the best interest of the minor child; and 226 (e) any other factor the court considers relevant. 227 (3) In determining whether a noncustodial parent has been actively involved in the minor 228 child's life, the court shall consider: 229 (a) demonstrated responsibility in caring for the minor child; 230 (b) involvement in childcare; 231 (c) presence or volunteer efforts in the minor child's school and at extracurricular 232 activities; 233 (d) assistance with the minor child's homework; 234 (e) involvement in preparation of meals, bath time, and bedtime for the minor child; 235 (f) bonding with the minor child; and 236 (g) any other factor the court considers relevant. 237 (4) In determining whether a noncustodial parent has the ability to facilitate the increased 238 parent-time, the court shall consider: 239 (a) the geographic distance between the residences of the parents and the distance - 11 - 1st Sub. (Buff) H.B. 370 02-06 12:20 240 between the parents' residences and the minor child's school; 241 (b) the noncustodial parent's ability to assist with after school care; 242 (c) the health of the minor child and the noncustodial parent in accordance with 243 Subsection 81-9-204(5); 244 (d) flexibility of employment or another schedule of the noncustodial parent; 245 (e) ability to provide appropriate playtime with the minor child; 246 (f) history and ability of the noncustodial parent to implement a flexible schedule for the 247 minor child; 248 (g) physical facilities of the noncustodial parent's residence; and 249 (h) any other factor the court considers relevant. 250 (5) If the parties agree or the court enters an order for the optional parent-time schedule 251 under this section, a parenting plan in compliance with Section 81-9-203 shall be filed 252 with any order incorporating the optional parent-time schedule described in Subsection 253 (6). 254 (6) The following schedule is considered the optional parent-time to which the noncustodial 255 parent is entitled to the minor child: 256 (a)(i) one weekday evening to be specified by the noncustodial parent or the court or 257 Wednesday evening if not specified, beginning at 5:30 p.m. and ending the 258 following day upon delivering the minor child to school or at 8 a.m. if there is no 259 school; or 260 (ii) at the election of the noncustodial parent, one weekday specified by the 261 noncustodial parent or the court: 262 (A) beginning at the time the minor child's school is regularly dismissed until the 263 following day upon delivering the minor child to school or at 8 a.m. if there is 264 no school; or 265 (B) if there is no school, the noncustodial parent is available to be with the minor 266 child, and in accommodation with the custodial parent's work schedule, 267 beginning at 8 a.m. and ending on the following day upon delivering the minor 268 child to school or at 8 a.m. if there is no school; 269 (b)(i) beginning the first weekend after the entry of the decree, alternating weekends 270 beginning at 6 p.m. on Friday and ending on Monday upon delivering the minor 271 child to school or at 8 a.m. if there is no school; or 272 (ii) at the election of the noncustodial parent, beginning the first weekend after the 273 entry of the decree, alternating weekends: - 12 - 02-06 12:20 1st Sub. (Buff) H.B. 370 274 (A) beginning at the time the minor child's school is regularly dismissed on Friday 275 and ending on Monday upon delivering the minor child to school or at 8 a.m. if 276 there is no school; or 277 (B) if there is no school, the noncustodial parent is available to be with the minor 278 child, and in accommodation with the custodial parent's work schedule, 279 beginning on Friday at 9 a.m. and ending on Monday upon delivering the 280 minor child to school or at 8 a.m. if there is no school; 281 (c) each holiday granted to the noncustodial parent in accordance with the holiday 282 schedule described in Subsection (15); and 283 (d) extended parent-time with the minor child when school is not in session for summer 284 break in accordance with Subsection (7). 285 (7)(a) For extended parent-time with the minor child under Subsection (6)(d) and at the 286 election of the noncustodial parent, the noncustodial parent is entitled up to four 287 weeks of parent-time with the minor child, which may be consecutive, when school is 288 not in session for summer break. 289 (b) For the four weeks of extended parent-time for a noncustodial parent under 290 Subsection (7)(a): 291 (i) two weeks, which may be consecutive, shall be uninterrupted parent-time for the 292 noncustodial parent; and 293 (ii) two weeks, which may be consecutive, may be interrupted by the custodial parent 294 for a weekday visit on the same day on which the noncustodial parent is granted 295 weekday day parent-time. 296 (c) A custodial parent is entitled to uninterrupted parent-time with the minor child for 297 two weeks, which may be consecutive, when school is not in session for summer 298 break. 299 (8)(a) Each parent shall provide notification to the other parent of the parent's plans for 300 the exercise of parent-time for summer break under Subsection (7). 