47	47	Be it enacted by the Legislature of the state of Utah:

49	49	Section 1. Section 76-10-509.4 is amended to read:

51	51	76-10-509.4 . Possession of a dangerous weapon by a minor -- Penalties.

53	53	(1) As used in this section, "responsible adult" means an individual:
54	54	25
55	55	(a) who is 18 years old or older; and
56	56	26
57	57	(b) who may lawfully possess a dangerous weapon.

59	59	(2) An actor who is under 18 years old may not possess a dangerous weapon.

61	61	(3)(a) Except as provided in Subsection (3)(b), a violation of Subsection (2) is:

63	63	(i) a class B misdemeanor for a first offense; and

65	65	(ii) a class A misdemeanor for each subsequent offense.

68	68	(b) A violation of Subsection (2) is a third degree felony if the dangerous weapon is:

70	70	(i) a handgun;

72	72	(ii) a short barreled rifle;

74	74	(iii) a short barreled shotgun; or

76	76	(iv) a fully automatic weapon[; or] .

80	80	(4) For an actor who is younger than 14 years old, this section does not apply if the actor:

82	82	(a) possesses a dangerous weapon;

84	84	(b) has permission from the actor's parent or guardian to possess the dangerous weapon;

86	86	(c) is accompanied by the actor's parent or guardian, or a responsible adult, while the

88	88	actor has the dangerous weapon in the actor's possession; and

90	90	(d) does not use the dangerous weapon in the commission of a crime.

92	92	(5) For an actor who is 14 years old or older but younger than 18 years old, this section

110	110	(1) The terms defined in Sections 76-1-101.5 and 76-10-501 apply to this section.

112	112	(2) An actor commits unlawful possession, manufacture, distribution, or sale of a

114	114	machinegun firearm attachment if the actor intentionally or knowingly:

116	116	(a) possesses a machinegun firearm attachment;

118	118	(b) manufactures a machinegun firearm attachment;

120	120	(c) distributes a machinegun firearm attachment; or

122	122	(d) sells a machinegun firearm attachment.

124	124	(3)(a) A violation of Subsection (2) is a class B misdemeanor if the actor is 18 years old