301 (b) For the notification requirement under Subsection (8)(a): 302 (i) in odd-numbered years: 303 (A) the noncustodial parent shall provide notice to the custodial parent by May 1; 304 and 305 (B) the custodial parent shall provide notice to the noncustodial parent by May 15; 306 and 307 (ii) in even-numbered years: - 13 - 1st Sub. (Buff) H.B. 370 02-06 12:20 308 (A) the custodial parent shall provide notice to the noncustodial parent by May 1; 309 and 310 (B) the noncustodial parent shall provide notice to the custodial parent by May 15. 311 (c)(i) If a parent fails to provide a notification within the time periods described in 312 Subsection (8)(b), the complying parent may determine the schedule for summer 313 break for the noncomplying parent. 314 (ii) If both parents fail to provide notice within the time periods described in 315 Subsection (8)(b), the first parent to provide notice may determine the schedule 316 for summer break for the other parent. 317 (d) If a custodial parent intends to interrupt a noncustodial parent's parent-time under 318 Subsection (7)(b)(ii), the custodial parent shall provide notification to the 319 noncustodial parent of the intent to interrupt parent-time within 10 days after the day 320 on which the custodial parent receives notification of the noncustodial parent's plans 321 for the exercise of interrupted extended parent-time. 322 (9)(a) An election should be made by the noncustodial parent at the time of entry of the 323 divorce decree or court order, except that the election may be changed by mutual 324 agreement, court order, or by the noncustodial parent in the event of a change in the 325 minor child's schedule. 326 (b) An election by either parent concerning parent-time shall be made a part of the 327 decree and made a part of the parent-time order. 328 (10)(a) Changes may not be made to the parent-time schedule under this section, except 329 that if a conflict arises in the parent-time schedule, the following order of precedence 330 shall be applied when determining which parent is entitled to parent-time: 331 (i) the holiday schedule for Mother's Day or Father's Day under Subsection (15); 332 (ii) the holiday schedule for the minor child's birthday, unless a parent is exercising 333 uninterrupted extended parent-time under Subsection (7) and takes the minor child 334 away from that parent's residence during the uninterrupted extended parent-time; 335 (iii) the holiday schedule for any holiday under Subsection (15) that is not Father's 336 Day, Mother's Day, or the minor child's birthday; 337 (iv) extended parent-time under Subsection (7); and 338 (v) the schedule for weekday or weekend parent-time. 339 (b) A parent exercising parent-time for the minor child's birthday may bring other 340 siblings along for the minor child's birthday. 341 (11) A stepparent, grandparent, or other responsible adult designated by the noncustodial - 14 - 02-06 12:20 1st Sub. Minimum schedule for parent-time for a minor child under five years 379 old. 380 (1) The parent-time schedule in this section applies to a minor child who is younger than 381 five years old. 382 (2) If the parties do not agree to a parent-time schedule, the schedules in Subsections (3) 383 through (8) are considered the minimum parent-time to which the noncustodial parent is 384 entitled to the minor child. 385 (3) For a minor child who is younger than five months old, the noncustodial parent is 386 entitled to: 387 (a) three two-hour visits every week; and 388 (b) two hours for each holiday granted to the noncustodial parent in the holiday schedule 389 under Subsection (15). 390 (4) For a minor child who is at least five months old but younger than nine months old, the 391 noncustodial parent is entitled to: 392 (a) three three-hour visits every week; and 393 (b) two hours for each holiday granted to the noncustodial parent in the holiday schedule 394 under Subsection (15). 395 (5) For a minor child who is at least nine months old but younger than 12 months old, the 396 noncustodial parent is entitled to: 397 (a) one eight-hour visit every week; 398 (b) one three-hour visit every week; and 399 (c) eight hours for each holiday granted to the noncustodial parent in accordance with - 20 - 02-06 12:20 1st Sub. (Buff) H.B. 370 400 the holiday schedule under Subsection (15). 401 (6) For a minor child who is at least 12 months old but younger than 18 months old, the 402 noncustodial parent is entitled to: 403 (a) one three-hour visit every week; 404 (b) one eight-hour visit on alternating weekends to be specified by the noncustodial 405 parent or court; 406 (c) an overnight visit on opposite weekends from Subsection (6)(b) beginning at 6 p.m. 407 on Friday and ending at noon on Saturday; and 408 (d) eight hours for each holiday granted to the noncustodial parent in the holiday 409 schedule under Subsection (15). 410 (7) For a minor child who is at least 18 months old but younger than three years old, the 411 noncustodial parent is entitled to: 412 (a) one weekday evening to be specified by the noncustodial parent or the court: 413 (i) beginning at 5:30 p.m. and ending at 8:30 p.m.; or 414 (ii) if the minor child is being cared for during the day outside the minor child's 415 regular place of residence and with advance notice to the custodial parent, 416 beginning at the time that the minor child is picked up from the caregiver and 417 ending at 8:30 p.m.; 418 (b) beginning on the first weekend after the entry of the decree, alternating weekends 419 beginning at 6 p.m. on Friday and ending at 7 p.m. on Sunday; 420 (c) each holiday granted to the noncustodial parent in accordance with the holiday 421 schedule described in Subsection (15); and 422 (d) extended parent-time for two one-week periods, separated by at least four weeks, at 423 the option of the noncustodial parent, as follows: 424 (i) one week of uninterrupted parent-time for the noncustodial parent; and 425 (ii) one week of interrupted parent-time where the custodial parent may have an equal 426 amount of weekday parent-time as the noncustodial parent on the same day on 427 which the noncustodial parent is granted weekday parent-time under Subsection 428 (7)(a). 429 (8) For a minor child who is at least three years old but younger than five years old, the 430 noncustodial parent is entitled to: 431 (a) one weekday evening to be specified by the noncustodial parent or the court: 432 (i) beginning at 5:30 p.m. and ending at 8:30 p.m.; or 433 (ii) if the minor child is being cared for during the day outside the minor child's - 21 - 1st Sub. (Buff) H.B. 370 02-06 12:20 434 regular place of residence and with advance notice to the custodial parent, 435 beginning at the time that the minor child is picked up from the caregiver and 436 ending at 8:30 p.m.; 437 (b) beginning on the first weekend after the entry of the decree, alternating weekends 438 beginning at 6 p.m. on Friday and ending at 7 p.m. on Sunday; 439 (c) each holiday granted to the noncustodial parent in accordance with the holiday 440 schedule described in Subsection (15); and 441 (d) extended parent-time for two two-week periods, separated by at least four weeks, at 442 the option of the noncustodial parent, as follows: 443 (i) two weeks of uninterrupted parent-time, which may be consecutive, for the 444 noncustodial parent; and 445 (ii) two weeks of interrupted parent-time, which may be consecutive, where the 446 custodial parent may have an equal amount of weekday parent-time as the 447 noncustodial parent on the same day on which the noncustodial parent is granted 448 weekday parent-time under Subsection (8)(a). 449 (9) For a minor child who is at least 18 months old but younger than five years old, the 450 custodial parent is entitled to one week of uninterrupted extended parent-time. 451 (10)(a) For a minor child who is nine months old or older, the noncustodial parent shall 452 have at least two times a week: 453 (i) brief telephone contact at reasonable hours and for a reasonable duration; and 454 (ii) virtual parent-time, if the equipment is reasonably available and the parents reside 455 at least 100 miles apart, at reasonable hours and for reasonable duration. 456 (b) If the parties cannot agree on whether the equipment is reasonably available, the 457 court shall decide whether the equipment for virtual parent-time is reasonably 458 available, taking into consideration: 459 (i) the best interests of the minor child; 460 (ii) each parent's ability to handle any additional expenses for virtual parent-time; and 461 (iii) any other factors the court considers material. 462 (c) Virtual parent-time supplements, but does not replace, in-person parent-time. 463 (11) For a minor child who is younger than nine months old, unless the parents agree 464 otherwise, parent-time should take place in the home of the custodial parent, an 465 established child-care setting, or other environment familiar to the minor child. 466 (12)(a) Changes may not be made to the parent-time schedule under this section, except 467 that if a conflict arises in the parent-time schedule, the following order of precedence - 22 - 02-06 12:20 1st Sub. (Buff) H.B. 370 468 shall be applied when determining which parent is entitled to parent-time: 469 (i) the holiday schedule for Mother's Day or Father's Day under Subsection (15); 470 (ii) the holiday schedule for the minor child's birthday, unless a parent is exercising 471 uninterrupted extended parent-time under Subsection (7)(d), (8)(d), or (9) and 472 takes the minor child away from that parent's residence during the uninterrupted 473 extended parent-time; 474 (iii) the holiday schedule for any holiday under Subsection (15) that is not Father's 475 Day, Mother's Day, or the minor child's birthday; 476 (iv) extended parent-time under Subsection (7)(d), (8)(d), or (9); and 477 (v) the schedule for weekday or weekend parent-time. 478 (b) A parent exercising parent-time for the minor child's birthday may bring other 479 siblings along for the minor child's birthday. 480 (13) If a holiday falls on a regularly scheduled school day, the parent exercising parent-time 481 shall be responsible for the minor child's attendance at school for that school day. 482 (14) A parent shall notify the other parent at least 30 days in advance of the parent's plans 483 for the exercise of extended parent-time under Subsection (7)(d), (8)(d), or (9). 484 (15) The following table is the holiday schedule for parent-time under this section. 485 486 Holiday Holiday Time Period Years Noncustodial Parent is Granted Holiday Years Custodial Parent is Granted Holiday 487 Dr. Martin Luther King Jr. Day (1) Holiday begins on Friday at:(a) 9 a.m. if the parent is available to be with the minor child; or (b) 6 p.m. at the election of the parent granted the holiday.
